Drama... I'm so sick of it...

Alright, here's some talking on yiffy.tk's chat
I changed the names... it's so lame:
(18:14:35) ObviouslyFA-user-1: I can understand the using random artwork on the web to a point at least but it is in violation of this site's rules on submissions. Thank you for the advice.
(18:16:21) (Moderator): Mostly general legalese clauses I whipped up because a ton of people already complained about the use of commissioned characters. Reporting someone for having other peoples arts in their user galleries is a different story, that seems to be a definite reason for ban.
(18:16:36) user-1: The submission rules don't apply to character creation...
(18:16:58) (Moderator): I don't think it's against the rules to have art from other people in the pictures you can post to represent your characters under character profiles.
(18:17:08) user-1: Unless someone's submitting artwork to their own art gallery and claiming it as their own, you're more or less SOL.
(18:17:23) (Moderator): But the user gallery is strictly for artwork you yourself have drawn, posting art from other artists is against the rules.
(18:18:27) user-1: What is it with this influx of people bitching about how the internet works anyway?
(18:18:43) Me: Rosette: So there is quite a lot of people here breaking the rules?
(18:19:03) ObviouslyFA-user-2: A lot of people have a problem with someone using their character as their own, or using said character as a ref for their character. I know I would not be happy with someone roleplaying as one of my characters.
(18:19:57) user-1: As I said... bitching about how the internet works *nods*
(18:20:05) (Moderator): For example, this picture is in my user gallery. As I made that sprite myself, it is in adherence with the rules. The picture under this character profile is NOT my art, but as it does not have to be my art to be used I am allowed to use it.
(18:20:08) user-1: Anyways, I have to head off to class, buh byes.
(18:21:21) ObviouslyFA-user-2: also, the artist of the artworks will 99% of the time put a disclaimer in the description of their artwork to NOT repost anywhere else.
(18:21:53) ObviouslyFA-user-2: but then again, this is the internet, and no one respects what isn't theirs
(18:22:28) (Moderator): I will note that character is merely a "sister" character to someone elses, and thus I am only using the same art they have used to represent their character, a white bat. I am more or less using it to represent my black bat sister to her, since that image acts as an excellent reference for both characters. It is not actual art of the characters, just a picture that best shows not only what we want them to look like but the relationship they share as well.
(18:23:52) Me: So, as long as it looks actually the way you'd like her to look, you can post it and barely claim this art or char as your own?
(18:24:12) Me: I need to understand this, sorry, it's a bit confused.
(18:24:18) (Moderator): It depends on if you consider a character merely the sum of their image.
(18:27:21) (Moderator): My character here, Rosette; is not merely just the picture I drew of her. She has a personality as well that I play, alongside a backstory, relationships, and other development built up over years of playing her. Someone may use my picture of Rose for their own robin character, but they may play this robin character with an entirely different personality, way of speech and mannerism, preferences and so on compared to how I do. In that sense, their character is different from mine, even if we share the same image; because when it comes to a roleplay character the art doesn't really matter. It only exists as a way of going "This is how the character looks.", not summarizing everything about them. You can still play a character and develop them even without a picture to represent them. The picture just makes it easier to focus on personality and mental development without having to waste time writing out a physical description.
(18:28:41) (Admin): yeah there's been a huge misunderstanding here. someone screamed art theft at the top of their lungs and all these people who have no idea what a character profile come in afraid people are claiming shit as their own. not so.
(18:28:50) Me: Ohhhh ok. So stealing is for lazy people? *winks*
(18:29:25) (Admin): but anyway if you want your art removed we honour that just ask the user that's offending to take it down first
(18:29:25) (Moderator): ...It's not stealing. Nobody has claimed anyone elses characters here.
(18:30:29) (Admin): well it's not stealing because the original is still there and the creator isn't being deprived of money :p
(18:31:05) ObviouslyFA-user-2: well I've spent $500+ on art for one of my characters. Someone using artwork of one of my characters is insulting in this respect. They are posting the artwork WITHOUT PERMISSION from the character owner and the original artist.
