Gallery Update; 150 entries CENSORED by Admin

The following is a message I sent to FA Admin Pinkuh, concerning the the uploads she removed from my gallery;
This was her reply;
So much for "Help & Support".
But it makes perfect sense;
http://www.furaffinity.net/view/2004694/
But even THAT wasn't nearly as interesting as her "reply" to my previous journal;
Funny, I could have SWORN the TOS stated; "A user may not intentionally harass, slander or disrupt another User of the site, or, through inaction, intentionally allow another User to come to be harassed."
Hypocrisy, much?
Not to worry though --- there IS a way for you to view and comment on ANY work through FA that I upload, which even the "rules" do not prohibit.
You'll see soon...
I concede that several items which you have recently removed from my gallery were indeed in conflict with the AUP, (photos of a bucket, refrigerator, anvil, dirigible hangar, etc.), and should not have been in my gallery. I will not attempt to re-load these items.
However, the same cannot be said of the overwhelming majority of what you removed.
First and foremost are all of the Animated GIF slide-shows, every one of which is designed to educate the public on important military issues that are little-known to civilians. These represented considerable effort on my part, taking anywhere from hours to WEEKS to assemble, and thus are very much "made by me" --- that doesn't even include the amount of physical and mental effort and time invested in the gathering and presentation of the information in these slide-shows, which when included represents multiple man-YEARS of "made by me".
The imagery used as the backdrop is required, because the images represent indisputable proof of what the text claims, and it is completely legal to do so under the "Fair Use" Doctrine of the US Copyright Code (Section 107; "...for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright.").
Within the boundaries of Fair Use, which these presentations unquestionably are, copyrights are legally irrelevant, and thus non-existent --- you cannot claim that these images, under "Fair Use", are not my own work, because under "Fair Use" they cannot legally be claimed anyone.
Second, the news articles I uploaded fall within the same category of "Fair Use", because the critical commentary I inserted into them makes these a rebuttal to the original article, and thus "Fair Use" (Again, Section 107; "...for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright.").
Thus, in the context of "Fair Use", these articles can neither legally nor logically be considered another person's work.
Likewise, because the articles themselves plainly cite the original title, author, date, and publication of the original text, these are not plagiarism.
Third, at least two of the items removed from my gallery were technical data of real vehicles that was compiled by me --- this is scientific data, and thus in no way is not "made by me", and in fact one of the items in question was my OWN interpretation of a hypothetical aircraft's performance specs (a production F-23 Black Widow II).
Said items in question were TOTALLY "made by me", and you wrongfully removed them.
Fourth, six of the items you removed (Titled "Gryker 1~3" and "Stryvin 1~3") were photomorphed images that combined the distinctive features of two different vehicles, set against a wide variety of backgrounds.
Fifth, the text article titled "The Trucktard Index, Version 1.0" is ENTIRELY my own creation --- I fail to see where this is prohibited in the AUP policy.
Please replace all indicated items, and associated favorites and comments as soon as possible.
Thank you for your time.This was her reply;
I don't really care what they "Fall under"
They are not allowed on this site.
And if you re-upload anything that I took down you will have action taken against your account.
It is against this sites RULES.
Pinkuh
[FA admin] So much for "Help & Support".
But it makes perfect sense;
http://www.furaffinity.net/view/2004694/
But even THAT wasn't nearly as interesting as her "reply" to my previous journal;
I removed 150 violations from his gallery
150 of them
That is an insane amount of stuff. I looked at every single one to make sure they were violations. Every last one.
Everything that I removed was against our sites TOS/AUP.
Everything that I removed Contained content that was not By him, nor was it for him. This ranged from stuff gotten straight of the net, all the way to what looked like bad scans of an army survival guide.
I don't remove stuff to be a bitch. But if you are going to use this website and not look at the rules, or pay attention to them, or bawwwwwww that I am somehow going out of line, you won't get any pity.Funny, I could have SWORN the TOS stated; "A user may not intentionally harass, slander or disrupt another User of the site, or, through inaction, intentionally allow another User to come to be harassed."
Hypocrisy, much?

