It is really fucking starting to piss me off that people keep misusing and abusing the constitution and amendments; twisting and distorting their basic knowledge on them to fit their own ideals as if they know something about the constitution at all, or acting blissfully ignorant as to what the constitution means to push a public agenda over what is just and right.
Yes, i am talking about the first amendment primarily, and the freedom of religion part in particular. Now, let me explain why the people of the internet and the masses are fucking retarded.
First off, the entire point behind the bill of rights, the first 10 amendments, is to restrict and limit the governments power. This does not give the government the added power to act, it states in plain text situations where the government cannot legally act. The US has never been a democracy, and does not believe in majority rule. Majority rule is bad, as a majority can be wrong and can commit grave injustice on a mass scale because they are, by definition, a majority. The point behind the bill of rights is to ensure that all people are granted inalienable rights to ensure that the minority or powerless are protected against the majority or powerful, at least on the government level.
Second, Freedom of religion states that the government cannot enforce the teachings or rules of any one religion over another, nor can it make a law nor act on the beliefs of a religion. In other words, saying "Because god" or "The bible says" is not a valid reason, ever, when it comes to the justice system in terms of making or following a law. This stretches to all forms of the government, including public workers, such as teachers, as they do represent the government as well. This is why public schools cannot endorse a religion.
What both of these mean, for anyone who does not follow, is that this whole fucking Kim Davis bullshit is fucking stupid. Let me make this clear; SHE REPRESENTS THE GOVERNMENT. This means she cannot use religion as an excuse to not do her job. She has no rights to claim religious freedom and use religious beliefs as a defense to not do her job because the first amendment exists to PROTECT PEOPLE FROM HER. If you want to argue the first amendment, get it fucking right.
Now then, why was she jailed? No, she was not jailed because her beliefs. She was sued for not issuing marriage licenses when there was no legal reason to deny them. She was ordered by court to issue the licenses, as they had a legal right to do so. She refused to issue them, so she was held in contempt of court by refusing to obey the court order.
Why not fire her? She is an elected official, she cannot be fired. She can either be impeached, or resign of her own free will. And no, she cannot go on strike or refuse to do her job for any reason, because government officials and public employees do not have the right to strike.
So, after stating all this, CAN ALL THE FUCKING RETARDS OF THE WORLD STOP BEING RETARDED? IM TIRED OF YOUR SHIT.
