Commissions OPEN (Medical Debt Sucks!)

So back in mid-October I broke my ankle...
At the same time our car broke down 6 different times, literally wiping our savings and stressing us out
I was just informed by one of the locations that I have 6 months to pay off my medical debt (Total is over $800) or it goes to collections which I HATE dealing with collections, they are so scammy and a literal horror to deal with
I also have $285 left over from the ER bill
And possibly around $400-$500 due from the location I am getting treatment from for my foot and physical therapy that is currently ongoing
I have about 1-2 months until I can walk on my foot without added support, I am in a brace and have been for about 2 weeks, fresh out of the boot! But I digress
The only way I have money come in is my art

Impersonations on the rise??? PLEASE READ

I am not sure what is going on but I've seen 3-5 users in the last WEEK have to warn their users that someone is impersonating them to scam them out of their money. Sadly a few users have fallen for this
So I want to get that out of the way
I will ONLY contact you as "Fulgarite"
Yes I have an account called "Fulgs-comics" but ALL notes are disabled on there, I take notes ONLY through FULGARITE
Now my name is easy to impersonate cuz its literally a rock, switch out the A for a U and you have the same name technically. But I dont go by FulgUrite, so please be aware of that.
I will NEVER solicit anyone for money. I think its tacky and disgusting to go begging people to commission me in notes and shouts. So I will never do that. It just rubs me the wrong way.
I will always comment on your response on my submissions first to verify things and ask YOU to note ME, or thats how I've been doing it for a long time now. Minus of course if your in my discord friends already, then we have a pre-established relationship and it doesnt matter.
I will ALWAYS ask for your paypal email so I can send an invoice. I dont tell you to send me money, I have to pay taxes on these payments and doing invoices is the easiest way for paypal to give me official documents through it, so thats what I do. So I will NEVER ask you to just send me money to X email. Thats NOT me.
Please just be wary when recieving messages from people on here guys. One letter or symbol off and they could be a scammer just trying to get your money and possibly tarnishing the artists name in the process, when its NOT them.

Hey guys, I feel like I needed to get some stuff off my chest
There have been a few things bugging me and I would like to address them
1 Lets start with OUR relationship
It feels like I'm put on a pedestal while also being looked down on as if I was dirt
I'm on a pedestal cuz I'm an artist and I do art
But also looked down on as if I was dirt since the clock starts ticking as soon as I accept payment and GET MY ART DONE NOW OR I WILL THROW A BIG FIT OR TELL MY FRIENDS THAT YOU ARE A HORRIBLE ARTIST
Or maybe thats my anxiety talking, I honestly dont know anymore
I dont get it either, thats just how it feels
2 Why cant you follow the rules?
So this applies to everything I do
I have a TOS for a reason, as the commissioner it is YOUR job to read MY TOS
My TOS had been my FEATURED Journal since I started being an artist over 2 years ago. This has NOT changed. It is literally on my profile plain as day. You CANNOT miss it
I have had several instances where people who have copyrighted characters have tried to commission me and I obviously tell them no as I DO NOT DO COPYRIGHTED CHARACTERS OR WANT TO BE SUED BY THAT COMPANY, or ya know I have respect for the creator and would not like to create NSFW art of a character I enjoy in a SFW setting
There are also people who bid on my auctions then they dont respond for the allotted time given.
You do realize theres a time limit right? Usually about 3 days is my minimum.
Its there for a reason
And raffles also apply to this number
I put precise instructions, sometimes even asking friends to double read them to make sure that the rules make sense and I am not missing anything

