I was recently asked for a TOS and I didn't have one so I figured I'd make one for folks' reference! I made it as thorough as I can but if you run into any questions just let me know! If I ever decide to sell fursuit comms here, there will be a separate TOS page :)
Things you MAY do with my art:
-- If you commissioned the art you may use it for personal, non-commercial projects such as using it as an icon, banner, or lockscreen, etc, or for making it into physical stickers, t-shirts, or other goods as long as they are NOT SOLD to others. If you did not commission the art and simply find something you like in my gallery, Note the owner of the character instead to ask their permissions :)
-- If you commissioned the art you are free to post it to any of your online galleries (including but not limited to Twitter/X, Bluesky, FA, DA, Tumblr) but ONLY with credit given! If I have a social media account at that location (please see below for full list) please credit me there, if not please credit this account and/or my main account FenrisTheFirecat
-- You may trace my art but ONLY for practice to learn what I do, and ONLY if you will not post your traced work anywhere.
-- You may use my art for reference only, meaning you do not base your entire piece off of mine. You may post your referenced piece but only if you credit it as having been referenced from mine.
-- If I post a custom description for your artwork (such as a short poem or funny saying) you are more than welcome to use the same description for your post as long as you credit me for it.
Things you MAY NOT do with my art:
-- You may not use any of my work to train AI learning of any kind. You may not base your AI algorithms off of my art even if you do not post it.
-- You may not use your commissioned art for profit of any kind. This means if you create physical goods based off of your piece (or any other piece in my gallery), you may not profit off of the sale of these items. You may only create physical (or other) goods for personal use or FREE distribution with credit given. You also may not sell art that was traced from mine. If you are interested in commercial rights please mention that during your initial commission Notes and I will try my hardest to accommodate you, though there may be additional costs .If I see you selling products with my art on it that was not commercially licensed, or if I see you selling art that was verifiably traced from mine, you will be Blocked, Banned from future commissions, and you will be reported on the marketplace on which I found the item(s) listed.
-- You may not use any of my work as a tattoo design. If you want a tattoo design commission please reach out for that directly. If you were the commissioner and REALLY want your artwork made into a tattoo please Note me and I may make an exception, but I'd be much happier designing a piece for you that was meant to become a tattoo.
-- You may not trace my art for ANY sort of work that is redistributed or sold. This includes tracing my Telegram stickers and using them for your own pack. If you trace my art you may not post it ANYWHERE! I would be happy to let you use my art as a tool for your learning, and you are welcome to reach out with art questions and I will always help if I have the time! But tracing/redrawing is only a learning tool to grasp shapes, proportions, values, and line language and NOT to create a finished piece of your own! Tracing can be a valuable tool but only when implemented properly, so you should consider starting by tracing real animals and people instead! Please respect this and apply appropriate art tutorials if needed! I would be happy to send some of my favorite resources if needed :)
-- You may not claim any of my art as your own. I do not watermark my art (with rare exceptions) but I do sign it. Please do not alter, remove, relocate, or shrink my signature. You are also not allowed to alter a finished piece, such as vectorizing it to make it transparent or redrawing it for a logo. If you need a piece altered or updated in any way please Note me! I will be happy to make many kinds of alterations for no cost, and will provide a quote if needed for larger undertakings. -- I may post my art to any of my social media accounts including (but may expand in the future): Discord (DennisTheDirewolf), VGen (TheArtCzar), Twitter/X (TheArtCzar), Bluesky (FenrisTheFirecat), or Instagram (TheArtCzarIG)
-- If you commission me for fanart of an existing copyrighted character I reserve the right to sell merch of this artwork if I desire to do so.
How the Artwork Commission Process Works:
-- You may pay via PayPal or CashApp. I recommend PayPal because it has buyer protection, CashApp does not give you the option to request a refund even if you were outright scammed (which is why you should be careful on Craigslist). I intend to always be trustworthy with your money and complete your commission no matter how long it takes me (Luke 16:12) but if you don't know me and haven't worked with me before, or if you just want to be extra careful, I cannot stress enough that PayPal is the better payment method for your peace of mind and buyer safety. You may ask for a payment plan for any custom commission over $50. PWYW and YCH art must be paid upfront in full. If paying by PayPal I understand if you do not wish to send your art via Friends and Family. If you send through Goods & Services PLEASE click the box for "no shipping needed" or I will refund you and you'll have to send it again. If you do not click this box PayPal may fine me if I do not physically ship you something. If you are needing a refund (read below for more info) please CONTACT me to set it up. If you chargeback your payment, I will block you and all of your accounts, ban you from future commissions, and report your PayPal account.
-- You may commission if you are under 18 but I will not draw anything remotely suggestive/NSFW or something that is illegal as a minor (such as art of someone drinking alcohol or smoking tobacco). I will draw drug usage but only for characters over 18. If you are an adult and you ask for a Suggestive idea I MAY need to see an ID or other verification that you are over 18.
