Not to mention our legal system isn't really built for fairness but rather who can prove their side more. Shady tactics by prosecutors lead to convictions of innocent people with alarming frequency while shady tactics from a defense lawyer can get people off on a technicality. The letter of the law, the spirit of the law and how they both play in a court of law vary too much.

Uh, dude? Something like 90+% of all cases never go to court, and of the ones that do, I'd say the vast majority of them are cases where one of the claimants is an idiot who would have been better off just taking a plea or cutting a deal. I've told this to lawyers and they haven't disputed me on it: If a case is in court, then either someone's a moron, or something has gone terribly wrong.

Doesn't dismiss the fact our court system is based on a game that involves legal trickery and loopholes in the law to get a conviction or get their blatantly guilty client off. Plus the fact also remains that the law is not equally applied. Get yourself a high profile lawyer and chances are you will get off entirely or easy with a crime vs someone with a public defender will mostly likely wind up with a harsher sentence. $$$ talks in our court system and that is a very serious problem. But also given the fact we have crimes that include severe mandatory minimum sentences an innocent person is most likely to take a plea deal than to risk the gamble of going to court most especially if they cannot afford an attorney.

I mean seriously the dude who gets caught with some weed on his person (at least in states where possession is still illegal) is going to see more jail time than the bankers who've robbed people of billions. Or how about Ethan Couch who was able to kill 4 people drunk driving and got off with probation and tax-payer funded rehab at a facility that was rather luxurious while the same judge sentenced a non-rich black kid guilty of DUI to a rather lengthy term.

Thus my initial argument. It really doesn't matter 90% of cases do not go to court because there's a fundamental problem right there in the foundation of our judicial system. If there weren't we wouldn't have this nonsense of legal trickery that gets guilty people off or bullshit that deters innocent people from fighting the charges against them because of crazy mandatory minimums.

I don't know about OP, but a couple starting points could be the abolition of three strikes and minimum sentencing laws as well as greatly increased funding for public legal defense. The former measure is getting some traction in the government.

Agreed on both points, and I would add that judges be measured against one another in sentencing, and overly lenient and overly harsh outliers be censured until they're more in-line with one another.

Yup. Judges sentencing way too lightly is what caused the three strikes to be passed, and too-harsh sentences can tend to turn minor offenders into repeat, worse criminals after 5-10 in prison.

it is better than nothing, things could be much worse, maybe try living in north Korea, they incarcerate your entire family. if you have a problem, try to find a fix for it.

and sadly its still the best justice system there is... the reality is it sucks.

When you combine Federal and state statute law, as well as the Constitution and the whole body of precedents and findings, it's just way too much for a normal person to comprehend. Which is sad, in many ways.

He is, quite literally, the only hero I have. Strong, stoic, yet kind and protective of those he cares about.

Oh it does, you're just A: not looking in the right places, and B: not paying a buttload of money. There's actually two competing comprehensive digital legal libraries, LexisNexis and Westlaw. They're hella expensive to get subscriptions for though.

They've even info on those ancient obscure laws from way back? And how much is a butt load because if need be, I might consider paying for said information

I don't know directly, but from what I've heard, a full Lexis Nexis plan can run upwards of $10,000 a year. Fortunately, they've got a lot of less expensive 'limited' plans, for laws just regarding a certain jurisdiction, or for a limited (and metered) amount of time, or both. I'm honestly not sure... I'm getting my access through my school on a 'student' account that was covered under tuition, and stupid cheap on top of that.

Oh, and yeah, I've seen some OLD stuff on there. If you really want to be doublesure, there's a feature (I can't recall the name off the top of my head) that automatically correlates any and all cases that affected a certain bit of law, forwards and backwards, so you can see if there's anything new or old that would affect it.
