The cruel irony is that I support the courts position...not because its ethical or morally right, but because Cali state law clearly makes propositions such as Prop 8 legal...what I resent is that a small fortune in religious backed scare ads makes borderline retarded people shit their pants with fear and rush to 'defend marraige'. Defend it against what? Happening? Having relevance? Meaning something? Bullshit. Divorce skyrocketed before gay rights even existed, so clearly the sanctity of marraige means jack+shit. Its just damned ironic that the institution even needs defending aginst people who actually still value it and want to participate in it.
If you want to debate the merits or minuses of gay marraige, military service, civil rights, etc...cool...good on ya, but you blew any chance of making a decent point with your opening line. If Id seen a message in the box that read "Dude...WTF? That's harsh." My answer would have been..."Yeah...that was just me being a sarcastic smartass. I dont actually wish death on anyone...deep emotional pain maybe...but not death."
My problem with overturning Prop. 8 is not because I have a problem with gay marriage, it's because I have a problem with the government and the judicial system oveturning propositions and laws. Think about it, if Prop. 8 gets overturned, what's stopping the government from overturning other propositions and laws? Then democracy is pretty much done, dead, and over with if isn't already! We the people would no longer have a voice in how our country is run!
You're dead right, its a good point, and it's exactly why the court ruled the way it did. It was clear they didn't like it (shit...neither did I), but the case was flawed from the start, so what else could they do. California allows laws to be passed by ballot initiative, and the way they do it is unique...and clearly flawed, but that's how the law stands, and it isnt the court's right to take it away.
I would suggest that they look into the example of the dissenting judge, who was Latino, and consider that he might have dissented because theres a difference between the rule of law and mob rule. The way it stands now, a ballot initiative that people like at the moment could easily be used to ream out any minority in the state...and the great lesson is 'where the rights of some are in question, the rights of ALL are in question'.
Democracy is great, but without a few basic safeguards it never lasts, and some of the worst tyranny in history had overwhelming popular support. I'll say this: I may be watching out for my own ass (for obvious reasons), but I also keep an eye peeled to look out for everyone else's. Prop8 was just a painful reminder that, even if you champion the rights of all people, sometimes they don't champion yours.
