New Comission rules

Some folks can't see two icons and blunt text saying "HD FILES AND ALTS AT PATREON"
So here is some new rules if you going to get a comissioned picture because i'm fucking tired dancing around it:
1. I reserve FULL RIGHTS TO THE PICTURE AND ALL OF ITS VERSIONS FROM NOW ON.*(details below)*
2. You are allowed to post publicly ONLY SFW VERSION PICTURE.*(details below)*
3. I am alowed to draw and post "cum" version of the picture at my Patreon page.*(details below)*
4. The curent Price list post ONLY provide brief and NOT strict examples of how much you idea will cost. "Details" part of post is not viable no more.
5. You are getting ~1500px picture.
What does it mean:
1. "Full rights" means: i reserve right to takedown commisioned picture if i find it necessary. (Never happened)
2. "Any version of the picture" means i'm gonna post it to my Patreon page and i woun't be using you character in whatever scene i, or someone else wants without your permission. I still respect you and don't want to disregard the privacy of your character and it being legally owned untouchable masterpiece, so 90% of the time "alt versions" means: cum, naked, clothed, different expression, different breast size, different body fittnes (Abs) version. I will inform you what versions there are gonna be. You don't pay for alternative versions if they are completely done by me without guiding (Minor fixes doesn't count)
3. "Posting publicly ONLY SFW VERSION PICTURE." means: upon recieving all versions of picture, you only get to post clothed version named "SFW" to any media you want with proper credits, you can post naked version of the picture (Not cum, different expression, different breast size, different body fittnes (Abs)) after two weeks since you got your comish pictures.
4. Price can differ depending of complexity of the picture.
By sending me payment you confirm you are avare of these rules and did carefully read them AND resolved all of the issues BEFORE PAYING.

I'm just assuming people would prefer get free alternative versions of their comish rather than rising comissions prices.
I certanly would love to get some free alts of my character.

I'm trying to sit on two chairs doing comissions for regular FA community and running patreon.
So if you do not want to cooperate, i have no choice but to decline your comission.
And respectfully, Usually you commission an artist for what you want as they are providing you a service. Commissioned works technically don't belong to the artist legally once payment has been made regardless of the artists terms of service, they belong to the holder of that intellectual property who paid the artist. I.E. a customer could force you to take down a commissioned work if is of their intellectual property copyrighted or trademarked.
Don't take it the wrong way, I love your art and it's your choice and I respect that.

I'm using your idea because you want me to! And you paying me so i would accept it.
The end product is picture that actually can be copyrighted and owned explicitly by me due to me being the creator.
If you own the character and have a reasonable cause to request taking down - i will.. by switching colors and minor details and technically its not you character anymore.
There are so many backdors people can use to just get away with shit.
My point is, if you are really concerned about your character being drawn with or without pants... don't ask for comission.
Sorry to butt in here with a late comment, but no. This is completely wrong, and because it is potentially harmful to be spreading this information incorrectly I feel inclined to correct you.
Copyright law both in the US and in the EU dictates that by default the full rights to any original content belongs to it's creator, in this case the artist. If the commissioner wants to have the full rights to the artwork they need to buy these rights from the artist and the artist needs to sign them over with a written agreement. Then and ONLY then does the artwork actually belong to the commissioner.
This is what Work For Hire and similar contracts exist for - they ensure that any artwork an artist creates belongs to the company or individual that commissions the artist. Without that kind of written agreement, the artist owns everything they make (provided of course that their own content isn't plagiarized). Unless you have a character that is trademarked, an artist drawing your character from scratch and in their own style falls into the category of derivative work. You have absolutely no right to it.

Not at all - a payment is not a signature. By accepting a payment I am not surrendering any of my rights as a creator, there is no such thing as an "implied" Work for Hire. That is simply not how transferal of rights works and this would not be defendable in court - only a written agreement can do that. I work as a game artist and Work For Hire contracts are commonplace in the industry, exactly because companies need to protect their IPs when working with freelance artists. If they didn't, they would have no official claim to the art created for them in this fashion. Also, because transferring rights is a disadvantage to the artist (not being able to re-sell and especially publish my work is directly damaging to my business) such an agreement generally includes an additional fee to compensate, which commissions hardly ever do.
You are correct that copyright law extends to the character design as well, provided the original design is sufficiently developed. Whether or not this applies to most furry characters is debatable, and this is also where derivative work comes into play. As the sole creator of a new, unique piece of art, my default rights to this work are equally protected by copyright law as the character is (again, provided the character isn't trademarked).
Of course, as an artist working in the furry fandom, I understand the emotional and personal nature of characters and will respect my clients' wishes regarding re-selling. But publishing? If you want the right to keep me from posting my work in my gallery, I will make up a contract for us both to sign and charge at least double.
I'm more referring to the explicit language set out by services such as PayPal which explicitly have a paying party declare that they are paying for goods or services rendered. It's a more legally grey area than one might think. I was more leaning on what I first tipped on, that the commissioner if scorned could (and rightfully) seek something such as a DMCA in such an event. Or, a commissioner could terminate services tendered in the event such a service fails to meet upon what was initially agreed.
Seems a bit aggressive.
Still sounds like the alt versions are permanently locked behind your patreon.
Basically patreon is paying for your alts.
To those that think having to wait a mere two weeks to show off is awkward, remember that those alts could instead be drawn-for-patreon only content you'd have to wait possibly months to see if you're not a supporter. Past that, the overall price of the piece of the artwork is subsidized by having this patreon access and alterations rather than being charged the full hourly rate of these skills.
If anyone complains too much, can I please have their spot on your waitlist?~

If we have asked for any alts, do we pay an addition fee for them?
Also, For any alts we wanted, are we not allow to post them at all?

Not sure if I will get any myself, but it would be good to know before hand :)
Every instance should be wieved individually.
For example: you want alt version of a character with simple swimsuit and extra accesories like beach ball or sunglases etc, those are pretty easy to render so i wount charge much.
But if your alt includes badass futuristic rifles and heavy armors along with more wapons and explosions and stuff, this will take quite some time to render so the price on this version is gonna be considerably higher.
Its really hard to cover it in a text form for every instance.

Also why ask me how they would know what they were paying for if its written up there? that's why i was confused in my last reply.
I don't like anti-consumer Patreons that provide scalped versions of pre-existing content, I fear this falls in that grey area.
