Vitai regarding The Dealers Den
Posted 2 years agoLast night, I was contacted by a Furry YouTuber, and for the first time, asked directly for my side of The Dealers Den story.
It’s been six months since everything happened and this inquiry got me to finally sit down and compose my thoughts on the matter. Enjoy.

remixartist69Another year older
Posted 9 years agoI am three to the third today. That's 27 for you non-math-inclined folk. ;)
Another year gone by and I feel like I have done a lot of growing this year thanks to the help of my wonderful corgi remixartist69. I've opened up a little bit out of my shell... that protective wall I've had around me for several years... and am starting to explore more than my immediate surroundings. I've started to take notice of others more and not be so self-centered all the time. I still slip into old habits now and then, but things are definitely looking a lot better and they will continue to get better as time goes on.
Thank you so much to those who have stuck by me so long. Been patient with me as I grow into the person I'm meant to be. I wouldn't be able to do it without friends like all of you. You guys rock. <3

A Discussion of Copyrights (Update)
Posted 10 years agoAfter doing more research, I have determined my character and this fursuit of my character, Vitai Slade, are copyrighted. See Harrison-Erickson, Inc. v. Chicago Bulls Ltd.. P'ship, 1991 Copr. L. Dec. P 26711 (S.D.N.Y. 1991).
The author of the protected work holds the ownership of the copyright. 17 U.S.C. Chap. 2 § 201 (Copyright in a work protected under this title vests initially in the author).
However, because I hired Scribblefox to do the work, I am the author of the suit. 17 U.S.C. Chap. 2 § 202(b). (In the case of a work made for hire, the employer or other person for whom the work was prepared is considered the author for purposes of this title, and, unless the parties have expressly agreed otherwise in a written instrument signed by them, owns all of the rights comprised in the copyright).
There were no agreements made in writing and signed by me involving the distribution or transfer of copyright in my character or of the suit, and as such, I still hold initial ownership of the copyright discussed above. 17 U.S.C. Chap. 2 § 204.

DATCH FOR ALL OF THE HELP!A Discussion of Copyrights
Posted 10 years agoI am not a copyright lawyer nor do I know all of the intricacies regarding copyrights. What I do know is what seems okay to me morally and what I have researched on the internet.
I had a few people contact me via twitter the other day regarding my company logo for my startup t-shirt business. They said that, without express permission, using a photo (or photo manipulation) of my fursuit as my logo was copyright infringement against ScribbleFox/OneFurAll Studios because the fursuit was his creation and therefore, he owned the copyrights to the suit and the suit image. While the argument is certainly a fair argument, I disagreed and here's why:
1. The character is a copyrighted entity in an of itself. I solely own the copyrights to Vitai and his image no matter what form he is manifested into, 2D artwork, 3D artwork, sculptures, whatever. There is no counterargument to this fact.
2. The fursuit, which was a commission for me that I paid for him to create, was based ultimately on my design, making it a derivative work. When I say my design, I don't just mean that it was my character, but it was literally my design. I chose to give him digitigrade legs, muscle padding, and fully-sewn stripes. For the head itself I chose the style of eyes that I wanted and most importantly, the custom shape of the muzzle, which, without that input, would have completely changed the look of the suit overall. It was a custom creation. While Scribblefox was the one who actually BUILT the suit, the suit design and features were of my choosing.
The counter-argument to this is that while I chose the options, the style (such as the eyes) matches that of the artist and his other creations. It is a clearly identifiable style across the fandom and many people know it and associate it with his work. HOWEVER, artwork style has been determined to not be copyrightable. For example, drawing new characters in the style of 'The Lion King' is not copyright infringement. The characters would retain their own copyrights regardless of what style they are most seen in and could be legally sold without infringing on the copyrights of others.
3. The logo is a photo manipulation of a photograph taken of the costume while being worn by an actor inside the suit, performing the character which belongs to me and is then being used as a trademark for a t-shirt company. This is where things get really complicated. Even if we were to assume that Scribblefox was 100% entitled to the design, creation, and copyright of the fursuit, which I still don't agree with for reasons stated above, we would have to take all of the other details into consideration.
The photograph - The photographer is really the one who holds the most claim to this image. Without the shutter click of the camera, the photo, and therefore, the image, would not even exist, even with all of the other pieces there.
The actor - Without the actor inside the suit performing the character, would that image have been able to be taken? Copyrighted artworks are usually stagnant and unchanging. Statues, drawings, etc. Does the actor play a role in the creation of the image? Absolutely. Does he hold any claim to some of the copyrights? I don't know, but I wouldn't dismiss it immediately.
The character - obviously still belongs to me. That hasn't changed and will not change. The image of the character as a photo of a fursuit creation is what we are questioning here.
The editor - This is the guy who actually took the photo and edited it. While the photographer retains the rights to the original image, this guy definitely played a part in creating the logo. Was the edit significant enough to be considered a derivative work? Or is the image still close enough to be considered a copy of the original? This is what you'd need to decide in order to determine his claim to the image.
The t-shirt company - I haven't yet touched on this, but it is a definite consideration. The t-shirt company never alludes to having created the fursuit that the logo is based off of and in the context that the image is used, I don't think that any rational individual would assume that they were. The t-shirt industry is a completely unrelated business to that of fursuit creation. The t-shirt company is not creating copies of the fursuit. They are using a manipulated photo of the fursuit character as a logo and trademark.
4. One other thing that I have not touched on, but might be worth thinking about is the fact that clothing designs are not copyrightable. This has been a serious problem for clothing designers for years, but courts have decided that the utilitarian purpose of the clothing outweighs the design itself. As with every general rule, there are a mountain of exceptions to that rule, but this has been the general consensus among courts.
5. As a final note to consider - What about the photographers at conventions that have their photo studio set up and then sell you the images they take in the form of posters, keychains, ID cards, etc.? Would that be considered copyright infringement against the fursuit maker because they are profiting off of the fursuit makers creation?
What do you think? Is the logo for Tiger Brand Clothing Company copyright infringement against OneFurAll studios? Or not? Who owns what rights?

