TOS update! (longass journal)
WOO, been workin on this for a bit. I think it's a lot more thought out and stuff from my old one. This will apply mostly to new commissions. Only a couple little things on it will be retro-active, so no worries!
ALLERGIES AND PET WARNING
If you are allergic to ______, please let me know in advance. This household has dogs, cats, fish, mice, spiders, snakes, and probably more on the way with time.
No animals are allowed in the workshop, however, hairs/dander can be carried on clothes.
QUOTES, ORDERING, AND PAYMENT
Quotes are valid three (3) months from the time it is given. I may not always have time to go through quotes, so please be aware of when they are open. Quotes send when quotes are closed will be ignored.
If the deposit (usually 30%) is not payed in full before the three months are up, the design will need to be re-quoted.
YOU WILL NOT BE PLACED IN THE COMMISSION QUEUE UNTIL THE DEPOSIT IS IN.
As soon as the deposit is in, and your commission is confirmed, I will order the materials for your suit. The deposit is NON-REFUNDABLE. Please be CERTAIN when you are placing an order for a commission, as it is a large sum of money, and an important decision.
Final payment will be 25% of the total, Plus any surcharges, to be paid upon completion of the project.
The remaining 45% will be paid in monthly increments by a designated date each month during suit construction.
Please, when you notify me you are about to send a payment, make sure it has been sent within 24 hours.
A missed payment (over one week overdue) will result in your suit getting bumped to the end of the queue and the deadline reset.
I accept Paypal and money order. PLEASE NO PERSONAL CHEQUES!
CONCEPT ART
Depending on the type of commission, Artistic Freedom or Personal Character, I will accept photo references of real animals, written descriptions, or a character reference sheet that shows all aspects of the costume. (Full body for a full suit, Head/Hands/Tail and Feet for a partial, etc.).
Artistic Freedom accepted reference
-Photographs of actual animals
-Simple written description
-Expression References (this is the only exception to the 'other suits/not your art' rule)
Note, For personal characters, I will try to follow the reference given to me as EXACTLY as possible, so make sure the reference given is exactly what you want.
Personal Character accepted reference
-Photographs of actual animals
-DETAILED written description
-DETAILED character reference sheet with important markings marked
-Expression References (this is the only exception to the 'other suits/not your art' rule)
Unacceptable reference material
-Messy/Scribbled pictures
-Uncolored lineart
-missing reference (Headshot and shoulders only for a partial)
-another person's character(gift commissions: Recipient must be informed BEFORE the commission will be accepted, sorry)
-another existing fursuit
If I deem any reference unsuitable for use, a surcharge of $50 will be added to the total cost of the commission, and a new reference will be provided by me, based on the reference given. The commissioner will be able to have any changes made to the reference prior to beginning work on the suit.
In addition to the concept art I will require a front and back photographs of the commissioner for final concept art (included with the initial commission) that will be used to make my 'working reference art'. In short, an overlay will be made of the suit design over the photograph, which will give the best possible idea of the final visual outcome of the suit. The colors of the Working Reference Sheet will reflect the physical color of the fur, NOT the exact colors of the original references, since it is impossible to 100% match the colors.
MEASUREMENTS AND REQUIREMENTS
Heads- A front view and profile (side) view photograph of your head with the following measurements marked.
Head Circumference in Inches
Distance between pupils
Distance from chin to between eyes(over the nose)
Partials- The above PLUS a mailed tracing of your hand, fingers splayed. If no hand trace is provided, a default LARGE size will be uses to create the hand paws. The following measurements will also be needed:
Wrist Circumference
Wrist to underarm (for sleeves)
Wrist to top of shoulder (for sleeves)
Shoe Size (US, Male of Female) OR a NEW pair of shoes (Pre-tied if not slip-ons)
Distance from belt loop to the ground (for longer tails)
Fullsuits - In addition to the head and hand measurements, I also require a FULL BODY duct tape dummy. It's advised to start with the main body and work your way towards your limbs. Killkodo Costumes has a wonderful How-To on making a Duct Tape Dummy, here: http://www.kilcodocostumes.com/dtd.htm
Please note that I require all Duct Tape Dummies to have the seams taped up before shipping them to me. Any Duct Tape Dummies received that have not been fully re-taped will receive a $25 surcharge to the final bill.
Also, for Plantigrade(no padding) body suits, the DTD will most likely not survive the patterning process, and will not be able to be returned in tact. I may be able to salvage the base DTD for Digigrade bodysuits, however, since multiple patterns need to be made based off the original form, and might be able to be returned at the end of the project.
ARTIST STYLE AND WIP/UPDATES
While I will try to match concept art as closely as physically possible within the constraints of putting a furry character onto a human body, you are commissioning me for a reason. You like what I've done with other peoples characters and think I will do just as good with your own.
That said, I WILL CHOOSE THE FURS TO USE FOR YOUR SUIT. Unless you have a fur already specifically chosen, I will pick the furs I feel best match your reference. I refuse to work with cheap materials, so I will need a swatch of any 'pre-chosen' furs before they will even be considered.
