Terms of Service
For Commissioning Lutivian

By commissioning me, you are hereby agreeing to these terms of service. These statements may change on a case by case basis if discussed prior to the commission. I reserve the right to decline your commission request without reason at any time before payment is sent.

The Commission Process:
The commissioner makes a request, providing adequate character reference, I accept or deny the request and offer you a quote. Adequate character references should have easily discernible details and colors. Once an agreement is made, an invoice will be sent. For orders above $50 USD, at least half of the payment will be required at this time unless another payment plan is discussed; otherwise, the payment will be requested in full. Payment must be made within 48 hours of receiving the invoice, if it has not been paid I will consider your commission to be cancelled. The commissioner is agreeing to pay me approximately for the amount of time invested in the work done. Payments must be made through PayPal. Currencies accepted will be in GBP or USD.

Private commissions are available upon request. Private commissions will be charged an additional fee of 10% to account for lost potential exposure to new clients.

I will then agree to begin working on your commission. The time for your commission may take longer depending on, but not limited to, complexity of commission, work, family issues, health, or commission queue position. Commissions are generally completed in chronological order; however, that may change based on the complexity of your order. I will do my best to notify the commissioner if my situation has changed and if it may result in a delay in receiving your commission.

Thumbnail sketch(es) will be sent for approval after the commissioner has paid. Your character here auction listings account for this "sketch". For commissions, major changes/edits must be mentioned at this time. The commissioner will have the opportunity to suggest small edits at up to two times during the commission process. These edits include suggestions such as expression changes, coloring mistakes, and other errors related to the character depicted. I reserve the right to refuse the edit proposed on the basis that it will add more of an hourly cost to the commission. If the commissioner would like to proceed with the changes, an additional fee will be added to the final invoice or to an additional invoice. The larger changes may include edits not initially agreed on such as an addition of a background, additional clothing, alternate versions, and/or anything that would need to be completely redrawn.

Once completed, the commissioner will receive a preview image for the commission along with the final invoice (if applicable). Once the payment has been received, the commissioner will receive the finished piece in its original, full resolution. PSD files are available upon request. The commissioner is receiving a digital good with no shipment required. One or more pieces may result from the commission and in extenuating circumstances, none may result.

Image Rights, Editing, and Distribution:
I, as the artist, hold the rights to the produced image, and may use it for my own promotional or display purposes. I hold the rights to post or refrain from posting your commission on my social media accounts, including but not limited to Tumblr, Twitter, Derpibooru, and Furaffinity at my discretion, unless otherwise specified by the commissioner as a private commission.

Redistribution of the commissioned piece commercially or for profit, removing signatures and watermarks, and/or claiming the artwork as one’s own is considered copyright infringement. Purchase of commercial rights for an artwork will need to be discussed individually.

Neither the commissioner nor uninvolved parties are allowed to edit the artwork or make any major changes that compromise the composition or monetary value of the piece without permission. This includes but is not limited to cropping, altering elements, drawing on the image, tracing the image, adding signatures unaffiliated to the artist. Any of these actions will result in a ban from commissioning me and depending on severity, I may inform other artists of your actions as a precaution and/or file a claim against you or the hosting site. If you would like any post-commission edits to be made, please discuss it with me. This is in order to preserve the integrity of the original piece.

Refunds:
The commissioner does not have the right to chargeback or refund the commission through the payment processor if payment has been received and the product is in development or completed. If there are extenuating circumstances that require the commissioner to cancel the commission, I must be notified and details will be sorted at that time. Partial refunds will be given based on the amount of work completed on the piece at the time the refund is requested. The commissioner and the artist have the right to cancel the commission before the first payment has been made. If final payment is not received and it appears the commissioner is intending to “walk out” on the transaction you will lose your anonymity and I reserve the right to notify others of your actions, file complaints against you, and ban you from commissioning me again, regardless of the length of time that has passed. I reserve the right to keep our conversations for reference as evidence in the case of a chargeback or refund. I reserve the right to cancel your commission on the basis of harassment, threats, or slander towards me, my family, or my associates.

If I cannot provide the commission to the commissioner due to any short or long term circumstances that render me unable to complete your commission, you will be notified and asked if you would like to be refunded.

Loss of Contact:
If the commissioner has become unresponsive to emails, personal messages, social media posts from me for 30 consecutive days, I reserve the right to cancel your commission. A final notice will be sent at most seven days prior to canceling. A refund will only be issued if the commissioner requests it.

For Your Character Here or YCH auctions, the highest bid will receive the commission, if the highest bidder does not respond within one week, it will be offered to the next highest bidder. Should the second highest bidder decline, I reserve the right to place the piece up for auction an additional time.

Adult Materials:
By commissioning adult materials, you are consenting to being over the age of 18 and the characters depicted are over the age of 18. No refunds or chargebacks will be given if the commissioner is fraudulent on their part in this aspect.

Will not draw:
I will not draw characters that appear to be underage. This is up to my discretion and I will let you know if I am uncomfortable with any subject or subject matter.

This list may include:
Water sports, vomit, scat, inflation, extreme gore, vore, bodily horror, loli, shota, cub, vore, sexual violence, beastilaity (or non-sentient feral on human).

Closing Statements:
The commissioner agrees to these terms upon payment for the commission, and they accept everything else that was discussed with me.

Any of these statements are subject to change, please retain a copy of these terms for your own reference. This document was originally created by aisuroma and use was exclusively given to Lutivian. Please do not copy this document for either personal or commercial needs.
