Exposing a child to anything so sexual in nature, in person or otherwise (i.e. electronically) is not acceptable. I don't care if it's how you and your friends relax or bond or relieve stress, and I don't care if you delete the journals about it - "statutory rape" and "paedophilia" are perhaps too extreme phrases to apply to it, but how the hell can you rationalize that cybersex with a minor is something which is okay?
- "Corrupting a minor. Lewd and lascivious acts with a minor. Contributing to the delinquency of a minor. (regardless of there being no intent to meet, webcam solicitation, or transmission of pornography)"
- "Any solicitation of sex with a minor is criminally punishable. If you are caught, in addition to severe criminal charges, you will be registered as a sex offender. The law DISAGREES with you when you solicit sex from a minor."
- "These laws set up to protect children from exposure to harm. You might call it 'experimenting' but the state might call it 'criminal conduct.'"
- "According to the FBI the following steps are to be taken by parents if children are solicited for cybersex:
Should any of the following situations arise in your household, via the Internet or on-line service, you should immediately contact your local or state law enforcement agency, the FBI, and the National Center for Missing and Exploited Children:
Your child or anyone in the household has received child pornography;
Your child has been sexually solicited by someone who knows that your child is under 18 years of age;
Your child has received sexually explicit images from someone that knows your child is under the age of 18.
If one of these scenarios occurs, keep the computer turned off in order to preserve any evidence for future law enforcement use. Unless directed to do so by the law enforcement agency, you should not attempt to copy any of the images and/or text found on the computer.
So, do you think that sounds illegal? I think that sounds illegal."
And if it is not technically illegal, it is still highly dodgy ground and frankly it is morally unbecoming (and societally unacceptable) to exploit such a loophole. The minor in question is not even a "borderline" minor - e.g. nearly eighteen (some American states), nearly sixteen (the United Kingdom).
Yes, your internet "love life" is your own, but it becomes the concern of responsible adults when you behave that way with a minor (frankly I am also astounded at the people who were - and still are, in some cases - commenting saying that it's okay, don't you listen to those big bad 'trolls'!!! - what the actual fuck, you guys? Are you shitting me? Are you endorsing cybersex with minors?).
A thirteen year old is nothing but a child, regardless of what they say or how big they talk and act; and children are supposed to be protected, not exploited. If the child in question was my child I would take legal action and pursue it as far as it could possibly go.

My approach to this is relatively simple. Words are words, and actions are actions.
It is important to protect children from rapists and fools, but it is also important to know the difference between a hanging offense and a bit of stupidity. Also, it is important to know that any crime that lacks a victim cannot be called a crime with any fairness.
In the meantime, will all the creepy older boyfriends/girlfriends PLEASE think before you leap? Or, better yet, wait a while?
wait so what about a 17 going on 18 and 13? or a 18 cybersexing a 13 yr old even if it is in "fantasy role play"?
why can't I make fun of them? it is so hard. its so hard when their supporters are "it's not real, and they love and care for eachother, go away hater!"
Two, trolling people is NOT a good hobby. It is hard, thankless work.
