Commission Terms of Service

Thank you for considering commissioning me for artwork! Before we proceed, please read the following terms and conditions carefully:
If you commission artwork from me, you are agreeing to the following Terms and Conditions:
Commission Process:
1.1 Before any work is done, please provide a deadline if necessary. If no deadline is provided, I'll complete the commission at my discretion.
1.2 I'll begin work on the commission within 72 hours of receiving payment. You will receive progress updates as significant milestones are reached. If I haven't been in touch within 72 hours, it may mean that significant progress hasn't been made, communication is impossible, I'm busy working, or waiting for a response from you.
1.3 You can request updates on the commission at any time during the process.
Artwork:
2.1 I will create the artwork according to the client's specifications within my artistic style and abilities.
2.2 You cannot not resell any created works for a higher price than what was initially commissioned.
Payments, Cancellation and Refunds:
3.1 If the commission is cancelled by either party, I will refund you whenever possible.
3.2 If the commission is cancelled, you forfeit all rights to the artwork, and may not use, share, or distribute it by any material relating to the commission by any means.
I accept both full payments and partial payments, half up front, half upon completion. The final product will only be delivered once I have received payment in full. All payments are through PayPal using invoices, you will need to provide your email so I may send it.
All sales/payments are final for completed pieces, pieces are considered complete when both the commissioner and the artist agree to an artworks completion.
If no work has made been made on a commission (i.e. in queue, or during the 72 hour grace period, etc.) you will be refunded 100% of payment (Excluding service provider transactional cut if applicable.)
If work has been made on a commission, cancellations will provide a 50% refund.
Payment plans can be arranged, so long as the first payment is at least 50% of the final price; ask me for details if necessary.
Confidentiality:
4.1 You and any third parties may not distribute any incomplete, unfinished, and/or non-public material I share with you in relation to the commission, intentionally or otherwise.
4.2 If you share any completed content, you must credit me, Winterfloof, as the artist.
Legal Information
5.1 Rights to the art I create, including commissions, belong to me. You may neither sell nor exchange my art in any form, physical or digital, print or NFT, under any circumstances unless you have my express written permission. This includes, but not limited to, the use of my art in any published material, even free material, on any online or physical marketplace.
By commissioning artwork from me, you acknowledge that you have read and agreed to these Terms and Conditions. Failure to abide by any of the above terms on the commissioners part is considered a breach of contract.
FAQs:
Q. Are there any restrictions on the type of content you will draw?
A. I will not draw any content that includes, but is not limited to; Loli/Shota/Cub, Bestiality, Scat, Vore, Gore, Impalement, Torture, Excessive Muscles, Morbid Obesity, Anorexia, Hard Drug Use, Non-con, Hyper, etc. If you request any other content I won't draw that isn't listed, I will notify you when appropriate.
Q. Do you do NSFW?
A. I'm not publicly offering NSFW commissions at the moment, if this changes, this journal will be updated.
Q: Can I draw your character?
A: Sure! Just please don't be too mean to him. If you're unsure about the content that you're including my character in, please feel free to ask. Chances are, if I've already depicted the character in a certain way, It's fine for you to also draw them like that. This would obviously not include stuff like vent pieces as they are very personal to me.
Q: Will you make me free art?
A: No.
