In Regard to IMVU & User Content

"Fur Affinity is governed by the site's terms of use, not Google's, Apple's or IMVU's."
- IMVU VP (and my boss)
I'm not entirely sure where people are getting all the quotes from the sales (we never made it public), but IMVU is *NOT* taking FA content, redistributing it, reposting it, using it in-game, etc. It's your content. Only FA has the right to show it if you upload it to the site.
Nobody else.

And if something like that DOES change I hope they inform people BEFORE they change the ToS instead of after.

Cmon man.
You have to blur the logos first.
I know what you this this clause was written for, you've stated it twice, and how YOU interpret this clause. It would do us a lot of good to just hear you say, this is outright NOT what is written.
Just reply with "This clause does not exist." and everyone will stop panicking.
Obviously it would be unethical and I don't expect IMVU to ever do it, but the fact that they can Is a bit worrying.
So you mean that they can't come here, and save the direct .jpg / .png files of our art, but they can screenshot our page with our art in it and that's totally okay ?
So which is it? Did they buy FA or not? If they did they thus are in all legal aspects FA unless specifically laid out that they have no ability to do anything with FA.
it doesnt matter what they say about FA remaining FA is they 100% own FA. if you did a full sale to them.
just saying it would have been nice to know about this before it was finalized or given a grace period to pull stuff down if we did not agree with the new owners policies.
I know numerous artists who want to keep their art to this site and this site alone, sometimes for personal reasons like needing to keep it out of their regular life for the sake of their job position and such, sometimes for other reasons. You do realize just how much this could screw people like that if their content got casually screenshotted and brought to another site, right?
FA's very own rules are very clear about the subject matter of screenshotted content. Could we please have a similar level of clarification on this matter, Dragoneer? It's a pretty important one.
That's why people were freaking the fuck out.
DID YOU SERIOUSLY JUST EDIT YOUR ORIGINAL FUCKING COMMENT TO HIDE THAT YOU JUST SAID PAGE 9???????
*edit* like this one
http://www.furaffinity.net/journal/6588324/
now, are you saying that the -journal- said the whole page 9 deal?
Do a simple page search and you will see people originally replying and quoting Dragoneer's comment about Page 9 in the IMVU agreement which stated redistribution rights.
The comment is now gone and Neer is backpedaling like a MoFo. 2+2=4.
I wouldn't make it if it wasn't legal, as I myself have had dealing with copyright in the past and know what a nightmare it can be to get someone to take down work they've stolen.
PLUS, why'd you change the topic? This isn't about me.
You blocked the account just as I caught you out chaning topics like that
LMFAO, you tool XD
So I guess we're done here! Good day. :)
:3
Different things. :)
Having a second account isn't against the ToS.
http://gyazo.com/908e9ac93bcd4243d05d577355b5b652
http://www.furaffinity.net/journal/6588324/
so that page 9 quote is from -nothing-, though I wouldn't know if there's a similar quote somewhere in terms of use anywhere else.
hth
Theres the source.
W/E - I didn't take a screenshot of that ONE thing and now I'm left bashing my head on a table.
c'est la vie
4. Data Use, User Created Content, and Privacy
And I mean I guess you can argue the point of "well why are they on FA in the first place ?? " but if they decide to take down their gallery and disable their account, IMVU still has the right to use said screenshots and has said screenshots.
Idk man.
All I really know is that if you are an artist, and you don't want your content being used or shared on other sites except for the one you uploaded it to {Like me, hi hello !} and it's going to be broadcast on another website, (in my Terms Of Service I have even stated that I require you to obtain permission from myself before uploading any of my work onto another website) that's pretty no bueno.