3. Trolls/Annoyances

Nitpicking: Oh my God. I cant even with this. Yes I understand if I dont get a specific detail right, sure thats on me. But nitpicking my work to the point that I'm pissed instead of having fun with a piece? Good God. I work with premade lineart made by other artists that I have to work with my average skills to fit YOUR character. Its not as easy as it looks sometimes.
4. Characters
Some of your characters are freakin awesome, and I LOVE how much of a variety that everyone has with different colors and species!
One massive complaint I have. Character or species theft
I double and triple check to make sure you own your character if I am unsure. I REFUSE to continue the cycle of characters being stolen. I have made other rants about this in another journal.
But giving me an imgur or discord link to your ref just doesnt cut it. I need to VERIFY that YOU own your character. Theft is VERY common in this fandom. Like scarily so. Hell if someone took my Willow and got sexual art of her I would most likely have a straight up panic attack over it. Like a literal anxiety attack. Cuz she is NOT a sexual OC of mine. I am VERY attached to her.
Just as an example.
Species theft
Ya know this pisses me off alot
I am in a number of closed and open species, you may have even seen a few of my characters from them being posted in OC-tober.
But stealing a species and making your own WITHOUT talking to the creator of the species??? Yes I KNOW it costs money most times. BUT did you ever stop and think, maybe THIS is how that artist makes money to have a roof over their head or food in their bellys? By selling imaginary creatures that people like the design of to get more art of?
I understand if you didnt know. But if you do and then STILL make it. You are basically scum to me.
I cant respect that. I just cant.
Anyways, I guess the TLDR is: I am tired of staying quiet and dealing with the bullshit behind the scenes.
I dont like doing things that cause me more stress and cause by my anxiety and depression to skyrocket. I dont want to pull "that" card. But its what I live with

Just treat your artists with respect. And for me respect is earned. And when you pull something of the above? You loose it and get put on my, never again will I deal with you, list. And yes that exists for me and many others.
Artists are people too, We have feelings and lives outside of yours, and sometimes the shit you pull makes our life hell. So stop it.

Are all VERY common in this fandom
Mostly its due to cheapskates who refuse to buy their own art and think "hey this character looks close enough to what I think MY character should be, so its mine now!"
And I'm sorry, but thats not how it works
As far as I know from personal experience, and from watching others, each character someone makes is literally a piece of themselves and when our characters get stolen and or used in ways we do not consent to it literally hurts our souls
I have seen many "popular" characters be stolen to us for "RP" or cuz people are too lazy and think no one will notice
I have an acquaintance who has one of the #1 stolen characters out there. He's not big or popular but ONE person uploaded his character to pinterest or some other well known "art theft-haven" website and suddenly his character belongs to "everyone"
Art of the character was being commissioned without his consent that he was finding on other websites, including them changing his gender without consent
I recently found out about a popular artists whos character was commissioned WITHOUT consent mind you, to be in cub porn sand fetish art. Not only does this hurt the character, but this could come back to bite the artist in the ass as they do NOT support this crap and did NOT commission this art of THEIR character being in LITERAL PEDO ART.
Its disgusting.
Its horrible
I hope both the freak that drew that art AND the one that commissioned it get thrown in jail cuz pedos need to rot in prison for their life with no freedom AT ALL

Back to the topic at hand
I know I have adopted a stance, that is even found in my own TOS where I will refuse to do art of the character unless I can trace it back to the original owner and or artist it was commissioned from. This is for my safety as well as the owner of the character
This includes with gift art to another, and I have and will go as far as to "destroy the surprise" ESPECIALLY if it is NSFW in nature to contact the other owner of the character to either verify they own the character (which if they have the character uploaded in their gallery then sometimes its a simple answer) or to verify that they know who is commissioning the art to me in the first place.
I have been literally THANKED for this and people have been SURPRISED
Why are people thanking me and being surprised???
Because not enough artists do this.
Not enough of us are going "Hold on, something doesnt seem right here, I need to double check a few things"
We NEED to be doing this
We NEED to be double checking
Or more character theft into disgusting situations will happen and it will be our own fault for not checking ahead of time
We NEED to be vigilant about people and how they approach us and with what characters
Its not just, take my money now draw my character
Its an extra step
But I do it with EVERY commission I am commissioned
Now its YOUR turn, YOU check the characters, make sure they are owned by the owner

As the artist I reserve the right to decline anyone I want no matter the reason
Commissioner must be 18+ years of age to commission me as commissioning requires us to be in a legally binding contract due to exchange of money.
If you, the commissioner, do not send me payment within 72 hours (3 days) of contacting me, I have the right to move on with another commissioner who has paid me.
*Paypal Only
*I will not start on any commission until I am paid first. You can expect results in 1-2 weeks depending on if I am busy in the real world or not.
*No more edits will be done once the commissioner approves the final piece. Whats done is done. (Minus of course if I forgot a detail that makes the character its own, such as a tail or horns missing)
If you do need edits after the final piece you will get 2 free major edits and after that I start to charge $1-$5 depending on complexity and time needed to fix.

