TOS for commissions

Been meaning to post this for a long time. Finally typed my commission terms of service. Feel free to ask any questions
First off, thanks for your interest in commissioning me. I enjoy doing commissions and working with customers to produce a painting that both satisfies my desire to create and meets your vision. Most of the below is a guideline and I tend to be flexible. If you need any clarification please enquire.

REFUSAL OF SEVICE
-I reserve the right to refuse service for any reason.
SUBJECT MATTER
-I paint a wide variety of subjects. Including. Pets, wildlife, fantasy, furry
- I will accept a wide variety of ratings up to and including explicit erotica. Don’t be shy. It’s best to just come out and ask for what you really want. I do not judge. But here are some subjects I will not depict. Examples sexual depictions of children,scat/water sports, vore, snuff. Especially complicated tech.
-I will accept some copyrighted characters. Best to inquire about specifics. Some of the aesthetics do not suit my style ie Sonic.
-if you wish me to depict other peoples characters it is up to you to have that permission. This is a touchy area.
COPYRIGHT AND USE ISSUES
-I retain full rights to reproduce the art for prints, art collections, portfolios.
-I retain the right to post the art to art sites , my web page or for advertising. I’m flexible on not posting if the customer does not wish. I do not tend to identify the customer when publishing unless expressly requested.
-For an additional fee the customer can purchase full rights to the artwork. This will not be cheap.
-All rights not otherwise expressed are retained by the artist,
-you may post the art to sites, use it as an icon/ avatar or print off for your personal use. You may not remove the signature. You may not alter the work other than to crop for use as a icon etc.
- if the painting is not adult in nature I usually post a step by step on my Patreon as I complete the painting.
PAYMENT
-prices are subject to change. Prices listed are base prices.
-there might be additional fees for multiple characters ,complex designs, complicated backgrounds.
-payment is through PayPal in USD. Larger more expensive commissions can be paid for in prearranged instalments. Generally half is due up front and the rest after the sketches has been approved. In any case the art is not shipped or large scan sent until. The commission is paid in full.
-Once the commission is fully paid for, a high rez scan will be sent and the completed painting will be shipped.
PRICES
- Most paintings are some combination of ink, acrylic, watercolour, coloured pencil and a wide variety of other materials. I usually paint on illustration board or watercolour paper.
BADGES $75
- original art is painted 4.25x5.5. You get this art, plus a printed copy 4x3 with the name digitally added, and laminated ready to wear.
BOOKMARKS $75
- original is 3x10. You also get a set of four printed and laminated.
Aceo cards $30
2.5x3.5 one character per painting
REFERENCE SHEETS
$500. This includes an 11x14 original with front and back views of the character, three mood shots and a limited number of important objects ie swords, jewelry etc. You also receive a printed out version with digital text added. And a high res copy to print out more for personal use.
COMIC PAGES
$300-$500 price varies on complexity

11x14 $300 2characters. $450
16x20 $600 2 characters $ 900
20x24$800 2characters $1200
I can paint any size so if you need particular dimensions please request a quote. Largest work I can do is 30x40.
For each additional character add half again.
THE PROCESS
-the first step is easy. Just email me and inquire if I am currently taking commissions. I most often am but sometimes I am busy.
- describe what you want in some detail. Want to make me happy? Give me your character, a general idea what you want, and say go for it. You get the best commissions this way.
- link to any references for characters or details. Very useful. I can work without this but it makes my job easier if your character has specific markings etc.
- I do a pencil sketch. This is sent to you for approval and comments. You can ask for tweaks or changes at this point. If there are major changes we go back and fourth till you’re happy. I don’t tend to charge for this unless it gets excessively nit picky. I want you to be happy. On rare occasions I have had to reject a commission due to the customer never being satisfied but it’s very rare. The customer had their deposit retuned and I walked away with no hard feelings.
-once the pencils are approved I move on to complete the painting. A quick turnaround on approval is highly appreciated.
-I complete the painting and send a small jog for the customer to check out. I can make small tweaks at this point but only small ones. I usually post it to FA at this point.
-painting is packed up and mailed to the customer. I live in Canada so shipping is a tad expensive and depending on the border can take some time. I use Regular post for small pieces and shipping is usually around $15. If you want tracking and signature it’s $40. Larger paintings are around $40 or $60 with tracking, really large works are mailed UPS and require a purpose built box that adds to the price.
TIMING
-once you reach to top of my to do list, things move pretty quickly as long as you respond to my questions in a timely manner.
-Having said that I am occasionally backed up on work and you have to wait in my que. in that case you will be told a general idea of how long you have to wait.
-conventions and commercial jobs can distract me too. If you are commissioning a gift or other time critical painting please let me know and I’ll try to work something out.
