Intro
Hey! First of, sorry for the lengthy text, but it's kind of necessary in order to avoid any misunderstanding. The name is Darkwarks, I am a furry/mlp artist (among other stuff. If you know, you know). This document is a TOS of sorts for anyone that wants to commission me. PLEASE read this document, as it will explain stuff such as prices, workflow, among other details that will help you better understand what you are getting yourself into. This document will be divided into sections so you can hop into the topic that interest you the most (again, please read the whole document at least once). I would like to point out that all commissions are being hosted on twitter. You can follow me darkwarks if you want to see some of my recent work, or if you want to commission me. If you are a minor, stop reading and get out.
COMMISSIONS/PAYMENT/WORKFLOW
For this section I'll assume that you've seen my commission sheet, so I'll skip the initial prices and stuff like that.
One of the things that I want to point out here is HOW I take commissions. In the past I've had peers and friends ask me to draw them stuff, however, most of them didn't describe what they wanted on the picture. This resulted in us bickering back and forth between details, clarification, assumptions, etc. To make long story short, it was a mess. So this section will deal more on the format of how you should describe your commission, as to avoid small conflicts due to lack of communication. I've found that a small paragraph works best for describing what you want, without overwhelming both of us. The paragraph should be a description of what is happening on the image; what is going on, who is there, where are they, props, actions, etc. PLEASE, don't write a fucking essay, as that is overkill, and quite frankly, I will be too fucking lazy to read it.
Example of a BAD description:
Can you draw my two OCs fucking? Like, make it as HOT as you can and add lots of cum.
The problem with this description; I don't really know what you are looking for. Sure, I can draw your two OCs fucking, but that can mean multiple things, not to mention, I won't know if you are not OK with certain aspects within the drawing (aka: if one of your OCs is a dom while the other one is a switch, if one of your OCs is into feet, etc).
Example of a DESCENT description:
[character_1]'s hand would be holding [character_2]'s hand as [character_1] is ramming his cock into [character_2]'s ass. Ideally they would be in a cuddle position (see ref_1) and [character_2] would be cumming all over the floor.
The description above gives me something to go off from. It's not too descriptive, but at least I have something to start with.
Example of a GOOD description:
In this scene [character_1] is lifting [character_2]. Both are are looking deeply at each other's eyes, [character_1] trying to play it smug while [character_2] has a look of being relieved. [character_1] is cuddling and grabbing [character_2]'s hand as [character_1] is plowing [character_2]'s ass. [character_1] is visibly tired and is trying their best to hold their climax, but [character_2] is already cumming buckets to the point of making a mess in the floor.
Not the best description, but better than the previous two. I can imagine what is being done, what is each character's expression, even the description kind of gives a glimpse at their personality. REMEMBER you can be as descriptive and explicit as you want. The more details you write, the better I can make your drawing.
Ideally, the more descriptive you are the better. BUT please, don't write an actual story. Unless it's REALLY important to the drawing, I don't need to know your OC's background, their childhood, hobbies, likes, dislikes, favorite music genre, favorite game, or any other misc details. The description should be ONLY describing what is going on in your drawing.
(I would like to make a note here to mention that yes, I also do SFW.)
Another thing that I would like to talk about is payment. I only accept payment via PayPal, and all the prices are in US dollars. In order for me to work on your commission you must pay for half of the FINAL price. So, if you want a Line Art drawing with a background (assuming it's a simple one), you would have to pay $10.00 up front. For me to deliver the final product, the full payment (aka the full $20) would have to been payed. I am willing to make accommodations in special circumstances, however, what those accommodations are will depend on your situation.
Once I start working on your drawing you can ask for updates at any time (please don't ask for an update THE SAME DAY that you commission me. I get that it is funny, but please don't). My idea of an update is; a snippet of the drawing with my signature in it. Note that I said snippet, this means that you won't get the full drawing as an update. This is my way to counter the cunts that ask for updates only to cancel on an artist and take the update as their free commission.
Talking about canceling; you are free to cancel anytime BEFORE I hit half way trough your drawing. What this means for each option:
Sketch: Honestly, this takes me like 5-30 mins to draw depending on complexity. So you can cancel at any time for this one I guess.
Line Art: I will consider the drawing to be halfway done when I am done with the sketch. Note that the sketch includes the background and props if applicable.
Monochrome: I will consider the drawing to be halfway done once I am done with the line art. Note that the LA includes the background and props if applicable.
Color: Much like Monochrome, I will consider the drawing to be halfway done when I am done with the Line Art. Note that the LA includes the background and props if applicable.