http://help.furaffinity.net/article.....rvice-TOS.html
4.1 - When you upload content to Fur Affinity via our services, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, transferable right and license to use, host, store, cache, reproduce, publish, display (publicly or otherwise), perform (publicly or otherwise), distribute, transmit, modify, adapt, and create derivative works of, that content. These permissions are purely for the limited purposes of allowing us to provide our services in accordance with their functionality (hosting and display), improve them, and develop new services. These permissions do not transfer the rights of your content or allow us to create any deviations of that content outside the aforementioned purposes.
The only part that concerns me is the bit I have bolded. The TOS doesn't really seem to limit the scope of what a new service can be.
"I have an answer to that question, but I can't tell you."
Has 9 letters
It is the third month of the year
9 divided by three is 3
Triangles have three sides
Illuminarty is a triangle
Dragoneer is illuminarty confirmed
DRAGONEER IS A REPTILLIAN! CALL DAVID ICKE!!!11!!!!
YOU GET RED ORANGE
or...
A NERD OGRE!
And I'm not worried about IMVU changing anything, I'm worried about the mass amount of trolls that might flood in with that community.
It only has the permission to supply them with real moniez, and DO THEIR JOB!!!
So stop whining, and worry about IMVUfags and trolls pissing on the site.
Let's just hope that they don't get bought by Ubisoft or 4chan, or even... BLOGTALKRADIO!!!
I knew there was a connection!
you may ascend now to Valhalla
People need to get off the " WELL THIS IS BAD BECAUSE ______________________________" and just enjoy the site. For fuck sake.
It's not the end of the world, just another opening for FA to widen their horizon. I think it's awesome!
Like-- who cares if IMVU MAYBE --- POSSIBLY-- ( why would they really but yaknow-- gotta start something) Screenshot the front page and your art is there. WOW EVERYONE SEES IT ANYWAYS.
If you didn't want it to be public, should have never posted it.
As long as they aren't claiming it as their own art that they drew or their own character I don't see what the issue is. The fact people are going this far in to the TOS is-- I can't even..
It's stupid.
I don't get why every time Dragoneer does something everyone has to be against it. If you hate it so much? Leave.
I want to leave but then I'm not sure.
Oh I just hope better things will come for FA.
Regardless of reason though, a person should certainly have the right to choose if their content is posted on a site other than the ones they wish to post upon. I think IMVU taking and using screenshots of FA is perfectly fine if permission is beforehand asked of and granted by any artists whose work is present in those screenshots.
So far there is no clarification to if such a system exists, or if IMVU does not have to ask permission. More information is kind of important to have at this point.
There is already a considerable market to play up here on FAVU, I feel the challenge is getting interest from the other end of the partnership
we will introduce FAVU shekels as a currency form, we can... oh my god
OH MY GOD
WAIT FOR IT
WAIT, WE CAN MINE BACK MEATS. WE WILL MAKE THE BACKMEATS FAVUSHEKELS A CRYPTOCURRENCY FOR PEOPLE PLAYING IMVU TO MINE AS THEY GRIND AWAY
This is is, this is the pay to win structure we need
this is an opportunity to push backmeats and other products onto the tween demographic. Tweens are going to school, so they should be learning about plate tectonics, it shouldnt be too difficult getting them to conflact the shifting of continents, the plates if you will, with the plates of scales on backs.
yes. this makes sense, ill draft a report pronto
hm
*furrows brow*
you know...
maybe we shouldnt do that, yea, kids hate the geologies... hm, shoot
hmmmm
what if we... what if we introduced... gators as a playable species in the platform
or maybe, what if we just, gave existing characters in the game backmeats, and make it a rare acquirable item... the tweens would strive to acquire it because of it's rarity and inherent status symbol.
the tweens would shit their britches and teh squee, as it were
ultimately yes, YES INDEED it will come back with great brand recognition, because soon the tweens will want backmeats in the real world, in which case we can negotiate product tie-in's with hot topic! Backmeat tees! Backmeat POP! figurines! BAckmeat chunky wide silicon wristbands!
And after doing some research, I beleive we should not stop at tweens but also extend our reach to an older, more party-oriented crowd, so we can uphold an image of backmeats being analogous with a fun and edgy lifestyle. I think flashing LED backmeat snapbacks and shot glasses are in order, maybe we can partner with Spencer's gifts? Secretary, write some e-mails, stat.
THE LIGHT UP SNAPBACKS
PERFECT
WE CAN HAVE G8R RIDGES FLOW OVER THE TOP OF IT FROM THE BRIM
THATS WHAT WE NEED. Snapbacks and backmeat jordans
i think we can get spencer's on board, no problem!
yes, ill pitter pat my lil raptor hoovies and GET TO WORK IMMEDIATELY ON THIS CORRESPONDENCE
Quarterly profits have been increasing, which is great news for our brands. Now let's continue fostering the growth by taking advantage of this marketing opportunity. WE MUST NOT REST UNTIL BACKMEATS BECOMES A HOUSEHOLD NAME
EXCELLENT EVEN! we have a solid financial backing for this capital venture. I'm thrilled to know that the backmeats operation has been buttressed by success in other sectors, like the Summer of Haunches and SEASONAL BUCKMEATS
Haven't seen you around in forever, hope you're well
http://www.furaffinity.net/journal/...../#cid:44895062
On the other hand there ARE websites where you give up the rights to your work when you post it there. facebook has done it, people say deviantart has done it (i don't use it really so i have no idea if it is true), and it IS a concern when there's a merger. The fact that there was that shady quote that says that IMVU can redistribute your work is a red flag for anyone who doesn't want to lose the rights.
This kind of stuff needs to be up front, man. I have faith that it's all good, but people need that crammed down their throat :\

