Terms of Service

This document describes the terms for my consent for the use of the furry character "Xeris Moon and Xeri Moon" for content creators and commissioners.
By depicting Xeris/Xeri or any character with a ref in my gallery in any medium, or otherwise attempting to use him or his likeness, you agree to the following terms:
(1) They are not a public characters, for RP or otherwise, and shall not be depicted without my permission. The characters are entirely owned by me, and all rights to the character and their likeness are entirely held by me.
Note: Permission to draw my characters is of course granted to the artist if I (
NeoXeris ) am the commissioner to have them drawn.
(2) No media of Xeris/Xeri shall be posted without the creator's explicit approval. This includes general releases of "Works in Progress".
Before any media depicting Xeris/Xeri (or his likeness) is posted, it must be approved by me .
(3) I retain the right to post any media anywhere (with credit given to the artist, of course) that depicts Xeris or Xeri. I can post without permission of the artist and at my sole discretion (unless special agreement of exceptions is reached prior). Artwork posted before this Journal's release date does not apply to this, as artists had no chance to agree nor disagree. I will not commission artwork from Artists who demand to retain sole legal ownership, and all content therein, for themselves, as this jeopardizes any future claims I might have to the artwork in question, should future conflict surface.
Commission Policies(Artists please read)
(4) I retain the right to refuse paying until I have seen, and subsequently accepted, any Work-in-Progress sketch(es) associated with the commission in question. If this conflicts with the artist's own policies, I will not commission them.
If you also have done the WIP to what I have requested you will be paid half and the other half after the final is finished. If some things need to be changed by me upon request I will pay extra but only if we mutually agree upon them.
(5) I have the right to order the removal of any media depicting Xeris or Xeri likeness and for any reason, at any time.
(6) Under no circumstances do I tolerate partially complete artwork, whether it is labeled as completed by the artist, or not. I retain the right to demand a refund if I feel the artwork in question is not completed to satisfaction.
(7) I refuse to pay any and all seller's fees that Paypal may require in order to complete the transaction; it is simply not my responsibility.
(8) Unprofessional, rude, obnoxious, self-entitled, arrogant, or directly immature behavior at any point during the commissioning process will result in an immediate forced refund through Paypals policies, as well as an irrevocable block.
(9) Failure to uphold your end of the deal, be it accidental or intentional, will result in a refund.
These rules are to minimize the number of incorrect or inaccurate depictions of Xeris and Xeri, and to maintain an overall high standard of quality and accuracy for the Xeris and Xeri characters and their respective canon. If these rules are not acceptable to you, you do not have permission to depict Xeris or Xeri, in any artwork, on any website/forum/misc. media, what so ever. In the event that a content creator changes his or her mind on these terms after a commission has begun, I expect the payment to be returned in full, and the work-in-progress will be destroyed. This means the WiP sketches, and all other misc. gathered info, on any digital device which has these images/information stored, be deleted, permanently(no recoloring or depicting the Prince Vaxis character as another character is permitted, ever).
Thanks ya slutty kitten for allowing me to copy this. I give all creative and legal rights to Vaxi for making his TOS.
