Good and bad news

First off, hey everyone! Long time no talk! What'a up, how're you?
Now onto business.
Starting with the good news, it's my mother's birthday and I got her a St Francis of Assisi stature that she absolutely adores as a gift. I think she was even crying a bit....
Bad news: McDonald's ice cream maker was down so I can't get a cheap ice cream and I'm melting out in this heat ;-;
Worse news! I'm not including names and want serious opinions here. See I commissioned a piece about a month ago. Thing is I haven't heard much of anything at all from the guy since. He gave me about one update... and hasn't responded to the half dozen I've left since. Now the update, small as it is, definitely doesn't justify the price I paid. If I leave a note asking for a refund and don't get a reply in about a week, am I justified in forcing a payback through PayPal? It's not for my lack of trying, I genuinely don't wanna do this but I'm not getting hung out to dry while they made what they did and never responded again. I mean I don't mind paying ahead but I never usually have this issue.