You can find the same exact thing on every other site accepting user-generated content. Note that this too says it's only for the purposes of providing you this service.
Mountain, molehill, blah blah blah.
*Sigh* and this right after your fundraiser. Well, I really hope everyone gets their money back... probably won't anyways since it was a scam from the start.
Good times, good times. I feel sorry for all involved in donating their money.
Tho is IMVU allowed to change FA's terms of service?
https://www.dropbox.com/s/bt8ugw5a1.....large.png?dl=0
'cuz freedom.
Only thing that has people worried right now is how that doesn't mention plans of potential changes once the operation is fully in their hands. The 'what if' factor is not being calmed down.
"What does God need with a Starship?"
Just replace God with IMVU and Starship with Fur Affinity.
-shrug-
and no one bats an eye
FurAffini gets sold
and everybody looses their minds.
I'll start giving away kitkats, some people here really need a break.
The instant you take anything of mine and use it "for ad purposes" without my explicit consent I am gone forever. If you intend to do that you need to tell me right the hell now.
If IMVU asks the artists whose art they've captured in screenshots for their permission of use, and receives that permission, then fine. If not, then indeed, that's a lack of consent and a BIG problem.
I hope we get more clarification on this important subject soon.
IMVU's in this for money and there's no way they're turning a profit off of just what we've heard about. They have their own plans.

A lot of the concerns by FA users are about privacy. IMVU does not allow adult themes, explicitly banning products made that would show such things. Would that apply to FA as well? Most of the art on that site cater to adult themes.
Will you be implementing a subscription or paying service on FA?
How much input do you have on FA, though you say FA will still be independent. What then does IMVU have to gain by obtaining FA?
I, personally, am happy that two companies that I love have merged, but I do have a few concerns. It'd be nice to have more information and clarification on this. Thank you.:
Response from IMVU:
IMVU's content policies (Virtual Goods Rating Policy or VGP) only applies to products submitted to our Shop. Content shared on FurAffinity.net site is not regulated by that policy.
As mentioned in our announcement, the only input we have in FA is ensuring the site administrator has appropriate resources to make improvements to the site that he has been wanting to make (servers and such).
We are not implementing any subscription services for FA or generally making any changes to the way that community operates.
As to what we gain is what we included in our announcement - bringing together communities that share common interests and advertising on the FA site.
Thanks!

Paranoia for ya....
Ads. Products. Customers. Subscriptions? I have a feeling that at the get go they're wanting to draw the furry community into their chat program, and YMMV on that one. I don't intend to use their services as I have no interest and it seems cheap anyway. I honestly don't see the community connection either, but maybe I'm out of touch.
For the record, I hate buy-outs.
Seriously though, it's just like "god dammit, here we go again..."
Of course, the poor wording is as much at issue.
Transparency is your friend. But then this isn't the first problem with a sudden change, and won't be the last.
There are quite a few attorneys on FA that would have helped with that too.
Please shut up and grow up and quit your whining.
Really? You aren't sure? Then you have misread you entire userbase and are sadly misqualified to helm this community you've been hired to lead (no shock).
The reason the entire community is freaking out about the terms of sale (real or imagined) is because neither you nor IMVU are giving any actual visibility what the terms are. Without facts, imagination/speculation will run wild.
It's that simple. If you actually disclosed the parameters of the deal you might have some sort of acceptance.
http://www.furaffinity.net/view/6471369
Let me rephrase that. We are well aware IMVU owns FA.
This can be a massive panic attack i ever seen here.
Hope you know what you already did pal.
I really hope.
Then please explain wtf this is?

Of course that's just one of the 1,110 pages. Imagine the rest. Smh.
THEY ARE MAKING MONEY OUT OF YOU.
IMVU GAINS A PROFIT EACH TIME SOMEBODY MAKES ONE OF THESE "POSTERS" SO DOES THE USER.
Edit// added " and another link.
We'll be working with people to help inform them of how to file DMCAs and request removals of their art. But what you're linking to here is NOT an IMVU problem, but an Internet problem.

Users are posting them and selling them, and that's something that is an issue and people SHOULD contact IMVU to request removal. But that also happens on eBay, Amazon, Red Bubble, Cafe Press, and even furry sites like e621. People (not the company) steal other's content and repost it, and I agree that companies need to be pro-active to look for it, but so do the content creators as well.
We'll be working with people to help inform them of how to file DMCAs and request removals of their art.
I am bringing it to the attention of IMVU further to see if we can do anything about it, but IMVU -- as a company -- is not taking user's work. People are reposting it.
Props Dragoneer for making and enduring said fallout, please know that some people do appreciate the work you have done to create a free community for artists, musicians, photographers, and all the other furries. I for one will look forward to what comes next.
So what the fuck is this?
http://www.imvu.com/shop/web_search....._rating=-1&
There will always be brats who don't know how to credit the artist, and there will be brats who will pretend to be the original artist when they upload the pieces to other apps.
All you can do is report the inappropriate pieces to staff of IMVU, using takedown requests and the like.
But Then I am hearing other bad shit about IMVU and FA was already bad so I mean...?
But apparently there was a joke that triggered people on here and the person who said it apologized for it.
Glad to hear it from the horse's or in this case the Dragon's mouth of what is really going on with FA.
