So giving it some more thought a reading over the TOS on FA, and looking a bit more into Copyright law there isn't much we can really do against IMVU since they bought FA, but they still haven't altered the FA TOS as far as I can tell...
FA TOS 4.1 - When you upload content to Fur Affinity via our services, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, transferable right and license to use, host, store, cache, reproduce, publish, display (publicly or otherwise), perform (publicly or otherwise), distribute, transmit, modify, adapt, and create derivative works of, that content. These permissions are purely for the limited purposes of allowing us to provide our services in accordance with their functionality (hosting and display), improve them, and develop new services. These permissions do not transfer the rights of your content or allow us to create any deviations of that content outside the aforementioned purposes.
and from the Submission agreement
Upon submitting to FA you grant the website non-exclusive rights to transmit, resize, store, display, publish or alter any submission media within the boundaries of the site's domains. Submissions may not be uploaded with intent to maliciously target, harass or cause harm to another individual. In addition, submissions uploaded must be of your own creation or must have been created expressly for you (and then, only posted with permission from the original artist(s)). All sources (inspirations, sampling, references, copyright) must be cited, credited and documented within the submission's description. Failure to do so may result in removal of the submission without notice. By finalizing the submission, you agree that any and all information contained within the description of said submission is truthful and accurate.
So at least from what I gathered YES IMVU owns FA now but these are still the old TOS and therefor keeps all material to FA and not for the sale of and marketing on IMVU.
So my action is this... I will keep my FA account, for now at least. All work in my gallery will stay for now until I decide later to keep it or not. I WILL however NOT upload any more work nor anything else to FA and will instead keep my account for the sole purpose to contact my favorite artists and friends that are still here and that may not have a account on other art websites. I will use more of Weasyl and Inkbunny because I heard good things from their users, and any new commission I get will be uploaded to those sites but only a link will be posted to FA to keep any new copyright sharing of any material from me and the artist's to FA/IMVU.
If you think this is a good idea let me know and maybe do the same. If not you should let me know why, I just don't want my content to be involved in anyway with IMVU and be sold or marketed for only their gain and not the original creator's.

2.) DMCA notifications do not require works to be registered.
I don't like the sale, I hate IMVU, but the DMCA has saved me a whole hell of a lot of time and money and doesn't deserve to be dragged into this mess. It works, and people are hurting the community by saying it doesn't because they discourage artists from even bothering.
Bottom line is I don't like IMVU either, It looks more like to me some cheap copy of second life where the chat rooms are literally in a small room, and everyone looks like they're a teenage supermodel which creeps me out a bit.
And yeah, having backup sites is always a good idea anyway. I've got accounts on Weasyl, Inkbunny, and SoFurry, though they're all really neglected. I still favor SoFurry over the others though myself. Do be sure to throw your Weasly link up somewhere so we can all follow ya.
