Commission Terms of Service

Terms of Service
1. These terms are equally binding to the client as well as the artist, hereafter referred to as DraconiArt.
2. All terms must be followed, failure to do so may result in a cancellation and refund of the client’s commission and potential blacklisting.
3. These terms may be subject to change at any time.
1. Client Rights
a. The client may:
i. Request a refund BEFORE the commission has been started (the client will be informed when DraconiArt has begun their commission).
ii. Request edits once the commission is finished ONLY if DraconiArt missed any markings, accessories, etc.
iii. Keep the unwatermarked version of their commission for private use (such as a phone or computer wallpaper).
iv. Repost the watermarked version of their commission with credit on art/social media sites, and other public areas.
v. Print the watermarked version of their commission for private use (such as posters or framed prints).
b. The client may NOT:
i. Request a refund once DraconiArt has begun on the commission, or after it has been finished. There are NO exceptions to this rule.
ii. Request pose or background edits to the commission. DraconiArt currently only offers artistic liberty commissions, the only alterations the client may request are for accuracy to the character’s markings.
iii. Continuously ask DraconiArt for updates or work in progress images (WIPs). Because these commissions are artistic liberty, there will be no WIPs. The client will be given one warning on this before their commission is cancelled.
iv. Repost the unwatermarked version anywhere public (this includes art channels in places such as Telegram and Discord).
v. Repost or “feed” the commission into AI image generators, or convert them into NFTs.
vi. Use the commission for commercial purposes, or for profit of any kind, whether digitally or physically.
vii. Claim the art as their own work.
c. A failure to adhere to these rules will result in an immediate cancellation and possible blacklist. DraconiArt also reserves the right to notify other artists if the client is found to be in violation of any rules.
2. Client Responsibility
a. The client MUST own their own character when commissioning DraconiArt. If the client is found to have commissioned art using a character they do not own (unless given explicit permission to use the character from the original owner), the commission will be cancelled immediately, unless it has been completed, and the client will be blacklisted.
b. The client must provide a clear visual reference of their character, with all markings and accessories visible. The reference should be unshaded, and there must be a color palette for use. If the client does not have a proper reference sheet, they may provide other art of their character, but they must link a usable color palette as well. DraconiArt will NOT work from written descriptions or “mood boards” of characters.
c. The client MUST provide proof of age if they are wishing to commission an NSFW art piece. This will be a photograph of a valid government ID (all information may be blurred or marked out, so long as the date of birth is visible) alongside a piece of paper with both “DraconiArt” and the current date written on it clearly.
d. The client must read through these terms fully and completely, and fill out the Google Form correctly (this step is outlined more fully in Section 3).
e. It is highly recommended the client keep both the watermarked and unwatermarked versions saved in a permanent location. DraconiArt will hold onto completed commissions for two weeks before deletion.
3. The Commission Process
a. By submitting a Form, the client indicates they have read these terms carefully and completely.
b. The client must be ready to pay before commissioning. If a payment is missed by the deadline, they will be given one warning. If a second instance occurs, they may be blacklisted (with exceptions for emergencies on the client’s part; these will be decided on a case-by-case basis).
c. The Google Form must be filled out completely; failure to do so may result in a rejection of the client’s commission. If the client has any questions about the Form, they may contact DraconiArt (Section 7b).
d. All communication will be held either through Bluesky, FurAffinity, or email, depending on which option the client selects in the Google Form.
e. The client must respond to any messages from DraconiArt in a timely manner. Frequent extended delays in communication may result in a cancellation and refund, unless the client provides a valid explanation for response delays.
f. DraconiArt will send a watermarked version of the art to the client once they are finished. If ANY markings or accessories are missing, it is the client’s responsibility to point them out.
g. While the expected turnaround time is one to two weeks, DraconiArt does not offer official deadlines at this time. The client will be notified of any emergencies or situations on DraconiArt's behalf that may cause a delay in completion times.
h. Once the commission is finished and has been approved by the client, DraconiArt will send them the unwatermarked and watermarked versions by email. Once this step is completed, the commission will be unalterable, even if markings are missing.
4. Payment
a. All commissions must be paid for in full before work is begun. Once an invoice has been sent, the client will have 48 hours to pay. If payment is missed, DraconiArt will contact the client; missing the deadline again will result in a cancellation of the commission.
b. Payment is currently done through PayPal invoices only.
c. All prices will be in USD, and the client is responsible for figuring out any necessary currency conversions.
d. If the client needs to cancel their commission, they may do so if the commission has not yet been started. The client must provide an explanation for needing to cancel.
e. Commissions cannot be cancelled once DraconiArt has begun working on the art.
f. If the client forces a refund at any point during or after the commission, they will be immediately blacklisted and a beware will be posted.
5. Cooldown Period
a. Once a Google Form has been submitted (unless the client makes an error and has to resubmit), there will be a mandatory two-week cooldown period before they are allowed to apply for a commission again, regardless of whether their commission is accepted. If the client attempts to submit another Form before two weeks have passed, they will be given a warning. Repeated submissions will result in a blacklist.
b. While DraconiArt will keep a log of this cooldown period, they will not notify the client once the period is up. The client is responsible for keeping track of this themselves.
6. Will/Will Not Draw
a. DraconiArt WILL draw the following:
i. Any original character (OC) that is owned by the client.
ii. Most furry/“scalie” species.
iii. Characters of any sex or gender identity.
iv. SFW, suggestive, or regular NSFW scenarios.
v. Most vanilla kinks.
vi. Characters with moderately muscular, curvy, or chubby bodies.
vii. NSFW works of non-bipedal dragons provided they are obviously sentient (this includes species such as quadruped dragons, Eastern dragons, wyverns, etc.)
viii. SFW works of non-bipedal animals (such as quadruped canines, felines, equines, etc.)
ix. Moderately simple clothing (such as a shirt and pants, a dress, pajamas, etc.)
b. DraconiArt will NOT draw the following:
i. Official/licensed characters, or any character that not owned by the client (this includes doing fanart for any official or licensed characters)
ii. Human/humanoid characters, robotic characters, or any other non-furry species.
iii. Underage characters, regardless of whether the piece would be SFW or NSFW.
iv. Multiple-character pieces (tentacle scenarios are not included here).
v. “Harder” kinks (these are entirely on a case-by-case basis unless specified in this section; if DraconiArt does not wish to draw or feels uncomfortable drawing a kink, they will let the client know).
vi. Bathroom kinks; CNC/non-consensual scenarios; “cucking”; blood or violence; scenarios involving hate speech or discrimination; religious iconography; feral NSFW; and incest are not allowed under any circumstances. Once again, any kinks not listed here will be decided on a case-by-case basis.
vii. Heavily detailed/complex clothing, such as lace.
viii. Characters with hyper/excessively large proportions, whether these are the entire body, the breasts, the genitalia, or anywhere else.
c. If any items are not covered in Sections 6a or 6b, it is best to ask DraconiArt before submitting a Google Form. The client may contact DraconiArt (Section 7b) if they have any questions.
7. DraconiArt Contact Information/Social Media