-- You will only receive WIP (Work In Progress) updates for certain commission types. You will not receive them for PWYW art under a certain price, nor will you receive them for YCH art at any price. For those types, your art will be shown to you once finished and you may request revisions only if something is wrong. If you are paying for full-price art (art that is not part of a PWYW special) you may request as many revisions as you need as long as we are still in the sketch stage. Once I start lines you will receive no more revisions unless I have done something erroneously (missed an accessory, overlapped lines, etc). At the outset of a commission you will receive an explanation of the WIP stages if they supercede this (such as, if your commission type is a special deal or something not commonly offered), but otherwise they are as follows:
Quick n' Dirty Colored Sketch: No WIPs
Cleaned Sketch: Rough sketch WIP, Cleaned Sketch WIP
Cleaned Colored Sketch: Rough sketch WIP, Cleaned sketch WIP, Colored WIP
Inked Flat: Rough sketch WIP, Cleaned sketch WIP, Ink WIP, Colored WIP

-- With the exception of reference sheet commissions, I do not work off of character descriptions. I will need to see clear existing art of your chracter or a reference sheet to draw your character, unless it is fanart. Your reference sheet must either be digitally drawn, or you must be able to provide digital color swatches. To make sure I get it right for you, I prefer to see the EXACT colors you want.
-- I cannot guarantee Turnaround Time for commissioned work so if you have a hard date by which you want something, please be very clear about that at the outset of the commission and I will try my hardest to accommodate it. If your date is very soon, your commission MAY be subject to a rush fee. If you do not pay for a rush fee, please do not rush me and please understand I have work outside of artwork and cannot always reliably sit down to work on art. I will always keep you updated ahead of time when planned disruptions (such as family gatherings) will keep me away from art, and if unplanned disruptions (such as medical emergencies or getting called into work) happen I will try to update you about them as soon as possible. I will mark commissions as CLOSED when I am expecting a vacation or other long-term period that I cannot work on art. Other than that I will update you at every point a new WIP is available, and will try to respond to any of your messages as quickly as possible.
-- I prefer to move communication over to Discord if possible, but if you wish to keep your entire commission process over FA that's fine! Just know that I'm slower at replies here (since obviously FA doesn't have push notifications).
-- I issue refunds on an as-needed basis. If you experience a sincere financial hardship, issues with your payment method of choice, falling out with someone you were getting a piece together with, etc you may reach out for a refund. If you are unable to finish the commission due to emergencies or other life struggles, please let me know and I can at least get your artwork as cleaned as possible in its current state before I issue the remaining refund. If you are simply no longer interested in the piece, I will discuss with you whether I finish its current state or whether you opt for a higher level of refund. Once paid in full, you are only eligible for a refund of 100% until I start work. Once sketch has started you can only receive a refund up to 75%. Once lines have started you may only receive a refund up to 50%. Once lines are finished you may only receive a refund up to 25%. Once colors are started you will not receive a refund. If you opt for a payment plan, refunds are a bit more strict. Payment plans and their according refunds will be case-by-case but will be explained to you at the outset of the particular commission if applicable.
-- I may reject a commission idea for any reason, including if I believe I will not be able to draw it well enough for you, or if I might not be able to meet your desired due date. I will also turn you down if you have been known to interact with z*ophiles, p*dophiles, or hate groups. If I accept an idea however, please expect me to finish it. I will only ask to cancel/refund if personal emergencies happen and I am not able to finish it. I WILL TURN AN IDEA DOWN IF I DON'T THINK I CAN MAKE IT HAPPEN! I don't just try to make a piece exist for you, I try to make it as close to exactly what you want as possible. I always try to give 100% on my artwork and make things RIGHT -- correct anatomy, correct colors, correct poses, correct clothes -- I want to make it good and as an artist I strive to do my best! If I don't think I can get it right I may turn it down, and I will be happy to recommend other artists that I believe could be good for your idea.
-- Please be courteous and understanding, I am not just a cymbal monkey at your behest, and I'm not just words on a screen. Please be patient if I have bad health days, work disruptions, family emergencies, or other issues that cause me to take a bit longer on your piece. Please also do not be mean to me (or to be hateful in general) while talking to me. I will treat you and your commission with the utmost integrity and I hope to make the process as pleasant as possible! I ask for respectful communication in return.
Things I Will / Won't Draw:
-- I can draw humans/humanoids, anthro, feral, fantasy creatures, and others! If you're not sure feel free to ask, but either way I'll try! Complex characters (including mech), complex outfits (such as armor), and complex backgrounds may include additional costs.
-- I will draw SFW or suggestive but I will NOT draw explicit art! No aroused genitals or intercourse! I am not a p*rn artist. Artistic nudity or suggestive (including kink gear) are fine. If you want to get a gift for a friend or character that isn't yours, that's fine, but I will NOT do suggestive art of that character unless I get approval from its owner. If your idea is not inherently explicit but still makes me uncomfortable I will politely decline it, please respect this.
-- I will not draw religious themes*, hate art, political themes (with the possible exception of fake political figures), feral suggestive of any kind, or minor characters. If the character is a minor in my country but not in your country I will draw them but ONLY fully clothed and NO suggestive content of any kind. *For religious themes: If you or your character have sincere religious beliefs and symbols are included as part of a character design (Cross necklace, Star of David Earrings, Head Coverings, etc) I will draw them. But I will NOT draw any Satanic or anti-religious symbolism even if they are part of the character design. Pentagrams and Norse Runes (due to their association with hate groups) are case-by-case. I will similarly not draw ideas sexualizing religious themes (sexy nuns for example). I will not draw historical OCs having to do with the Axis and prefer not to have to draw Soviet.
-- I will not draw art in styles other than my own, with VERY few exceptions!! If you have a toony character you must be okay with me adapting it to my semi-realistic style! If you want fanart of a character you generally must be okay with me adapting it to my style! If I absolutely cannot adapt a fanart character into my style or I'm not comfortable adapting to their style, I may turn down your commission.
-- I will draw backgrounds but I am not super experienced with them. I may turn down your idea if I believe I am not capable of bringing it to life, or I may ask to revise it to something simpler that I believe is in my wheelhouse.