New Hobby: Movie Poster Collecting
Posted 10 years agoOne thing that has always been a big hobby of mine is movie watching. I love movies! So much, in fact, that I aim to one day build a mini-movie theater right in my own home. One part of this idea was to get a poster light box like you see outside the actual theaters. You know, the ones that show the posters of the movies that are 'Now Playing'? Well, one of my very favorite movies of all time is 'The Lion King', so I decided that the poster I would be displaying in this light box would be THAT poster. I ended up buying one off of eBay and found a fantastic light box there to display it in. When I stuck them together and saw how beautiful it was in my own home, I was hooked, and now I want to buy another light box and change the display posters in them from time to time. When I saw how affordable most of these movie posters were, I decided to buy my very favorite movies to display. One after the other, I started collecting and have succumbed to the fact that I've now gotten a new hobby. This journal is going to be updated whenever I add a new poster to my collection. But for now, my current collection, in order of purchase:
1. The Lion King (1994)
(Original, One-Sheet, Double-Sided, Rolled)
2. The Lion King (2002)
(IMAX Re-release, One-Sheet, Double-Sided, Rolled)
3. Two Brothers (2004)
(Original, One-Sheet, Double-Sided, Rolled)
4. How to Train Your Dragon (2010)
(Original, One-Sheet, Double-Sided, Rolled)
5. Guardians of the Galaxy (2014)
(Original, One-Sheet, Double-Sided, Rolled)

INGRESS INGRESS INGRESS EVERYWHERE (Invite Codes)
Posted 11 years agoFor those of you that have heard of the game (or haven't) and want to know what the craze is all about - Ingress is an augmented reality game created by a subdivision of Google where players capture and protect areas of their own town using a GPS-based app on their phone. Think of Capture the Flag, Foursquare, and Geocaching all rolled into one. If you've never played it, I recommend you at least try it! Play until you reach level 3. If you still don't like it, then you can uninstall it, but not before that! If you want a special invite code from me, hit me up with your e-mail address (note me if you don't feel comfortable posting it) and I'll send you one. :)
Quarter Century (25th Birthday)
Posted 11 years agoSo now I'm officially a quarter century old. How do I feel? No different than last year really... or the year before that... or the year before that. Honestly, with as much focus as I've put into my finances and goals, it feels like the years just zipped by. I feel like I should be turning 22 today. I've not had anything truly significant happen in my life since then, which may be why I feel this way. I mean, I've bought a house, gotten a decent bit of experience at my job, increased my net worth by quite a bit, and met some new people and gotten closer to old friends, but nothing 'life-changing' has happened. I suppose I am responsible for that. My life is very predictable. Very concise. Very deliberate. Stable.
I suppose the thing that has me mulling through the days the most is a complete lack of real activity. I go to work, I come home, play video games, eat, sleep, on weekends I host my regular game night, etc. But besides the occasional convention (which ironically I end up mulling through out of habit), nothing really changes.
25 is an interesting age for me. A lot of people are married and have a kid on the way by now. Others are just getting out of college. Myself? I'm almost 3 years into my career, settled down into a stable home that I can take care of myself, but have never really had a real, live relationship. Seems like a silly thing, but I feel like I'm missing out on that part of life. I did the long distance thing with several people, but to me it is a temporary thing unless plans are made to make it real. I had a 3 month, one-sided relationship with someone who didn't have feelings for me back, so I don't know if I even consider that real.
To be honest, I feel like I should just keep to myself. I long for the passion of a deep loving relationship, but I don't know if I can trust anyone enough to let myself feel like that again. Life is stable and manageable. I know that there are thousands of people that would kill to be in the position that I've set up for myself here. There is no spark to life right now... that's not to say that life is bad, because it's definitely not... but there is a serious lack of 'something' there. I'm sure there will be if I just be patient. Of course... I said the same thing last year... and the year before... and the year before...

