While I agree that this sucks, freedom of speech does not apply to private entities. Freedom of speech merely means that the government cannot censor you for saying things they do not like, and even then it doesn't give the right to say anything you want, there are exceptions.
Yeah a lot of people don't actually understand the US constitution or how it's amendments actually work. I've seen people try to apply it to non-American websites as well, where freedom of expression is the actual law and that's slightly different to freedom of speech.

Er the Swedish company is ignorant then, cos copyright comes under the Berne convention and Sweden is a signatory to that. Mind you I once had a GB company try "fair use" on me, we have fair dealing which is slightly different to fair use, more to the point I doubt any judge would have sided with them that stealing someone's art and writing a defamatory article about them counts as fair dealing.
That said? Cross border suing is a pain in the ass.
for example, in germany you automatically gain copyrights to the work you created, and can not sell it. you can sell, however, the rights to use the works and make money with it. you'd still have to claim being the one who created it if someone steals it without you having evidence, like the original painting, or a first publishing. artists in germany do confuse the two ways of using (amercian vs. german) quite often, though.
side note: it doesn't mean here we can make money off trademarked characters at our leisure, of course. most companies like anime or games companies ignore it, others don't.
That's not unique to Germany, it applies everywhere that is under the Berne convention apart from the US, it's part of fair dealing law that authors retain the right to have their work attributed to them and only them.

Hell on storm artists, all the time people complain about me for very little reason cos I deleted their precious screenshots/stolen art/rule breaking porn, even mentioning my name and I generally let them, it's their opinion, if they want to show everyone they're a rule breaking nitwit they can.
