I will no longer take or do 'surprise' auction gifts or commissions under any circumstance even "I'm their friend on FA". Why? Because I'm done with feeling uncomfortable. Those who have commissions going on right now will get a note saying I need the other participates TOS agreement.
Now when you want to use someone else character, they must agree to the TOS and give a note or email stating specifically that the commission can use their character. This is because I reserve copyrights on the artwork and I can't do anything with artwork without those agreements, because I refuse to deal with people coming and going "this was a gift to me, I didn't agree with your TOS"
EDIT: You don't need to expressly tell the person exactly what the picture is, but if you're getting a fetish piece, let them know you are. My TOS doesn't have "commission sensitive" information, so they just fill it out. Yeah they know art is coming for them, they by who, but they don't know what ;)

Can't people understand that other fact that once a person pays, they are agreeing to the terms of your services? And if they didn't read, its their fault in my honest opinion.
So no, I haven't had a huge problem but this is to prevent those problems arising
I mean in my case for an example, I recently got my first ever gift art from someone I've watched a couple of weeks ago. And I was ecstatic and overjoyed! And I thanked them and properly credited them for their work and even left a short message on what's so good about them. And i might draw or commission something in return and show them in private first.
I mean there's nothing wrong with that, right?
Also this does protect people from their characters being used inappropriately(as I mentioned below). If you hate BDSM, would you be okay with a friend commissioning your character bound and gagged? I would hate it if someone used my characters without my permission.
Will this happen with every commission? No. But it's better to treat every commissioner and character equally then pick and choose who I get signatures from. So I'm just stating it here- if you want your character drawn by me, no matter who pays for it, you as the character owner need to agree to the TOS. This protects the owner, me and the commissioner. Because I'll blacklist someone who's using other people's characters and I didn't know and get told later. People will be upset because surprise art is awesome, and I get that but I'm running my commissions as a business and need to protect myself in that standpoint.