Pinkuh's reply stinks of "They're not allowed because I said so, Naw Naw!"
Geez, what a retard. I actually thought FA admins/moderators were pretty relaxed and cool until this.
Their above and beyond any rules us mortals have of course ;)
Not that it isn't easily predictable, when you understand the pattern;

Aw, did I bruise your poor little ego when I exposed ineptitude?
After showing a good majority of the admins and us talking about it for like a half hour, Dragoneer was the one that caught that the bulk majority of his submissions didn't contain enough original content. I went through and looked at all of his submissions, and I had to crawl through them becuase I REALLY didn't want to delete anything of his that was original.
He is more then welcome to upload anything he creates that isn't within our rules to photobucket or some other random image site and link to them in his journal.
That being said, What I removed was against the rules. So as upset as your friend is right now he was in the wrong. But it really wasn't an extreme enough wrong to say anything other then "Hey we removed them". We didn't ban him from the site, the only thing that we did do was remove the content that wasn't allowed.
People tend to make mountains out of molehills.
She has done this before though and theres nothing you can do really unless the owner Dragoneer involves himself (which is likely not) since he is the next step
Your best bet is to just leave this be and probably disappear from fa as its fast becoming a visual arts only site and nothing but.
...but I do have a few ideas on how to work within the rules, and still use FA for most of my work...
Otherwise okay whatever you need to do just be careful not to anger said admin into thinking your circumventing the rules or something.
I won't be insulting Pinkuh's pornography and/or self-congratulation with anything as detestable as journalism!
This is how this whole situation really went down.
I handle the trouble tickets, someone reported that Blacktail here was posting works that were against the AUP. I took a look and wasn't sure on the matter, so I posted it to some of the various other admins, including Dragoneer and we debated about it. (As is what happens to all work that comes into serious question) Dragoneer was the one to make the final decision about axing. With the amount of original content that was littered throughout the violations we had to be careful. To make sure we didn't remove any content that was original I had to go through over 200 submissions, view each one of them. I did my best to make sure everything I removed was a violation.
Everything I did was well within what I was supposed to be doing. There is no corruption on my part I was just doing my job.
You might want to drop this issue and run away as if you lit the fuse on a cheap Chinese firecracker the size of a doghouse. I think you're feeding the thing whose name starts with a "t" and hangs around under bridges if you stick around.
I'm slowly getting sick of Furries attitude towards anything which isn't badly-drawn horsecock. It seems if anything even slightly educational appears, furries are like "GAH! GET IT AWAY! I WAS FAPPING! WAAAAAAAH!" and when they then lose their argument, then run off and cry to moderators.
Yup. Given that some of them are "Running the Asylum," there's not much even good administrators (if they still exist here) can do. Ugh. I think I'm going to go to bed and think about what I have to deal with next in my commission stack.
I wonder if they ratted on me to conceal my responses to their whining? It would make sense that they're covering their tracks --- I called them on their "logic".
Now that I think about it, I find it hilarious that they would complain to ME that "FA is for porn", given the quantity of Mature and Adult artwork in my gallery!
That being said I didn't abuse my power. I did my job.
to reiterate the situation from a post above:
I handle the trouble tickets, someone reported that Blacktail here was posting works that were against the AUP. I took a look and wasn't sure on the matter, so I posted it to some of the various other admins, including Dragoneer and we debated about it. The arguement isnt weither or not its furry or non furry (people post things unrelated to furry all the time here and don't have their gallery wiped)
its the fact the issue is that one of the admins has gone out of their way to essentially expect every single word text and brush or pencil stroke to be 100 percent original to the point only visual art is acceptable (since everything else has a source from something including writing photography and some crafts)
Our AUP is simple. If you didn't create it in full don't post it.
He broke the rules, I removed everything in his account that broke them, notice what remains? It's all his original stuff.
While some of the works depicted are not 100% original, they all exhibit unique content, and where this occurs, proper credit and no claim of ownerships have been made. Also many others are complete unique content.
As such you may want to reconsider your choice to remove these works.
None of Blacktails works have broken the Terms of Service agreement, nor any other legally binding agreement held by Ferrox Art LLC.
You however, may be committing what ammoutns to harrasment and abuse of power.
The former is a violation worthy of a ban, the latter I am not so sure and I am certain it would fall to Dragoneer.
Simply put, your priorities are misplaced, and you should probably re-evaluate your intentions.
Congratulations on being the new Dave Hyena.
-Ethan Black.
So you still have it on dA? What is your account name there?
Pinkuh can't vandalize my galley there. Of course, that doesn't guarantee she won't put in a bad word about me...
I can't re-load ANY of the stuff deleted, lest I get spaz-banned from FA, but there are workarounds...
Be careful, man. Check Six, I don't wanna see you get golden BB'd in a flamewar.
I loved the slideshows. *bookmarking your dA account*
I'll still be uploading artwork to FA, only I won't be able to upload the same kind of stuff I used to --- I have to be a good little Quisling now.
Completely original!