Updates will be provided at certain stages of costume creation, unless I feel I need/want to post more bits of it in-between. The basic stages of suit progress are:
Head: Foamed
Head: Furred(fluffy)
Head: Furred(shaved)
Head: Finished
Body/Hands: Fur (just the fur for color examples)
Body/Hands: Padding(if padded)
Body/Hands: Finished
Tail: Finished
Feet: Foamed
Feet: Finished
Aside from these stages, fursuits in the building process tend to look like piles of materials slapped together with no real direction, and don't really show much of anything, so I don't feel there's much point in showing them. Unsewn fabric just looks like pieces of scrap, and a half foamed head tends to look like some kind of monstrosity.
That said, please do not pester or hound me about progress and updates. I post pictures as soon as I have a stage finished, and if nothing has been posted, it means I haven't yet worked on your suit. I have a visual calendar posted to show when certain suits are set to be worked on, so please refer to that before messaging me about your commission, since answering note after note after note does take time away from me actually being able to work on things.
DEADLINES
While I prefer to organize deadlines myself, or have a semi-floating deadline for most projects so I can give them the time they deserve, if you have a specific event or deadline you would like, it can be discussed in advance, and while I WILL NOT guarantee 100% a deadline, I will try to meet any I am given.
Unreasonable/Impossible deadlines will not be accepted. I require at BARE MINIMUM one month on small projects, and larger projects, at least 3 months notice.
Rush projects can be arranged, but will incur an additional fee, at my digression, on a case by case bases, and can not be guaranteed, but again, I will try to come as close to them as possible.
SHIPPING
Shipping is not included in the original quote. Shipping and Handling is extra (usually $50-$200 within North America for full suits) and figured out once the commission is complete. Inability to pay this S&H within two (2) months will result in your commission being canceled and your project sold at auction.
I ship using Fed Ex. All fursuits come with tracking. The buyer is responsible for all duty fees, customs, brokerage, and taxes over and above the cost of shipping. This is usually low or negligible within North America but it is up to the officials’ discretion. I have no control over extra fees.
I also will NOT deliver suits (by flying them in) at conventions unless expressly offered before hand. I WILL ship to a convention hotel but the post office is not an exact science so I highly suggest shipping it a week or two early to a friend’s house so you can pick it up before the con.
Shipping within N.America can expect to take 1-3 weeks. Overseas shipping can be 1-6 weeks.
WARRANTY AND REPAIRS
Warranty on a suit lasts 3 events (read: Not conventions) or 6 months, whichever comes first. If pieces of the suit do not fit, or arrive damaged, repairs will be made free of charge at cost of shipping the pieces back to me, if shipped within 2 weeks (14 days) of the item arriving. I will cover return shipping.
If the suit incurs any damages from NORMAL wear, the suit can be shipped back to me for repairs free of charge, commissioner paying shipping both ways.
To show that you have read the terms of service in full, please add Bananga Hanga at the top of your quote form. Also, please be sure to read the last portion of the terms of service, since it is very important. Thank you!
For airbrushed work, an annual touch-up can be arranged once a year to renew markings and detail work, free of charge, at cost of shipping both ways. Additional touch up will incur a charge of $25 to $100 depending on the level of airbrushing involved.
I refuse to do repairs/touch-ups on any pieces that have been worn (aside from test fitting) unless they are thoroughly washed and disinfected first. I will not fix any suits that have been abused, stained, modified, neglected, or used in any inappropriate way. Normal wear and tear is expected, but anything that I feel is obviously out of place will result in the suit being shipped back as is, and all warranty voided.
CANCELLING COMMISSIONS AND REFUNDS
I reserve the right to cancel any commission at any stage of the process, if the commissioner is rude, threatening, or otherwise unreasonable.
Once the order has been made and I have begun work (which includes having already ordered the fur) then no changes may be made to the commission.
If you wish to cancel your commission (for any reason), I will refund the balance (minus any applicable fees) and the deposit will not be returned.
I also reserve the right to not accept certain orders and commissions – these include copyrighted characters, ‘yiffy’ suits or items, ‘blacklisted’ commissioners, poor reference art, and such.
If the commission is complete and you decide something is not quite correct, let me know and I will tell you if it can or cannot be changed. If it can be changed and is my fault (for not following the reference/directions) there will be no charge, but if it is something that was not in the reference and/or is my own interpretation of the reference (The expression is not ‘happy’ enough even though you did not tell me you wanted a specific expression or the fur is the wrong shade even though it matches the references) then a fee will be charged for the adjustment to cover time/materials.
If we cannot come to an agreement, then you will be applicable for either a refund (minus deposit) or a remade head/paws/etc depending on what I think best fits the situation.
If the commissioner, at any time, decides to cancel the commission WITH A VALID REASON, a refund of the balance will be issued, minus time (if construction has already been started) and material costs (the deposit).
Buyers remorse is NOT a valid reason. You should be triply sure that you can afford a several hundred dollar costume before sending any kind of deposit.
IF UPON CANCELLATION OF A FURSUIT COMMISSION YOU DESIRE THE FULL PAYMENT AS REFUND, you will forfeit the commissioned design and all rights to said character to me in return for the deposit amount. The suit will then be finished and auctioned off before any refund payments are begun, and will be provided in payments over the course of one year.
