Terms of Service
By commissioning me, you are responsible for having read, understood, and agreed to my TOS. This TOS overrides and voids any client TOS.
Terms of Service are subject to change at any time. It is your responsibility to review this even after you've purchased artwork from me. However, if a change is made and I believe it will directly affect you, I will contact you accordingly.
Exceptions to my Terms of Service are allowed if discussed between myself, the artist, and you, the commissioner.
I. GENERAL TERMS
☆ Do not complain about my pricing or try to get things for less.
☆ Any ill behavior will not be tolerated. If it occurs: you will be issued a refund depending on the amount of work completed, I will block you, and you will not commission me in the foreseeable future.
☆ Follow the rules provided in the commission, YCH or Adoptable post.
☆ I have every right, as the artist, to decline your commission without providing a reason.
☆ Do not harass me for progress, but you may ask to see WIP, which I will provide at my own discretion.
☆ You may NOT under any circumstances commission NSFW if you are not 18+.
☆ I will NOT draw anything: racist, transphobic, homophobic, or hate related, drug use, mecha, or underage NSFW.
II. PAYMENT
☆ Do NOT send me money before I've confirmed the quote, details, and have requested you to.
☆ I take payment via Square or PayPal in USD via Paypal Invoice. Meaning I will need your paypal email.
☆ If not paid within 2 days of receiving an invoice, your slot will be canceled.
☆ Payment plans are allowed if the commission price is more than $100 total. Payment plans vary depending on the total price.
☆ Commissioner may pay 20% of the total price for commission priority; to be bumped up on the to-do list.
☆ For slot reservations, (For when my queue is long, I am closed for commissions, or taking part in a special project) I require a $10 downpayment for the reservation.
☆ Deadlines are accepted, but will result in a fee of +30% or more depending on the date.
☆ Private commissions will result in a fee of +$30% to the total price. Alternatively, I will replace your character in the piece with one of mine so that I may post it.
☆ I will charge a complexity fee within reason and will provide the reason.
☆ Adoptables designed by and adopted from me are 20% off for commissions of them.
III. PROCESS
☆ I will not begin work on your commission until after I receive payment.
☆ You must supply me w/ at least one flat color image of your character. Shaded pictures and text descriptions will incur an additional 30% to the total commission cost.
☆ I provide WIPs in the order of sketch, linework with flat colors, then the final product.
☆ Smaller commissions such as animated icons, icons, headshots, chibis (Option A), are exempt from receiving WIPs unless otherwise requested by the commissioner.
☆ If you wish for your commission to be streamed, I take additional payment for creating a set time aside to work on it.
☆ Patreon, etsy, and smaller commissions take automatic priority. Those exceptions aside, I try to work down my to-do list in order of those who've paid first.
☆ I provide the final product in full resolution to the commissioner via imgur links, or via email.
☆ In the case of Payment Plans, the commissioner will be provided with a full resolution image after 100% payment has been made.
☆ Turn around time can vary between 1 week - 3 months on a variety of factors including; commission slot priority, commission complexity, Patreon, merchandise deadlines, holidays, school, and family matters.
☆ If any of the above occurs, I will announce it via social media and in private to the commissioner.
IV. CANCELING / CHANGES / REFUND POLICY
☆ The commissioner may only request to cancel a commission for a full refund if a WIP has not been provided.
☆ Do NOT ask for a refund within 24 hours of purchasing a commission, otherwise, you will be put on a list of people I will be wary to accept comms from in the future, and if it occurs more than once, I will not accept commission requests from you anymore.
☆ Partial refunds may be given at any point, but the amount is entirely dependent on my own discretion and the commission’s level of completion.
☆Refunds will not be given once the commission has been finished. This is non-negotiable.
☆ If you file a chargeback, you will be blocked, reported, and put on a blacklist. I will also warn others about you, to avoid any other occurrences of this.
☆ I have the right to cancel and refund your commission at any given point in time, regardless of the reason.
☆ During the sketch phase of a commission, any changes are free of charge, within reason, so long as the changes requested coincide with the original description.
☆ After the linework phase of a commission, small changes are free of charge, but big changes where I'm required to re-do something completely (ex. change a pose) will come with an extra charge.
☆ After the completion of a commission, any change comes with an extra charge. I keep .SAI/.PSD files of all commissions for this reason.
☆ Adopts are not available for refunds.
V. COPYRIGHT / USAGE POLICY
☆ You may repost/share your commission wherever you please, as long as you provide credit.
☆ You may use your commission as an icon, header, advertisement, etc. as long as you provide credit.
☆ You may not claim the commissioned piece as your own work.
☆ You may not make a profit from the commissioned piece unless otherwise discussed, and given the okay from me, the artist.
☆ You may not use the commission commercially unless otherwise discussed, and given the okay from me, the artist.
☆ I have the right to use your commission as examples, showcase pieces, price sheets, prints, etc. (unless requested to keep private) with direct permission from you, the commissioner.
☆ You may not pay someone else to alter my work.
☆ I, as the artist, am permitted to post the commissioned piece and use it as a source of advertisement, unless requested not to.
☆ For reselling adoptable or customs you may not sell them for more than you purchased them for (unless there are additional pieces of commissioned artwork. You may not rise the price for gifted/free artwork to profit from).
☆ I retain all copyrights to my artwork.
☆ You may not edit my artwork without my permission.
