His death was very avoidable, however it's also plausible the Police interpreted the consequences of the drugs being in his system as resisting arrest since they had no way of knowing unless he flat out told them. At this point the focus is turning into revenge not justice, and treating it as such to force the authorities to bring higher charges could very well result in the officer walking if they can't prove intent. Which will make the people mad even more mad.

I'm not in the US, but I've been watching these events closely because what happens in the US tends to filter its way through here eventually. A few things really stand out about this mess to me but first and foremost is the sickening mirth with which people are stoking up the violence.

I completely understand the anger and desire for justice for Floyd, a man who was murdered by any sensible description of events. But here is the kicker- everyone was in agreement with that. Fucking everyone from the president to the man on the street protesting, the first real chance to get some actual bi-partisan supported reform going in decades... right up to the point the rioting started. The violence was not needed. It is elementary power dynamics that when violence is introduced to any system, justice is the last thing that will come from it. Now people are dying. Innocent people who had absolutely nothing to do with any of this. Are we ever going to see justice for them, especially when people are out paying their bail and encouraging them? Do their lives matter any less? A lot of them were black too.

You cannot tell me this is about justice whilst gleefully supporting or participating in spreading injustice far and wide. Even the man's own family, the people worst hit by his death are calling for calm. A lot of this has become cynical opportunism, either for personal gain or political point scoring, and people suffer because of it. It needs to stop fast, and everyone responsible for it needs to be held to account.

I do blame the dems for this mess. They've spent decades stirring up racialised narratives whilst the communities that these injustices happen in have usually been cobalt blue for decades, and then passing the buck and crying foul of republicans when things boil over. The republicans are and always were far from blameless, but this is part of a far more systemic problem that has been brewing for decades on democrat watch, festering in their strongholds, directly overseen by democrat mayors and review boards and police chiefs... And this is somehow now Trump's fault? My understanding of state vs federal rights is limited, but I gather that the federal government is largely powerless in state affairs, to the point that even if he wanted the president can't activate the national guard to help quell the looting without approval of the state governor. If actual change is to be made in these areas then it is necessary to hold to account the people directly in charge, who have sat on their hands and let this happen because it was politically expedient to have a captive voter bloc.

And now under pressure they have raised the charges to second degree murder which means they have to prove the officer intentionally killed him, otherwise there is the possibility that he walks. Third degree would have been a much much safer bet. It's incredibly hard to prove intent and damned well impossible to prove premeditation short of unearthing a manifesto.

In Minnesota Second Degree is Intentional Homicide without premeditation. To get a conviction your going to have to convince the jury that the officer intentionally killed him. This is substantially more difficult than proving the officer is a dumb-ass and callously acting in a way that was uncalled for, wantonly disregarding the statements of "I cant breath" resulting in a man's death. If they charge the other officers on the same basis they are going to have to prove the same thing. Trying to get a higher charge often results in perpetrators walking thanks to a hung jury.

This is one of the tactics crooked prosecutors use to get a not guilty verdict without appearing to go easy on the perp. They overcharge, try hard to get the conviction, then when it nearly inevitably fails to pass the jury, the bad guy walks free. Either way it goes, they win in the political side.

I suspect that's what's going to happen in this situation and of course people are cheering it. I have no idea how their going to prove intent. Though I imagine they are going to dig though the familiarity if the two for a motive. Negligence by the the officer and the others present looks more plausible from what is known

I fear the chances of anything positive coming from this vanished the instant it became a partisan issue. For a moment there was an opportunity and everyone seemed on-board with the idea of a full investigation and probable reform resulting from it. But then the usual suspects had to turn it into a beatstick and at this point the actual investigation and anything that might come of it is background noise to the burning and finger pointing.

As stated above, what is most concerning to me is the apparent normalisation and support of political violence going on in certain circles. If people directed justifiable anger I'd have no issue with that; but when they are indiscriminate, up to and including putting the torch to an apartment building full of people then blocking fire rescue from getting to it, one has to wonder if there is still an attachment to reality among the riot supporters.