It keeps track of EVERYTHING art related I am working on, from commissions, to personal art and is updated in real time as I complete tasks or commissions
*If for some unknown reason I am unable to do your art, IE I dont have the experience and or I cant work on it due to too much going on and I have already accepted payment, then you can get a full refund, or half of a refund if I was over halfway complete with the commission.
If you bid on one of my auctions and do NOT pay within the allotted time period or give any indication that you received my comment saying you have won, I WILL block you and blacklist you from ever doing business with me again
Bidding on my auctions means you agree to my TOS and you would be violating them if you do not conclude your end of the deal
Bidding on my auctions and then not answering in the alloted time is a waste of my time and anyone elses who was looking to bid on what you won. You may be blacklisted if you do not answer or not acknowledge that you have won the auction.
Please make sure to credit me and the base owner I am using when you repost the art you have commissioned as everyone involved, including the one commissioning, deserves credit for amazing art!
*All sales on adopts are final, unless if I missed a specific detail we had talked about previously, whats done is done. No refunds.
Prices are usually determined by complexity and design of time spent
You may not sell the adopt for more than you paid UNLESS you have added more art that YOU paid for or created, but it cannot be the bare minimum quick free to use base stuff. That isnt fair to myself or the future buyer.
Anyone who is taking my adopts and quickly selling them for more than they are worth will be blacklisted from future sales with me.
Free adopt raffle adopts may NOT be sold for ANYTHING unless commissioned work has been added to them. Dont be making money off my free adopt, thats just super scummy. If you dont want it after winning it you are free to raffle it off or trade it for another adopt or art worth the same price, so free. If I find you selling the adopts you win for free from me, you will be blacklisted and warnings about your behaviour will be put up for others to see.
Blind Adopts are exempt from the prices above as more are offered based on what tier is bid on, such as extra art in YCH or chibi's
If you are doing free art for another, or you have no art of your character you want art of in your gallery, I may just ask you to upload information, or guide me to where it was originally uploaded to verify you own the character(s) or the people you are gifting own the character(s). Art theft is common in this fandom. I do not want to continue the cycle. There is a high chance I will not do art for either you or the person you are getting art for if you do not have at least one place where ANY art of where either sona has been uploaded online. New refsheets for new sonas do not count in this.
On that note I will NOT do art of cannon copyrighted characters that are not owned by the commissioner.
Fan OC's are alright as long as they arent an exact replica of the copyrighted character, such as my own Pokemon fusion, Soul, who is a absol/dragonair fusion.
I would prefer heavily if the reference sheet/reference pic given to me was FLAT colors and NOT shaded. Shaded pieces are an absolute chore to get color swatches from as the color of the character literally changes per pixel when heavily shaded.
ALL of my reference sheets/adopts/customs will be done in flat color to reflect this.
Something I would like to point out is I have two children.
I may be busy with either of them and not have time to get commissions done as fast as I would like.
I only work Mondays-Fridays provided my physical and mental health allow it. I have been nonstop sick since my kid started school so some days may be worse with others. Mostly headcolds, ALL the headcolds...
I do not work weekends so I can spend time with my family.
If something major happens, death in the family, social event, etc I will put out a journal letting folks know and will then either quickly get the coms I have done, or give the commissioner a wait time until they can be done if I am impacted by said major thing.
I retain the right to use any art I've created for portfolio purposes of my choosing. Owners of characters I've made gift art for may request the art to be removed from portfolios.
