Recently, adult Pokémon artist
insomniacovrlrd got hit by a DMCA strike on Patreon, by Nintendo of America. He had been doing this adult Pokémon fanfic series called Haven, and it's especially disheartening for him to have to cancel that series altogether in its current form, by removing all Pokémon- and other Nintendo-related works in his Patreon page, to keep his Patreon page in a good standing. It seems that you'll always be in danger of this happening, when much of your art output had been Nintendo's properties such as Pokémon, especially when you're making money out of them via Patreon donations. It's very possible that this is happening because not only because Nintendo were displeased with how their properties got transformed into Rule 34 fantasies -- that's pretty much inevitable, anyway, and most companies turn a blind eye over that -- but it's also possible that it's because Nintendo had just released a game that also happen to be called Haven, for the Nintendo Switch.
After consulting with a couple of friends of mine, just to stay safe, I've decided to also remove all Pokémon-related art from my own Patreon page: https://www.patreon.com/marwangreencritter From this point onwards, I will not be posting any more Pokémon-related art there, as well as all other Nintendo-owned properties. I'd rather be safe than sorry. Such issues like that is one of the reasons why I don't do Rule 34 art of copyrighted properties, because I don't want to get myself into legal trouble because a big gaming company like Nintendo didn't like how we've been using their characters as part of our Rule 34 fantasies.

Right. =/ Worse is just how deliberately ambiguous companies can be, regarding the use of their copyrighted properties for anything, including situations these characters were never made for in the first place such as Rule 34, which allows these companies to sue anyone for just about any reason whatsoever. Nintendo are quite overprotective when it comes to their IPs, including shutting down ROM sites, shutting down passionate fanmade projects like Pokémon Uranium, and just a few months ago, the whole Slippi debacle which led to the #FreeMelee movement. (The latter being a massive deal due to the current pandemic situation we're in.) It's almost as if Nintendo are actively preventing us from showing our love and support for them and their properties, kinda like biting back at the hand that feeds. It's no wonder more and more creators these days turned to making their own original IPs as a replacement to Nintendo-owned ones, in order to avoid such issues.

It really does feel amazingly counter-productive, the people they're slapping are some of their biggest fans... Enough that they care to do serious art and production with the characters. Just so amazingly backwards, you'd *think* you would want to encourage fans like that as much as you could, they're your most dedicated and enthusiastic folks...

And yet SMG4 somehow gets away with having 4 million subs, and sponsorships in which he uses Mario to endorse games competing against Nintendo, and somehow has not been touched. It is absolutely perplexing.

Probably cuz he's made enough money that he could afford to go to court if they challenged him, so they only tackle small projects they know will back down immediately. After hearing about Nintendo's use of private investigators to harass modders, they seem like a bunch of cowards to me. Stuff like this is why I stopped supporting them years ago, and only draw anything Nintendo-related if it's someone's sona.
