✦ Gemini Moon Adopts — Terms of Service ✦



By purchasing, bidding on, trading for, or receiving any design from me, you agree to the following terms.



✦ Payment ✦



• Payment is through PayPal unless stated otherwise

• Payment must be made upfront and sent within 24–48 hours unless a hold or payment plan has been approved beforehand

• Please do not bid, claim, or offer if you are not able to pay

• Payment plans may be considered for higher-priced adopts/designs

• Ghosting, backing out, or non-payment without communication may result in being blacklisted from future sales



✦ Ownership / Personal Use ✦



• Once bought, you have full ownership of the character for personal use, with the exceptions listed below

• You may redesign, use, and repost the character as you please

• You may change the name, pronouns, gender, outfit, personality, style, and other design details 🥰

• Personal use includes things like Toyhou.se, roleplay, writing, character profile sites, fanart, and similar uses

• Credit is appreciated. You do not need to credit me every single time, but if you repost the original artwork, crediting me once is enough ❤️



✦ Trading / Reselling / Transfers ✦



• Trading, gifting, and reselling are allowed

• You may re-home the character for any value

• Owners can be changed without notifying me

• If reselling or transferring the design, credit to me as the original designer must remain attached to the character/design

• If you want to make art of one of my designs after it has been sold, always ask the current owner for permission first



✦ Commercial Use / Artist Rights ✦



• Commercial use is not automatically included and must be discussed with me first

• If an adopt/design was bought in an auction, the price for commercial use may be higher

• I may still post the design and original artwork in my portfolio, galleries, or social media as the original creator, and will credit you as the current owner where appropriate

• I also reserve the right to re-use my bases for future adopts if I choose to do so



✦ Restrictions ✦



• Do not claim my original art as your own

• Do not steal, copy, or heavily rip off my designs

• Do not make identical art of an original adopt you did not buy, especially in the case of a Closed Species

• If I make an Open Species, you may use it, just do not completely rip off the exact design I made for an adopt 😊

• Do not use the character/design in any illegal fashion

• Do not use the character/design to promote hate speech, bullying, abuse, or similar harmful content

• Do not edit another owner’s bought adopt/design without their permission



✦ Tracing / Referencing ✦



• I understand that tracing or referencing artwork can be part of learning and growing as an artist

• Using traced work as a study, guideline, or reference is fine for practice

• You may only post traced pieces based on my work if you have bought the character/design first

• Violating these terms may result in blacklisting / being blocked from future sales or auctions



✦ Refunds ✦



• No refunds after payment has been completed and the design has been transferred, due to the nature of adopts

• If you no longer connect with the design, you may re-home it instead

• The only exception is if I am unable to complete my side of the transaction



✦ Holds / Reservations ✦



• Holds may be considered under specific circumstances, so please do not abuse this

• If approved, I am willing to hold a design for 3–5 days before it goes back up for sale



✦ Delivery ✦



• After payment, you will receive the full images in PNG format, including versions with and without the background, and un-watermarked

• If you have a Toyhou.se, I can transfer the character to you there

• If email is preferable, I can send the files that way instead

• If you would prefer another delivery method, please let me know



✦ General ✦



• My TOS applies to all adopts/designs unless otherwise stated on a specific post or character

• I do not currently offer customs / commission work, but they may be considered in the future

• Anyone who steals, scams others using my designs, falsely claims my artwork/designs as their own, or does charge-backs may be blacklisted from future sales
