General Service Agreement

From here on the party making any purchases will be referred to as the CLIENT and the artists attached to this account will be referred to as the ARTIST(S).

The CLIENT must read and agree to these Terms of Service to have their purchase approved.

By purchasing a commission you (the CLIENT) are agreeing that you are 18 (Eighteen) years or older and have the legal right to make purchases via credit card. You must be 18 (Eighteen) years or older in order to purchase any character design, reference sheet, or work of art from the ARTIST(S).

Falsified information regarding the Age, Name, Permission to commissioned Character, or Payment Details of the CLIENT will result in immediate termination of the purchase and immediate reporting of the CLIENT. A purchase may be terminated at any point and a refund may be granted if applicable. Please see the following section 1. Payment and Refund Policy for further details.

1. Payment and Refunds Policy

Payment is accepted via Paypal invoices only.
Payment must not be sent ahead of invoice.
An invoice will be sent as soon as the price has been negotiated and agreed upon.

The CLIENT must pay the invoice before or on the agreed date for payment. Failure to pay the invoice means the CLIENT will not receive finished, unwatermarked character design. The CLIENT should notify the ARTIST as soon as the payment has been sent so it can be verified on both ends. All character designs are sold via auction. The CLIENT must be able to provide payment in full upon the agreed upon date.

Refunds are not applicable as all art is fully completed when being auctioned. There is no refund policy. If the CLIENT is no longer pleased with the character design that they have purchased there is a buy back/selling policy.

If the CLIENT is no longer satisfied with their character design and wish to sell, they can take the following actions:

a. Selling the design back to the ARTIST(S) for %75 the original price payed for the design. 

ex: A design has been auctioned to the CLIENT for $80.00 USD could be bought back by the ARTIST(S) for $60.00 if it is within the ARTIST(S) means at the time.
b. Selling the design to a third party for up to, but not exceeding, the original price payed. 

ex: A design has been auctioned to the CLIENT for $80.00 USD could be sold to a third party for $80.00 USD or under, but not for $100.00 USD.
c. Selling the design for more than the original auction price if accompanying artwork is being sold with it.

Ex: The CLIENT purchased the design for $80.00 USD and then bought an additional $120.00 worth of art of the character. The original art, rights to the character, and accompanying artwork can be sold for the cumulative value of all the art provided the ARTIST(S) are informed of this decision.

2. Harassment Policy

Any verbal and/or written forms of harassment or abuse towards the ARTIST by the CLIENT or violation of the following Terms and Services will result in immediate termination of the commission. Harassment and/or abuse includes but is not limited to:
Stalking
Threats to the ARTIST's or anyone else's personal safety
Threats of self harm on the CLIENT's part as leverage (for any reason)
Threats of cancelation on the CLIENT's part as leverage (for any reason)
Begging and pleading after a purchase has been denied
​Derogatory Language (this includes slurs used to describe characters such as c*ntboy)
The attempted justification of derogatory language
Incessant or Obsessive Messaging
Demanding of private and/or personal information

If the Harassment Policy is violated, a refund will be granted if the CLIENT has payed for their purchase and the CLIENT will no longer have the rights to the character design.

3. Accepted Content

Dramatic changes to any character design auctions will not be accepted with the exception of “Custom Character Slots” which will be released upon the ARTIST(S) discretion. Content that is absolutely and entirely forbidden is as follows:

a. Fan Art (the ARTIST(S) will NOT create any designs based on pre-existing, copyrighted characters such as Pokemon, Digimon, Final Fantasy, etc…)
b. “Rip Offs” (the ARTIST(S) will NOT create any designs based on other people’s fursonas or other people’s characters.)

4. List of Services

If the CLIENT attempts to solicit the ARTIST for services outside this List of Services, the proposed commission will not be considered and as such there will be no applicable refund policy.

The ARTIST(S) offers the following services:
Character Auctions
Custom Character Design Slots

All services function with an auction system where the CLIENT with the highest bid at the end of the allotted time period has rights to the character and design UPON PAYMENT TO THE ARTIST(S). The CLIENT must pay the invoice before or on the agreed date for payment. Failure to pay the invoice means the CLIENT will not receive finished, unwatermarked character design. The CLIENT should notify the ARTIST as soon as the payment has been sent so it can be verified on both ends. All character designs are sold via auction. The CLIENT must be able to provide payment in full upon the agreed upon date.


5. Distribution and Sharing Rights

The CLIENT who has purchased the character design has rights to use it in the following ways:
Use for role-plays and other creative endeavours
Cropping, resizing, and using for banners or icons
Using as a reference for other artists to make art with

Items/Character designs that are noted as “As Is” are designs that the ARTIST(S) will not change upon purchase. There will be no edits made by the ARTIST(S) upon purchase. The CLIENT is free to use the artwork from the ARTIST(S) to commission an updated reference sheet/updated artwork from other artists. The CLIENT is free to draw their own art of the purchased character with any and all updates or design changes that they wish. Neither the CLIENT nor any third parties may edit, draw over, redline, or otherwise alter the artwork in a way outside of cropping, resizing, or editing the canvas. Editing to the artwork provided is not prohibited.

The CLIENT is free to use the character design in any way they wish, but must give proper credit to the artist. Giving proper credit to the ARTIST is:
Not claiming to have designed the purchased character design
Not claiming to have drawn the original purchased artwork

​The CLIENT will be given an unwatermarked version of the final product for their own personal uses, but is not permitted to repost an unwatermarked version without the ARTIST's express permission. Finalized designs may be cropped to be used as icons, banners, (etc) and do not need to be watermarked in this instance.

5. Will/Wont List

The ARTIST(S) will not make characters with any of the following themes/intents present:

Transphobic uses of C*ntboy, Herm, Futa, etc.
Any Derogatory Language/Terms
Pedophilia/Cub
Bestiality or Zoophilia*
Hyper***

*Feral designs are acceptable, but they will NOT INCLUDE ANIMAL GENITALIA**
**Fantasy genitalia such as dragons/aliens is acceptable. Ones based on real life animal genitalia such as Horse Penises on Unicorns is not acceptable.
***It is the CLIENT'S choice to change/augment any features of the characters after purchasing however the ARTIST(S) are not obligated to create character designs with any particular fetish in mind.
