FosQ Commissions - Terms of service - v.1.0 July 2025:
By buying a commission:
-You affirm to be of legal age in your country of residency and that you’re the owner of the payment method (debit/credit card, bank account, etc.) or have the permission of the owner to use it.
-You agree to the following terms of service's version that was active at time of buying the commission:
1.Commercial rights and copyright:
By default, the commissioned artwork is for personal use only and for sharing on the client’s personal social media accounts, any other intended use must be discussed before payment.
Some or all rights may be given to the client for extra payment or no additional cost.
Regarding adoptables/Character design, all rights will belong to the client except the use regarding “1.2 Secondary uses clause”.
1.2 Secondary uses clause:
Client may not use the artwork or designs for neural network/AI/machine learning/NFT/Blockchain or any technology directly or remotely derived or connected.
2.Revision Policy:
Up to 5 changes/reworks will be provided during the sketch phase, after that, up to 2 reasonably small changes will be provided.
I may reject any change, revision or rework if I find them to be excessive or not viable.
Further revisions may be provided after extra payment.
3.References, updates and feedback:
The client must provide a detailed description of the commission alongside reference images, anything that is not explicitly discussed will be taken under artistic liberty.
4.Payment and procedure:
Payments will only be made through Paypal in USD. Unless stated otherwise, I will provide a basic watermarked sketch before proceeding with the payment, once the full payment is done I’ll start working towards artwork completion. Exceptionally big payments will be discussed accordingly.
In the case of a sketch commission, a very rough watermarked sketch will be provided instead.
If any type of payment tamper or not agreed refund is detected, the commission will be immediately canceled and the client blocked, the client will not retain any rights over the artwork or designs commissioned.
5.Timeline:
Artworks will take at most 10 days after the payment, unless otherwise agreed upon or stated.
If exceptional circumstances of any kind occur, the client and the artist may discuss a solution.
6.Artwork files:
The final artwork and the different updates will be provided either by direct message on the client’s preferred artist’s social media and/or email.
Commission’s original files will not be provided unless previously agreed upon.
If the client loses the file, I’m not responsible for providing a backup of the artwork 90 days after commission completion, even then you may freely ask if I own a copy.
7.Credits and watermark:
Client must always provide credit when sharing the commissioned artwork online, if a footnote its not possible, the watermarked version must be used instead.
Client under no circumstance will claim to be the author of the commission.
8.Changes and retroactive nature:
This document is not retroactively applicable, you are only bound by the version coinciding with date you bought the specific commission.
This document’s terms and conditions may change at any time for any reason
9.Termination clause:
I can cancel the commission at any time for any reason, you will receive a full refund in the following days.
10.Dispute resolution:
All disputes will be solved only between client and artist.
11.Refunds:
For refunds, you must contact me directly through any communication channel, preferably the one you originally used to contact me. In no case or circumstance will PayPal be contacted first.
If I didn’t start working on the artwork yet, you will receive a full refund.
If I did start working on the artwork, you may or may not receive a partial refund depending on how much work was done before cancellation.
12.Communication channels:
If the client fails to respond in 3 days, the commission will be labeled as “frozen” and it will not be worked upon, that is, I will not proceed without the client’s approval of the work-in-progress update.
The commission will not be deleted, the payment will not be lost, the commission will became active once again after the client responds.
If the client fails to respond in 360 days, the commission will be labeled as “abandoned”, after that the client might ask for a partial refund proportional to the artwork’s completion.
13.Referral code policy:
One (1) code will be provided per client and per commission, the code’s validity and referral promotion can end at any time for any reason.
Codes can be rejected at any time for any reason.
14.Data collection and client privacy:
The data I collect and register is:
-Your social media Nickname.
-Type of commission. (Sketch, Lineart, Flat color, Shaded.)
-Commission Description.
-Reference images provided by the client.
-Communication channel used. (Social media, Email, message.)
-Date the commission was accepted.
-Date the commission was finished.
-Price
-Referral Code
-Progress of the commission.
The data I do NOT collect nor register:
-Any of your PayPal data: name, email, country etc...
-(Besides commission description) Any content inside direct messages and/or emails between client and artist.
The data I collect is encrypted and protected inside local-only drives.
All the data will be deleted and overwritten after 30 days of commission completion.
The referral code will be saved ,with no attached metadata nor name, until its used or expires.
The artwork, with no attached user metadata or name, will be saved for at least 90 days after artwork completion.
You may request for your data or commissioned artwork to be deleted at any time for any circumstance or reason.
I’m not responsible for data collection from third parties not associated with me, such as PayPal, FurrAffinity or any other communication channel/social media the client uses to contact me.