Assumptions Meme
Posted 11 years agoFollowing the bandwagon, I suppose. Ask away! :p
Write a comment with an assumption you have about me and I'll let you know if it's true or not! I've always been curious how people see me, especially those I don't talk to often but who have followed me for awhile.

<3 Love is this beautiful thing... <3
Posted 11 years agoIt's been three years since I've felt the true heart pangs of love. Well, no, I guess that's not completely true. I have been heavily infatuated with several people in that three years. I won't name names, you know who you are. But every single one of those infatuation spells was for someone that lived too far away to consider having a real, permanent relationship with. I don't want another long distance thing. I want a REAL relationship if I'm going to have one. One that is not only emotional, but physical. As in, on a regular basis (not just at cons and shit). The problem is... I'm so heavily involved in the furry fandom, that all of my friends are from the furry fandom, which wouldn't be a problem, but most all of them live hundreds or thousands of miles away! The local community here isn't small, but there hasn't been anyone that has come around that has piqued my interest. I'm rather picky, you see... at least when it comes to someone that is going to be an extension of myself.
I've had a few serious relationships in the past, but every single one of them has been long distance. The only one that wasn't lasted a mere couple months. That was three years ago. After I swore off long distance relationships, I stayed single, though it was a blessing in disguise. In that three years I overcame a lot of the personal problems that was causing my other relationships to fail, but mainly, my lack of self. I found myself. I found who I wanted to be. I found purpose, hobbies, a meaning to my life, a direction. I became my own person instead of this mirror that shifted into whatever my partner at the time wanted me to be... or what I thought they wanted me to be. I ditched my co-dependence, which, if I learned anything from my most recent ex, it was that.
After growing into the person I wanted to become, getting a stable, amazing job, and having lots of time to myself, I became very content. So content, that I barely even remember anything from the last year or so. I was set on my goals and my path and it just zipped by me. But that all changed around February of this year. Right around then, the company I work for hired some new 'chip runners' and one in particular immediately caught my eye. It was odd.... I had sworn off long distance relationships and females (when it comes to relationships), but this one... I don't know... she captured me. I immediately started crushing on her and right about mid-February, I was ready to ask her out for Valentines. I had just about gotten up the courage and asked a couple co-workers about her when I found out... she had a boyfriend. DAMN.
With my plan foiled, I withdrew back to my content life, trying to ignore my feelings. I had already gone through one experience involving stealing someone else's girl and I did NOT want that drama again. Just leave it be... But I still couldn't stop taking peeks here and there. Every time she was at work with me, I'd feel a little flutter inside as she walked around the room. I kept it to myself, of course, never daring tell a soul. But those feelings persisted.
I won't bore you with all the details, but around the beginning of this month, she ended up breaking up with her boyfriend for reasons I will not discuss publicly (I was not involved!) and we started talking.... every. single. day. We continue to learn about each other and grow closer and closer... and... goddamn... I think I'm in love with this girl. We are still 'just friends' at this point, but it is becoming quite clear that this feeling I have for her is mutual, and will most likely turn into something much deeper with time. <3

LAZERS IN YO EYES! - Lasik Surgery
Posted 11 years agoSo I finally grew a pair and went in for my Lasik surgery this morning. To say that it was a unique experience would be an understatement, but gods is it amazing afterwards! It blows me away that I'm sitting here typing this without the help of contacts or glasses... and it's just the first day! The time it takes to fully heal is around 3 months, with the first three days being the most vital, followed by the first week, then the first month. It'll take 12 months before my wallet is healed, but only because I decided to put it on a payment plan. :p 0% interest for 12 months? Hell yeah! Anyway, just wanted to update everyone on the purchase of my new eyes and how grateful I am that everything went well with it! For anyone who has questions about the process, how much it costs, where I went, etc. feel free to ask away in the comments below!

ESG Plans Cancelled
Posted 11 years agoWhy I waited until today to make this journal, I don't really know, but I promise you that it is not an April Fools Day joke.
Because of an upcoming event at my place of employment, I was denied the time off for ESG 2014 and had to cancel. Sadly, I will not be in Vegas this year. However, I did take the plane ticket and turn it into a Rainfurrest 2014 Seattle trip, so as long as there are no events occurring during THAT time frame, I should be good to go! Just thought I'd let everyone know where they'd see me next! My schedule (tentatively) is as follows:
Anthrocon 2014
Megaplex 2014
Mephit Furmeet 2014
Rainfurrest 2014
Furloween 2014
Elliott's Fall Festival 2014
Midwest Fur Fest 2014 (hopefully)
More to come in 2015!