"Ok, I've canceled my commission. Now what." Pues ya wey, te jódiste. No dibujo para ti XD. Na I am just messing with ya. If you cancel a commission you will get the current process of your drawing. If you've payed more than half of your drawing, and you canceled, then I'll refund you the total amount you have payed so far, minus half of the Final Price ([amount payed so far] - [Full Price / 2]). This means that, if you only have payed the required half price and you canceled, then you don't get a refund.
I do this because, it's only fair that I get payed for my time and effort. I only have so much time, I don't find it fair that I am putting time and effort into a commission, only for someone to cancel and get pay scraps for my work.
REFERENCES
If you have references such as posses, ref sheets, color palette, or any other image that can help me visualize your drawing better then you are more than welcome to send them to me. References can help me get a better grasp on how you want the drawing to look like, as well as, dealing with props/background. HOWEVER, there are certain limit with the things that you can send me as references:
1. Images of any living or dead person: I won't draw anyone that is real. You can send me the image if you want me to reference the pose, clothing, hair style, etc. BUT I WON'T DRAW THE ACTUAL PERSON IN THE IMAGE. The same goes for animals; if you want me to draw a breed of dog, cat, lizard, or whatever, then it's better to just send me the name of the breed. It's ok to send me an image of an animal if you don't know the breed, but don't expect that specific animal to be drawn. You can still send me the image of an animal to REFERENCE the pose, clothing, hair style, among other stuff.
2. Images from other artist: You must prove that the artist you are using as a reference is OK with their work being used as references DURING the time that you are commissioning. None of that crap of "X artist was ok with people using their art 12 years ago, so that counts right?" You must show proof that they CURRENTLY are ok with people referencing their work. Additionally, they can DM me in twitter (@darkwarks) to send me a message stating that they are ok making an exception for you. (PLEASE use the account that THEY give permission for. Don't use a smurf account.)
3. ANYTHING resembling illegal stuff: Listen, shit is already hard as it is. Don't send me stuff that can put me in a list.
KINKS/FETISHES AND PRIVACY
I am sure some of you scrolled down looking for this section. Well I am happy to announce: ALL KINKS ARE WELCOME! Seriously, doesn't matter what you are into, so long as no real person/being is being harm, I don't care. That being said I would like to point out that I haven't really dwelved into gore, scat, and waterworks. So, depending on how complex your drawing is and how picky you are, you might be better off finding another artist for these works.
Now, some of you might be thinking "Well, I have an idea for a drawing that involves [hard fetish]. But I don't want people to know that I am into that." Fear not my degenerate friend, for I am no snitch! Whatever comes out during the commission process will stay in the commission process. Unless you want to keep in contact AND you are ok with it, I won't bring up any kinks/fetishes that you have told me. I know shit is hard out there, specially in this political climate, but I want you to know that your secret is safe with me. Doesn't matter if you backstab me, double cross me, talk shit about me, or whatever. I will tell no one.
The ONLY exception to this rule is, surprise surprise, if you send me or talk to me about anything illegal. I would like to clarify that stuff like cub, feral, loli, and other works of art DOESN'T COUNT as illegal material. Shit is imaginary, no real person/being is being harmed, it's just a bloody drawing. And no, I am not interested in debating this. If you don't agree, then:
a) I respect your opinion.
b) Métete tu opinión por el culo, pinche baboso! I didn't ask for it.
OWNERSHIP/POSTING
By default, I am the owner of the DRAWING. This means that I am free to post, re-post, remix, edit, print, sell, wipe my ass, and overall do whatever I want with the drawing. However, the character's ownership goes to their respective owner. By commissioning me, unless the character is from a copyrighted source included but not limited to another artist or tv show, you are giving me permission to do whatever I want WITH THE DRAWING. I would like to note that, just like any of my normal drawings, you are also free to post, re-post, remix, edit, blah blah blah you get it. SO LONG AS; you credit me as the creator of the original drawing.
By default, I will send you the finish drawing (upon full payment) and you will have 3 days of exclusive access to the drawing. After 3 days, I have the right to post the drawing on any social media platform that I want. Of course, I shall give credits where credits are due. This means that I shall credit you as the commissioner whenever I post the drawing. IF FOR ANY REASON YOU DON'T WANT TO BE CREDITED, you can let me know and I'll leave your name out of it.

Welp, I guess that is everything that I have for the TOS. I would also like to point out that these TOS can change at any time. As a commissioner, you are only tied to the TOS version that was up when you commissioned me. AKA If you commission me on September 30, and the TOS changed on October 3rd. You are tied to the version that was available on September 30.
