You might be incorrect on your assumption.
1. Jonty and Clem are here for the murder case of a Higher by Nether Jonty or not, both who have said that "Nether Jonty" is innocent of accused crime.
2. Clem and Jonty have said that their was another Nether there at the fight. Refer to http://www.furaffinity.net/view/31183162/ or chapter 4, page 54.
3. Jonty has made it clear with his spoken words that he was the victim of an unprovoked assault by the Higher patrol, one of which ending up dying before they managed to escape, while both Jonty and Clem had nearly gone killed during the fight in their attempt to survive.