Popufur - Celebrity Worship Theory
Posted 12 years agoThis is a very good talk/rant I found from Jack Gleeson (AKA King Joffery from Game of Thrones) to the Oxford Union explaining his ideas and opinions on celebrity worship in our society. It is very similar to my ideas regarding the desire to become 'popufur' in our furry fandom and why it happens to a certain few. If you have the time and patience (t's about 30 minutes long), give it a look. Oh, it also contains 'big words', so you'll have to personify that of an intelligent, perceptive individual if you want to understand it fully.
FURRY Cards Against Humanity Card Ideas?
Posted 12 years agoSo I now have the main game, the box set, and all four expansion packs to Cards Against Humanity. I have thought of several different ideas for white and black cards, but now I'm out of ideas and I still have a TON of cards to go because they gave me so many! I've already used Sodomy's Furry Dog Pack (or at least my favorites from it) so please don't add any from that. But I need ideas for furry-specific cards (black and white cards). Do you have any good ones?
(Yet another) Furry Documentary Casting Call
Posted 12 years agoIt's too bad that all of the furries we might actually want to portray in a televised documentary are smart enough to ignore the casting calls. It only leaves the suckers and deviants who can't string a coherent sentence together and it makes us all look like idiots.
I sent Asylum entertainment an e-mail today and this is what I wrote. Tell me what you think:
Hello,
I understand that you are interested in casting a few furries for your next TV Documentary. I am a 24 year old male fursuiter in Florida that is deeply involved in the furry fandom. I have been in the community for approximately 8 years now. Due to being in the fandom so long, I am quite aware of the negative media portrayal that seems to plague our group and I am always skeptical about the true intent of producers when I hear about (yet another) furry documentary casting call. As I'm sure you may know by now, furries in general do not take kindly to the media thanks to past occurances. However, there are rare occasions that the media does a good job and shows an accurate picture of what the community is like. As a long-time member of the furry fandom, I ask you kindly to re-think your stance on producing another show about us. You are not doing us any favors nor are you helping out the people you follow with your cameras. More often than not, these few furries you choose are ostracized and run out of the community shortly after the show airs due to the awful image you have manipulated them into giving to you. Sadly, I know I cannot stop you from doing this show nor can I force you to do a good job when you do produce it, but I will give you a little insight to our community. We are VERY tight knit. As a whole, everyone active in this fandom knows pretty much everyone. If you do a poor job and show us in a negative light, you will cause a ruckus and it will hurt this community even more than it already is hurting. More hatred will be spewed at innocent teens and young adults just trying to have a good time. Passing cars on the street will yell out 'faggot' at fursuiters that are just trying to bring joy to others (I've had this happen to me). Not even mentioning the lives of the few furries you just completely screwed. It will NOT be a good addition to the slew of media that doesn't truly understand who we are and why we do what we do. On the other side of things, if you do a good job and truly get to the core of what being furry is about, you will be praised and practically glorified by the community (and there are a LOT of us across most first world countries) for at /least/ a short while. After that though, things become even more amazing. When furries express themselves and open up to their friends and family, they can point to your documentary. When parents don't understand why their kid wants to buy a really expensive, 'stupid dog costume', they can be directed to your documentary. Instead of smearing the community and destroying people for a good laugh, you can be a positive force to help people understand and accept. With that said, I do not want to be included in your documentary, I do not give you the rights to use my words, image, character, or any references to me, my creations, or even this e-mail, nor do I want the show you are about to do to even air. But if it is going to anyway, please at least make it positive.
A very hopeful tiger,

UPDATE: I received a response just the other day. It was as follows:
Thanks for your email. We have found the furry stories that we intend to follow. We have come again alot of scrutiny and we realize that the media has not been nice to the fandom in the past. When we reached out to people for the documentary we explained that this is your chance to voice exactly what you want to about being furry and show the true lifestyle. I cannot promise you that this piece will be a positive one as we are simply following the people involved so if they are not a good representation of the fandom, unfortunately we were only left with choosing people that were willing to be involved. We produced this show with integrity and have no reason to slander or tell a story of untruths. People unfortunately already have a preconceived notion of what they thing being a furry is....and unfortunately i must say it is not great. When people asked me what i was working on and I said I am looking for Furries, they immediately went to the dark side saying oh those people that dress up i animal costumes and have sex, I immediately shot that down and said absolutely not furries are individuals that relate to anthropomorphic characters and animals, they are very creative and love art work and are so much more.......there is a dark side to every subculture, it is a shame that people immediately go there when furry is mentioned. I have done everything I could to educate the narrow minded and really hoped that more people in the fandom would have been willing to step forward and be apart of this to really set the record straight and be that voice that the fandom needs.
