If it's non fatal than means they'd either be conscious but in pieces or unaware because they can't think as a statue.

I think the former is much more interesting. What's the point of shattering a statue that can't be cognizant that it's being damaged?

They don't even necessarily need to feel pain as a statue, though distress as they are broken seems warranted (tho mostly by internal monologue since they can't speak or object)
