They OWN FA. You do not own FA. Per FAs own TOS they can use content , even directly for the purposes laid out on the TOS for FA. Unless your sales contract with them specifically states that they have no control or ownership of any type of FA and it operates as a whole independent entity from the IMVU corporation.

So which is it? Did they buy FA or not? If they did they thus are in all legal aspects FA unless specifically laid out that they have no ability to do anything with FA.

Nigh-every content-based website has this exact same clause. Pretty much for legal reasons. Tumblr, Facebook, Google+, DeviantArt, etc.; all have this clause to stop someone taking them to court in the event their icon (or other owned material) appears in a thing they publish, such as a screenshot, banner, or whatever.

That doesn't negate the fact that in one post he says they can distribute people's art (or a screencap of it, what the fuck ever) and then turns around to say "No, they can't do that." The only part that concerns me is the bit I have bolded. The TOS doesn't really seem to limit the scope of what a new service can be.

That's a very common clause and it allows a service to do things like copying content across to a test server.

AI guess the problem is that it makes sense- they won't have to ask everyone every time they change stuff on the server. but at the same time it's powerful and we just have to hope they don't abuse it. the clause in it's self isn't bad, if taken from a well-intended manner.

By this point it is well understood boilerplate. Similar to how, back in the days of dialup, something saying "unlimited connection time" was understood to refer only to the total time per period and not that you could maintain a single session for an unlimited time.

Not true really, a deal was made in January, but typically in business transactions they can take months to finalize. Also, when Yahoo! bought Tumblr people overreacted too, and nothing changed... at first. Now there's ads and suggested this and that ads everywhere, but thankfully nowhere near as bad as was feared. I'm sure that the IMVU influence will be felt, and that to say, "then they'd have happened already" is naive, but I'm just hoping it's nowhere near as bad as people are freaking out about.

The thing is, IMVU isn't the kind of site to put something like that up for free. And the artist(s) in question get nothing out of whatever revenues might come from those ads

There are some instances where people - for sometimes better or worse reasons - want to control where their art goes. They may just want to keep it here on FA, or a set of specific sites...and honestly, sometimes it can be for very good reasons, like a professional animator doing some NSFW content on a furry site but NOT wanting it spread around past there, because if his style is recognized his job could be put at risk.

Regardless of reason though, a person should certainly have the right to choose if their content is posted on a site other than the ones they wish to post upon. I think IMVU taking and using screenshots of FA is perfectly fine if permission is beforehand asked of and granted by any artists whose work is present in those screenshots.

So far there is no clarification to if such a system exists, or if IMVU does not have to ask permission. More information is kind of important to have at this point.

to be fair it's a legitimate concern, this information wasn't really that clear, and for a lot of people the risk of having a company/site have ownership of their content is very serious.

Well yeah, that is true :P people are going to repost art on forums, facebook, imgur, wherever they want. However that doesn't automatically mean that by posting something online you lose the actual rights to it.
On the other hand there ARE websites where you give up the rights to your work when you post it there. facebook has done it, people say deviantart has done it (i don't use it really so i have no idea if it is true), and it IS a concern when there's a merger. How can we be for certain your word is good, and that IMVU does not ultimately have malicious intent for the site? What is there to say that IMVU can't underwrite FA policies since they now have been granted ownership? You really should make the signed contract available for this that validates/disposes all of these claims and speculations in legal writing. If IMVU asks the artists whose art they've captured in screenshots for their permission of use, and receives that permission, then fine. If not, then indeed, that's a lack of consent and a BIG problem.

IMVU's content policies (Virtual Goods Rating Policy or VGP) only applies to products submitted to our Shop. Content shared on FurAffinity.net site is not regulated by that policy.

As mentioned in our announcement, the only input we have in FA is ensuring the site administrator has appropriate resources to make improvements to the site that he has been wanting to make (servers and such).

We are not implementing any subscription services for FA or generally making any changes to the way that community operates.

As to what we gain is what we included in our announcement - bringing together communities that share common interests and advertising on the FA site.

So... I've been a part of a company that got bought out before. Big companies that buy smaller companies generally expect to make some sort of money off the smaller companies they buy. Whatever form that takes...

Ads. Products. Customers. Subscriptions? I have a feeling that at the get go they're wanting to draw the furry community into their chat program, and YMMV on that one. I don't intend to use their services as I have no interest and it seems cheap anyway. I honestly don't see the community connection either, but maybe I'm out of touch.

The real problem is that Dragoneer has been promising for months that he'll be more open and transparent to the community just after claiming that his hacker friend is no longer an admin on FA. He keeps promising and promising and then does a complete 180.

The reason the entire community is freaking out about the terms of sale (real or imagined) is because neither you nor IMVU are giving any actual visibility what the terms are. Without facts, imagination/speculation will run wild.

It's that simple. If you actually disclosed the parameters of the deal you might have some sort of acceptance.

As long as IMVU does not requirement to INSTALL any CLIENTS or plugins to view this site and I can freely block their AD's I will still use this site. I remember removing a spyware a few years back involving IMVU....

I am bringing it to the attention of IMVU further to see if we can do anything about it, but IMVU -- as a company -- is not taking user's work. People are reposting it.

I'm still disappointed with FA's decision

I dont think people realize that its end users posting said ripped off artwork and not the fault of IMVU. If say the people complaining reported usage violations instead of just getting butthurt then maybe there wouldn't be a problem. As this has now established a dialogue the decision to sell may have even drawn attention to an previously underlying problem that can now be addressed and art piracy cracked down upon.

Props Dragoneer for making and enduring said fallout, please know that some people do appreciate the work you have done to create a free community for artists, musicians, photographers, and all the other furries. I for one will look forward to what comes next.
