:::Terms of Service:::
This Terms of Service (the "Terms") apply to the customer ("You") in conjunction
with the contract for buying products by the artist ("I", "me", "my"). Any work is
subject to these Terms. These Terms do not alter, in any way, any other written
agreements you may have with me except for point 3 (Disclaimer of Warranties
and Limitation of Liability) of these Terms which can not be altered outside of
these Terms.
PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY CONTRACTING ME YOU AGREE TO BE
BOUND BY THE TERMS AND CONDITIONS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY
REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT COMMISSION ME.
1. Eligibility
You must have legal capacity to be able to place an order for my work.
2. Privacy
The information I collect from you during our cooperation will only be stored
if necessary and only for the time of the cooperation. These information will
not be shared with any third party persons.
3. Disclaimer of Warranties and Limitation of Liability
ALL PRODUCTS COME WITHOUT WARRANTY OF ANY KIND AND ARE PROVIDED "AS-IS". TO THE
MAXIMUM EXTENT PERMITTED BY LAW, I WILL NOT BE LIABLE TO YOU FOR ANY SPECIAL OR
CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF OR RELATING TO YOUR OWNERSHIP,
USE, MISUSE OR INABILITY TO USE THE PRODUCTS, EVEN IF I HAVE BEEN ADVISED OF
THE POSSIBILITY OF SUCH DAMAGES. IF A LAW RESTRICTS MY ABILITY TO LIMIT
LIABILITY OR DISCLAIM WARRANTIES, THE LIMITATIONS LISTED ABOVE MAY NOT APPLY TO
YOU. IN THAT CASE, I LIMIT MY LIABILITY AND DISCLAIM WARRANTIES TO THE
GREATEST EXTENT PERMITTED BY LAW.
4. Work Previews
Some work in progress previews will be shown during the various stages of
the project. Additional previews may be requested at any time in any work stage
but I reserve the right to reject those requests.
5. Project changes during work
In the progress of creating a painting/drawing you may request changes to main
and background details at the sketch state. Changes to color are possible until
the end of the coloring state. I reserve the right to reject change requests.
6. Payment
The payment methods that will be accepted are (a) Paypal and (b) Cash. Other
methods may be accepted after prior discussion.
7. Refund
Payments can only be refunded for work that hasn't reached completion due to the
artists fault.
8. Shipping
Physical goods will be available for international shipping at the then current
rates. Shipping from Germany.
Digital goods will be send to you via email or any other prior discussed way.
9. Usage of the Artwork
Commercial usage needs prior written permission by me. Noncommercial and
private use is granted to it's fullest extent.
10. Copyright
The copyright of the work will be held by me.
If you want to have other characters than your own in the commission, you need to
have the respective rights and permissions.
11. Miscellaneous
If any part of these Terms is determined to be unlawful, void or for any reason
unenforceable, then that part will be severed from these Terms, and the rest of
the Terms will remain intact. If I do not enforce any provision of these
Terms, that will not be considered a waiver of my rights. Any waiver of these
Terms must be obtained in a written document signed by me.
12. Changes to these Terms
This terms of service may change at any time. If they are changed after
accepting the contract, we will try our best to let you know of the changes.
