Car Accidents suck =(

@>-->--@>-->--@>-->--Kira's Thoughts!<--<--@<--<--@<--<--@ So I'm sure you guys have been wondering where I've gone! No, I havent died. Like usual, I just have the worst luck ever.
I worked Polycon alone almost over a month ago, for my friend and I's business CheesyShenanigans. That actually went super well. We made a decent amount of money and everyone seemed to enjoy our product. Add that to the fact that Emerald and I were making decent headway on the wedding plans and life seemed to be going smoothly. I guess I should have known better? lol.
A week or so after Polycon, I had a 'day off' where I had someone watching my dad so I could get out of the house. I finished my errand running and when our DnD's groups DM asked who was free for boardgames over the group text I decided to head over. I was halfway there when some college kid Tboned my car.
I had come to a four way stop, following a road that passed through a little residential area of Lakeland. I stopped, looked both ways. No one was at the other stop signs or even close to them, so I proceeded through.... and bam. The other kid, Chris, had apparently been looking at his phone instead of watching the road and was going way too fast for the residential area we were in. No, I'm not making that up, those were his own words. He blew through his stop sign and slammed into my side of the car. Thankfully it was the backseat area. A little further up towards my door and things might have been much worse.
I'm ok, I just banged my head pretty good and got a little bruised up. Had a black eye that somehow managed to look like one of those fancy smoky-eye makeup tutorials. lol. But my poor car, Stephano, is a goner. The last few weeks have been a hassle of bickering over shit between mine and Chris's insurance companies. Allstate, his company, declared my car a total loss and offered me.... well, next to nothing. Not even close to what the Bluebook value was, or even enough to finish paying it off.
So, I've been trying to find a way out of this hell, in which someone else ran a stop sign and hit me, leaving me with no car and debt on a car I no longer have. Add that to the drama of the shady ridiculousness going on with the repair shop and tow yard I was dealing with (Btw, Lakeland furs, do not use Auto City Towing or Bernies auto Shop. They are in cahoots or something. They lost my car somehow, -twice-, when it was sitting right outside their office, in the same place). Needless to say I havent been spending alot of time on art or even online.
As of today, though, things seem to be looking up. My own insurance company offered me a better deal on Stephano, so I can at least pay him off with very little out of pocket. Its a mark against my own insurance record, because Florida is a No-fault state, but its still better than fucking Allstate. And Emerald had a friend from work who was selling a car, and dropped quite a bit off the asking price for us. It cut into the wedding fund a good bit, but we are hopeful that we'll have time to earn it back. Named the new car Toriel, from Undertale, because its white.
So, fingers crossed guys!
Hopefully things will get back into a good place and I'll be on here more frequently. Now, to go get some art done!

Next time, get a damned lawyer hun. This fucker is at fault 100%. Did he stay at the accident? Did you call the cops because he ran the stop sign? It's too far past the date of going to see a physician I imagine, but still, find a lawyer if you can. HIS insurance company should have covered everything.
Even if it's settled, get a copy of the policy report, the estimates, EVERYTHING and consult someone who specializes in accidents. At least get their opinion, because it sounds like you were doing everything right, and HE did everything wrong. ESPECIALLY in regards to the fucking tow company/repair shop. I don't smell a rat. I smell a decomposing pile of shit.
I'm only going off what you said, but this wasn't a case like mine where someone in front of the vehicle I hit was doing something wrong, with sopping wet roads that sent me into them despite ample stopping distance. This is a case of you doing the correct thing, and the idiot who hit you clearly NOT.
His insurance, Allstate, did cover a rental for me... for a few days at least. And from what I understood my insurance is going after them for the medical bills. In either case I dont have to worry about paying those. The real problem came when Allstate declared Stephano a total loss and offered me a pissant amount for him. I did speak to a lawyer then, one specialized with accidents, and apparently there was nothing I could do. Florida law doesnt require an insurance company to pay you what you -owe- on a car. Just what they think its worth. And allstate doesnt look at Bluebook prices, they look at what cars in my area similar to mine have sold for, via shit like Craigslist and personal ads and shit. Its bull. But apparently legal bull. The lawyer recommended getting a second opinion with my insurance and going with the higher offer, so I did, and my insurance came through.
The repair/tow thing was total bullshit though. Apparently Auto City towing has a tow yard on Bernie's Auto Repairs property. Allstate had my car at Bernies to see if it was a total loss. It should have stayed at Bernies while my insurance was in the process of checking it out, but it got put back in the tow yard. They called to ask about my car when state farm contacted them, acting like they'd never seen the damned thing before. I had a fit, went down there, boom. theres my car, right in sight of the fucking office. I went ahead and cleaned stephano out, since I knew with a broken rear axle and all the other damage he was still gonna be a total loss, and gave the key back to Bernies. Didnt hear from anyone for a few days, and got a letter from auto City towing saying if nothing was done with my car in a few days they'd put a lean on it and auction it off, so I called my insurance to see if they have an estimate yet and check what was up with that. The lady I talked to, Mina I think, said she hadnt received an estimate yet and called Bernies while I was on the line listening to check in.
The manager of Bernies acted, once again, like they'd never seen my fucking car before. Said he saw they had an order to check it out, but that they didnt have the car. Even though I'd been there days ago and seen it with my own eyes and gave them the key. He acted really shifty about the whole thing. Finally he admitted it might be on auto City's lot, but couldnt say why it had been moved, or answer why they hadnt gone and gotten it when they received the work order like they should have. So we called Auto city, and you know how when you call a company like an insurance agency they'll open with "Hey, this is Mina from blah-blah, I'd like to inform you that for our sake and yours this call may be monitored and recorded."? The owner flat out responded with "No, I wont speak if I'm being recorded." WHAT KIND OF FUCKERY IS THAT? You own a business, you shady motherfucker. Unless you are doing something wrong, its in your best interest for shit like this to be recorded so I cant sue you. We had to call him back on an 'unmonitered' line to speak with him. He tried to hemhaw around too, but at this point Mina was having none of it, and finally I guess the little weasel got tired of the heat and 'found' my car. Right where it had always been.
Mina got it straightened out for me, and admitted they were probably trying to scam me over fees and shit from my car taking up space in the lot. She said sometimes repair shops and towyards will work together like this, and she would be putting a mark on their record with the insurance company. they were gonna loose alot of business from them because of this bullshit. I'll never use either of them again, thats for sure.
You covered your bases. Good. Good. Then I've no need to worry.
In case of my accident, we got photos of both license plates (I still have theirs, two years down the line) and went home to report.
I wouldn't have minded if they had contacted authorities. In my mind, under the realm of the law, I was at fault, irregardless. And I wouldn't try to deny that in the least. But it helped them since they decided that having just a state farm zipper bag would be enough to count for insurance. So while I had mine all set up, they didn't. I imagine cops would not approve of being without proof of insurance.
Thankfully, they did, because they contacted me. And then spun a tale about how they were severely injured.
Painkillers are meant for pain kiddies. Not pleasure.
i'm glad you're okay though!!
but yikes especially while you're trying to save for a wedding? i'm so miserable when anything cuts into my wedding money i can't imagine having to get a new car ;-;
And yeah, it sucks. But we'll pull through. Worst case, we will go to the courthouse and skip the wedding. I really dont want to, but if it comes to that it comes to that. We can always have a ceremony later.
