Commission Terms and Conditions - July 2019
6 years ago
By purchasing a commission from me, you accept these Terms and Conditions. These Terms and Conditions will be made viewable via a link alongside the most recent commission price sheet.
I reserve the right to display, share, and upload any commissioned works for the purposes of self-promotion, advertisement, and demonstration of artistic skill. I will not attempt to claim ownership of characters featured in said commissioned works. This includes streaming work on the commissioned art to Twitch, and sharing "Work In Progress" versions of commissioned art during its creation.
If however the commissioned work is for example a gift for someone else, then I can agree to withhold sharing and streaming of the work until completion and/or a certain date.
The purchaser of commissioned works has the full rights to the work to share, upload, and sell copies (prints, merchandise, etc.) or the rights to the original as they please, however they are not allowed to edit the work so as to make characters featured in said work be different characters altogether (for example making adoptables).
In cases where copies of the works are available to purchase from the purchaser of the original commission, or the work has been shared publicly (memes, etc.) except using the work for the purpose of a profile icon/avatar, the signature must remain intact and visible. However linking the artist's online galleries/social media for the purpose of giving credit while not required is very much appreciated.
Tipping is not to be done during purchase. Instead, if the purchaser wishes to tip the artist, it should be done as a separate transaction after the commissioned work is completed and finalized and the tip should be marked as a gift.
This is because paying more than the asking price places pressure on the artist to perform better than what is expected. Tipping after the work is completed is very much appreciated.
I reserve the right to delay completion of commissioned works. Producing artwork that is of high-quality is demanding and sometimes stressful when done in a commercial sense. It is not something that can be rushed.
I also reserve the right to cancel any commission purchased prior to completion at any time, for any reason. In such a case, a full refund will be sent to the purchaser, and any transfer fee will be covered at my expense (excluding changes in exchange rates).
If however the purchaser wishes to cancel a commission, they must do so before any work has started for a refund (excluding fees). After work has started, it will be up to the artist to decide on the amount to be refunded based on the progress of the work. This can range from 100% when work has not started (excluding PayPal fees) to 0% when work has been completed. Simple backgrounds are not counted as part of the commission and as such, a commissioned work is technically completed when characters and complex backgrounds (if purchased) are finished.
BY PURCHASING A COMMISSION YOU ARE AGREEING TO A SIMILAR LEVEL OF QUALITY AS THE WORKS SHOWN ON THE MOST RECENT COMMISSION INFORMATION SHEET.
I will not provide refunds for a completed commission if I don't agree that the quality is worse than what should be expected based on my skill-level and previous works. If the purchaser has commissioned me to draw something I have little experience with, then there is a reasonable probability that the final work will not be of as high quality as other works of things that I am more familiar with. By purchasing a commission for something I am unfamiliar with drawing, the purchaser agrees that the quality may not be as high as expected.
