DA Art Thief. . . looking for advice on how to handle this

Recently, someone let me know that there's someone on Deviantart posing as me. I will say this right now. . . I do NOT have a Deviantart account. Several years ago I got a virus from their site, and I have never used them since. I closed down my old account, and deleted all of my images.

This is NOT me. Please do not patronize this person, and do NOT donate to them, or commission them. I'm very, very concerned that whomever this is is going to tarnish my name, and they've already very clearly stolen my artwork and intend to use it for profit. I would welcome any help on reporting them and getting them permanently banned from DA. I do not know DA well, I do not have an account with them, and I'm not certain how to handle this.
Any and all help is welcome.

Fortunately, those of us who do can report submissions on behalf of the artist.
But with the number of people here who've reported it, it won't matter that much.
dA is trying to crack down on abusive ads, but they're doing a terrible job.
How would you need a dA account to contact the admins?
Can't they just use email?
Next bet is to contact the person directly and warn them with legal action.
If that fails..
There are some people that run for pay sites in fandom that could offer you a path to approach for legal resolution.

Do you have Red Lantern under some sort of copyright? You could try contacting a lawyer if DA doesn't take care of it...
Legal action is possible, but the problem is that the person is probably not wealthy, so while you can mess them up financially, it will cost the person hiring the lawyer a good amount either way.... crappy situation.

Also if they're trying to make a profit off of it, get a lawyer to send 'em an official "cease and desist order" letter. ...if it is a middle school kid he'll have fun explaining to his parents what he's been plagiarizing. Usually you just have to THREATEN a lawsuit and that stops it good.
As they say, business is a contact sport. It is your privilege to distribute what you own for whatever price you see fit including free. Even if it is free nobody has the right to profit off of it without your consent (and royalties).
Besides, it's just a kid being stupid.
This means that you need to warn of legal action. If you don't set on the record that you disapprove of your intellectual property being stolen, then you have a weaker case when someone takes your IP and actually makes a profit on it. A judge looks at that and says, "Oh, you didn't mind in THIS case, but the second much more money is involved you start minding? This is inconsistent."
It's not a really pleasant system. But then, IP thieves don't tend to be pleasant people as far as I've noticed.

Select one of the fields under Copyright/Ettiquette in the Category drop down.
Write up the report- Link them to the account and tell them it is not you.
deviantART is a HUGE website. I've heard people complain about getting their help tickets resolved promptly. But usually, if it's outright theft, they take care of it right away.
If not, you might have to make an account. You can make one and then close it when the ticket is resolved.
If you absolutely don't want to make an account, you can cross your fingers and hope that with enough people reporting it, the CEA staff will consider a ban. Just note that they resolve things a lot quicker (and with guarantee) if you the artist submits a ticket. =\
I'll submit a ticket for you. Hopefully they will consider my relationship with the community over there and trust my word. I don't know if they will take action without your direct response though.

On the bright side of things, you work is well known enough to get trolls... well maybe that's around the 50% gray side of things. With a dash of dirty puke green for good measure.
Like everyone else suggested, just report them and hopefully their staff will remove the account. T'is about all you can really do, sadly.
A bit from their FAQ on how to report a person for any "issue [you] think is a problem". Getting others to report the thief might help as well, but I don't really know much on this. I barely use DA myself, but I hope they're removed soon
if it's put on the net, it can, and probably will be copied!
The only way to stop pictures, is to watermark them. Yeah I know people hate to do it, but if you don't want someone ripping you off, that's what you have to do.
Text - is almost impossible -. If anyone has any ways of stopping text, I'd like to know.

The individual is always trying to do Points Commissions on DA under the use of your Work, Points Commission is kind of like paying money for a Commission, except people buy points to use towards stuff like Commissions. Which should give the DA Staff reason enough to either Ban or put Suspension or other forms of punishment upon the Theft.
Hopefully something can be done to assure your Work does not get profited off by someone else. I can't say whether or not this is how you're making your living through your artwork. If so, I do hope and pray for the sake of it all, as well as your reputation as an artist, that it doesn't become tarnished by the Theft
When sending them a DMCA takedown notice, they will take down the infringing art, and notify the user of the takedown notice. The user will get a full copy of your takedown notice + your contact details in case they want to combat your takedown notice.
You can also undertake legal action against him for attempt of identity theft and fraud, but I don' t know the law relating to that too well.

And you can take an alternative route and add a trouble ticket through here, DA, and there is an internet copyright agency too. If they are making money off you, the agency is a good way to make sure they wont get much further.

Mind you, it's been a little while since the last incident. So I don't know if they've been bogged down as people have been stating, or what...
But one whinny "omg they stole my art" in a sea of whinny "omg they stole my art" reports, isn't going to get anyone's attention unless a shitload of other people are telling the Admin's the same thing. I've seen people wait MONTHS. Where I only had to wait a week, sometimes less to get the problem taken care of.

Many (at least 1000 for what I can see) people have reported DA about this, I'm sure of it. It's just a matter of time until that guy gets banned.

The account will be banned eventually and the artwork removed, but there's still some sleezeball out there who is attempting to sell your work. I suggest you let everyone know to keep their eyes and ears open and may i suggest looking into legal matters when these cases arrive? You're about to make a pretty penny and you have every right to protect your work.

Yes art theft and identity theft is very wrong. Criminal even because it affects the perhaps of which the thief is stealing.
YES they should be reported and YES they should make some compensation for what they have done to the person they stole from.
But look at some of those post on their pages and such. Be a whore like the other gutter trash? Sell your body, get F**Ked by your dad. What the freak? That's too much Fake and Gay? Why would anyone say such things to anyone else. Not only are you attempting to insult the person, but you are taking people that have to be prostitutes to earn a living and demeaning them. Calling something Gay in a derogatory manner is putting a negative connotation on homosexuality even on the word. Gay originally meant happy, something positive. So why would people use the word to describe something negative?

Yes go stick up for Rukis, that is a good thing. Its showing support for Rukis. But don't be slandering other people while you are doing it. It doesn't matter what the person did. Yes its wrong. But you don't slander them and their family, that makes you in same category as the thief. The thief is slandering Rukis by stealing identity and art. So if you dislike it so much why are you slandering yourself? Not only are you doing similar actions as the thief, but you are giving Rukis a bad name by having followers that would do such things.
Report the person, Show support for Rukis, tell the thief to take the art down and apologize thats all fine and good. BUT DONT slander the person or use derogatory words and phrases to put the person down.
They'll notice us soon enough. Don't worry, I've deal with this countless times.

I think this thief is a foreigner, so legal action woudn't be an option at all. only to have them banned from DA.

Since you don't have an account, you can e-mail them. explain the situation and that this person is impersonating you (that's a criminal offence in many places too!).

Rukis is a Graduate of the Rochester Institute of Technology, with a Bachelors in Conceptual Design for Animation/Film. She is fond of all things natural, and indeed brings a bit too much nature into her house, at times. Apparently they DO allow anyone, also without an account, to create a support ticket on DA, so that would probably the quicker way to report this if something similar would happen again.
