Commission Prices and Terms of Service!

Kayvo Clockwork Terms of Service and Prices 3/8/2021

These terms of service are subject to change any time without notice.
You must read this terms of service in it’s entirety before commissioning me. You agree to these terms of service by sending payment.
“you, your, yours” refers to the commissioner.
Payment and Refunds:
A) All payments must be paid via PayPal invoice. I will send an invoice within 24 hours of your agreement to commission me. Payment must be made in full (or first payment must be made, see Payment and Refunds, point C) within 48 hours of me sending the invoice. If payment is not made within 48 hours, I will assume you have forfeited your commission spot, and you will have to contact me and start over.
B) Payment must be sent upfront and in full if no payment plan is used.
C) If the total cost of the order exceeds $100 USD, you may pay in installments via a payment plan. The number of payments and when the additional payments are expected to be paid will be discussed on a case by case basis.
D) All Prices are in USD
E) If I cancel the commission for any reason at any stage of the commission process prior to its completion, there will be a full refund paid within 24 hours of the commission’s cancelation. If you cancel the commission for any reason, there may be a partial refund based on the amount of work I have done on the order at my discretion.
F) You must be 18 or older to commission me.
G) If the work is canceled either by myself or by you, I reserve the right to re-use what I have completed for a different project. I will change the character so all I'm reusing is the art, not your personal character.
General:
A) I will not necessarily work on commissions in a set order.
B) I reserve the right to post any work in progress, finished art, and details about the commission of any sort online, and I reserve the right to share any work in progress, finished art, and details about the commission of any sort with other people. You may request that I keep the commission private (private defined as: withholding identifying information about the commissioner or the subjects of the commission) for the duration of the commission process, however you must tell me before you send payment for the commission. If you would not like me to post the art online after the commission is complete or share it with anyone after the commission is complete, you may request I do so for an additional 15% fee. This must be discussed prior to the initial payment for the commission.
C) I will NOT post any work in progress or finished art online nor will I share any work in progress or finished art with anyone that discloses your identity in any way (i.e. A work in progress photo draw over) without explicit written permission from you.
D) I will provide both a high resolution png and a high-resolution jpeg of the final work. The Files are for personal use only. You may crop the art, so long as my name is accessible somewhere on the post.
E) You may NOT claim the art as your own, you may NOT trace the art, you may NOT make YCHs or adoptable from the art.
F) I will NOT work with text descriptions of characters, OTHER THAN for reference sheet commissions. Some sort of clear reference must be provided for the character in all other commissions. Reference sheets are preferred, but I will work with other of the character as well.
G) By commissioning me for any content you acknowledge that you are of legal age to view such material and you release me, Kayvo Clockwork, from any liability.
H) Once the commission is complete and sent to you, I no longer have any liability for the commission.
I) I will not work with any set deadline.
J) You may NOT post or share any work in progress I send you during the commission process. You may only post and share the final work.
K) There will be licensing fee(s) if my work is to be used for profit; amount will be discussed on a case by case basis.
Content of Commissions:
A) I reserve the right to refuse any commission for any reason. I have no obligation to disclose my reasoning.
B) Types of material I will not draw include but are not necessarily limited to the following: Vore, gore, hyper, rape, characters under the age of 18 in adult situations, taurs, diapers and associated elements, etc. I will not draw anything hateful or overly political at my discretion. If you have a question about an idea for a commission and you aren’t sure if I would be willing to draw it, feel free to ask first!
C) If you ask for art in an NSFW context involving another character, I will check to make sure they have you listed on their page or you have previously gotten art with them, otherwise I will contact them for consent to draw their character in an NSFW context.
D) You may request any commission to be artistic liberty
E) If no description or reference for the details of the commission are provided for the commission, the commission will default to artistic liberty.
F) I will send work in progress screenshots as I go. At what stage of the commission I choose to send work in progress is at my discretion.
G) I will make two large scale changes to the commission for no extra charge prior to beginning the color. Once the final stage before color is approved, I will no longer make changes to the structure. If more than 2 large scale changes are requested, there will be additional cost at my discretion. Character design commissions and commissions where consistent back and forth communication are exempt at my discression.
H) All listed prices are base prices and may be subject to increase or decrease at my discretion depending on the complexity or simplicity of the commission or character present in any YCH I open.
I) I will NOT draw copyrighted characters.
J) Communication during the commission process may take place on any social media or messaging platform that you wish, so long as it is a platform on which I am already present, with the only acceptations being platforms requiring the sharing of a phone number.