(18:31:36) (Admin): if you don't like it, like i said, we honour takedown requests. i'm afraid that's the kind of thing you invited when you posted it for free, online, in a publicly accessible place
(18:31:46) (Admin): most of these people didn't even get the art from your galleries
(18:31:55) (Admin): they got it from someone else who re-posted it on e621 or fchan
(18:32:27) (Admin): so if you want to waste the energy going around the internet on a crusade to keep the image boards free of your stuff then go to town but i would rather watermark things before putting them online, it seems only rational
(18:33:12) ObviouslyFA-user-1: I have contacted both the person who posted my commissioned artwork and added to the Stolen Artwork Thread with links and such
(18:33:40) (Admin): perfect then you have nothing to worry about. tomorrow the mods are going to do a clean sweep of that thread and anyone who hasn't complied will have the art removed for them
(18:33:58) Me: Actually the thing is different between showing a pic online (being a character or anything) and using it as a reference.
(18:34:45) ObviouslyFA-user-1: Thank You
(18:34:48) user-2: Are we still on about this?
(18:34:51) (Admin): no problem
(18:35:05) (Moderator): It's only referencing. It's like... take a movie or a realistic video game for example. You know how Pierce Brosnan played Bond in a movie? Or how Bruce Willis, Sylvester Stalone, Arnold Schwarzenegger, Jason Statham and so on are in a ton of action movies? They are all sort of like RL examples of what is going on here. A bunch of characters in action movies all based on a single persons design. The astronaut from Armageddon and John McClane are two different people that act entirely different, same as Korben Dallas from The Fifth Element... yet they are all based on Bruce Willis.
(18:35:22) user-3: gives Kiru a bag so he does not hyperventilate.
(18:36:04) (Moderator): That's sort of what people using other peoples character art are doing here. Taking a character someone else made and making them sort of like the movie star of their own little movie where they play someone they aren't.
(18:36:28) (Moderator): Non-canonically.
(18:36:43) user-2: I go to put oil in my car and get food and we're still on about the bloody art theft e.e Go to the forums people!
(18:37:38) (Admin): settle down kiru it's not like there's much going on this early :p
(18:38:12) user-3: I feel like the fat guy who survived the plane crash... MEAT!
(18:38:16) user-2: It's been goin' on since this mornin'. It's gettin' old ya'know
(18:38:22) ObviouslyFA-user-1: I really wouln't mind it so much if Me or the original artist were referenced like is the case on e621.
(18:38:44) (Moderator): But yeah, if you are angry they are posting the image without permission, best bet is to state on the picture that the image should not be reposted anywhere except FA or whatever imageboards like e621 you are fine with without your permission. If you haven't watermarked the image, or placed a clause somewhere saying it shouldn't be reposted then that's your fault sort of.
(18:39:18) (Moderator): But yeah, watermark. Put your name or character name somewhere. Corner, bottom, top... or if you're really paranoid right across the front of the bloody image. x7
(18:39:45) (Admin): the problem is people take this whole furry thing way too seriously :p
(18:39:59) user-2: Exactly.
(18:40:03) (Admin): it's all "fuck the music industry!" and "yay fchan!" until it's your lousy sketch :p
(18:40:22) (Admin): then it's "where do i file a DMCA :<"
(18:40:36) (Moderator): I'm glad I can draw my own art. Instead of throwing a bundle at some other artist to draw what they think my character should look like with "artistic liberties."
(18:40:38) user-3: gives Karma a fresh snickerdoodle.
(18:40:50) user-2: Even if it was art done for me, I'd just politely ask the person using it to stop. I would bugger up everything everywhere and go all nazi germany on it.
(18:41:10) user-2: Then again, I don't pay for my art X3 so meh.

FA+

I don't even want to waste My time doing this...

There is a difference between theft and shoplifting the same way there is a difference between Hamburgers and Cheeseburgers. One has a little specific detail. -_- Wow. This hurts to read.
"take a movie or a realistic video game for example. You know how Pierce Brosnan played Bond in a movie?"
Irrelevance... This isn't actors being cast for a character, which by the way, they ALWAYS need to have permission to do by whoever owns the character.
The stupid watermark suggestions really aren't helping either.
http://wiki.yiffy.tk/Submission_Rules
"All submissions to your furry art gallery, Fiction Archive, audio and video galleries must have been created or commissioned by you."
Does this cover it? Or are the submissions to the furry art gallery different?
"You are obligated to respect international copyright law."
When you have something submitted on FA, I noticed it does this.."This submission is copyright © 2013 Lits" Wouldn't that be within copyright law?
