Terms of Service update?! AND YO FOLKS~!

YO YO! How's everyone doing?
I hope you're all enjoying the GIGANTO FLOOD. I've got tons of color work to upload too, so I hope y'all aren't color blind now :> STILL ABOUT 200 THINGS LEFT TO HAVE POSTED HAHAHH So the shenanigans will continue. Sorry I haven't been replying too much these days, sometimes I hardly even notice when things are getting posted xD! The team is working well and working hard :> A million thanks to them! But do know, I DO read all the comments and I appreciate the hell out of all of you guys <3!
Now. Regarding the ToS thing. I don't actually have a new TOS typed up (still kinda working on how I wanna flavor it) - but I do need to make an important announcement. Don't be fooled, I'm not open for commissions or anything still, just figured I should say this.
From here on out, I need to state somewhere that ALL work done by me is only my own when it comes to selling rights. Meaning, despite you commissioning it, I have the ability to sell prints of it online or at a con or w/e. As always, you can post it, you will be credited, etc etc. But by working with me, you understand that this is something that I can sell prints of or put in a book or something in the future.
Based on the prices we artists charge, I feel like this should be super duper obvious - but I needed to have it written down that way I don't have to ask everyone in the future xD! When I come up with my official ToS, this will be included.
I mention all of this because I recently got accepted on InkedFur! I have some plans of making a daki, some prints, a book, and who knows what else in the future! Having some sort of merchandise options can only have more opportunities and possibilities for cool shit in the future! They will be launching their new site sometime next month, and once I have some things looking good - I will announce the opening of the shop. I'll probably also have a lil raffle promotional for funsies :>
I DO NOT plan on having prints of everything. Just the select few pieces that I think I did SUPER fucking well on, and think that they would make for some good prints! The ones that I choose, I will be contacting the individuals to make sure they are cool with me making prints 'n stuff. Likely candidates would be Rule 34, random designs that don't belong to anyone, or my bunny. But if I did super freaking well, your piece might be a candidate.
SO YEAH! That's about it. I'll be contacting peeps individually regarding this.

Does this mean i cant commission you, ever, because thatd be a shame. Or does selling rights still require consent of the individual before you do it (and would it be a breach of ToS if a customer said no)
But, and no offense to anyone, I don't really think people are gonna want prints of someone else's OC :O! SO the chances of them being a print are PUHRETTY slim. If it's the BEST DANG PIECE EVER, and it would make for an AMAZING PRINT, then you bet your ass I'll be hounding you trying to make a deal or figure something out. But again, the chances are crazy slim.
To give you an idea, of the thousand or so pictures I've made, I'll be considering MAYBE 15-20 of them to make prints of. 90% are rule34 and generic characters. So I'd say you're probably safe!
THOUGH
I do have another project I wanted to make that's more of a "The works of Carrot" sorta thing. An art book full of my bllack-and-white paintings. So would your character being included in an art book be different? I'm just curious how others might feel on this matter - and if there's a different if the point of the "product" isn't the piece itself.
That said even a slim chance id still say no, id want no chance at all; Advertisements and Banners are okay ofc, but physical objects start getting really creepy fast.
There are so many artists doing this nowadays, i have to tread quite carefully, commissioning art is already such a pain in the ass.
Books are a little different yeah, since the sole focus isnt just the one character; As long as the book isnt done in a degrading way (eg "Titled: Sluts of FA") And crediting the owner of the character somehow would be most appreciated.
If you're that concerned, probably best to stick with private commissions and not posting them though. The minute something is public, the minute it's at the mercy of anyone else.
Regarding the book, of course I'd take proper precautions to crediting, as there'd be a place for it. I can't really put that info on a print, so I don't mention it.
It just really sucks for people like me, thats all. Never being able to commission our fave artists. (not to mention in the past ive already commissioned artists and i cant exactly revoke permissions now that ive changed my mind on the matter, its permanent :( )
But, at the same time, sometimes people have a very personal connection to the character, hense why a lot of art is private to the entire world. (WHICH I THINK IS LAME) but I do understand and respect.

Yeah though, a TOS should definitely clearly state who owns the rights and such, even if you're just repeating the basics of copyright law - lots of people just don't know. As a freelance artist, the piece itself is your intellectual property, you own all the rights to the piece. You don't own any rights to the characters, but you own this depiction of them. The right for the customer to be able to post the pic to their own page is something you've specifically granted to them. The customer paid for your time and talent only.
I wouldn't assume anyone would find any part of copyright law to be obvious. It's completely understandable that people don't know.
It'll be cool seeing your stuff in shop. I know some people have concerns, but I personally love the idea of someone snuggling a personal creation.
