Commission ToS

Thank you for checking my ToS. Here are my terms:
• You must be over the age of 18 to commission me, regardless of whether the piece you are commissioning is NSFW. I reserve the right to ask you for proof that you meet this criteria and refund any payment and refuse to do the work if you cannot provide such proof or if it is not consistent with the payment details.• I reserve the right to an additional charge for working with characters from only a text description. If you don't have art to send me for reference, DO NOT send me an AI-generated reference as you will be blacklisted.
• I accept payment from PayPal only. I will NOT ask you to pay "friends & family" or in some other form where you have no chance to refund if I don't do the work. If anyone asks you to do that with my name it's a SCAM.
• If you claim a refund through PayPal after the work has been completed, this will be disputed
• If the style of a particular piece, or aspect of a particular piece in my gallery which I made appeals to you, you can ask me work with that specifically.
• You are expected to send payment within 48 hours of acknowledgment that you claimed a slot. If you fail to send payment within this time, you will lose the slot. Repeat offenders will be blacklisted.
• I have the right to refuse any commissioner for any reason
• Don't be a dick, or you'll be blacklisted and sent an appropriate refund if you've already paid. Just apply common sense and you'll be fine.
• I will NOT draw:
Minors in ANY situations
Genitals that are larger than the character they are attached to. I just don't appreciate the aesthetic.
Fanart of characters from existing franchises. Some exceptions may apply, don't be afraid to ask)
Gore, hard vore or excessive violence especially when this would glorify or attempt to erotically depict any of them (blood may be situationally acceptable)
Macro (but micro is fine)
Anything NSFW unless otherwise stated
WIPs and Edits
TL;DR: Will do free edits within reason according to the situation. When you are sent a WIP, work is paused until you approve it or request changes. You may edit my WIPs specifically show changes that you want to be made.• I will do up to 3 small edits and 1 sketch rework for free.
• If you ask for any edits which I could have been reasonably expected to notice from your ref(s), these won't be counted against your 3-edit quota.
• Try to provide as much detail as you can about what you want from me, otherwise I'm more likely to get things wrong and you're more likely to use up the 3 free edits. Having said that, artist freedom is fine but if I'm suffering from art block at that time there may be delays in sending you a WIP.
• Please leave it a week after we agree on all the details and you have sent payment before asking for a WIP! I will send you a sketch as soon as possible after everything is confirmed.
• I will not continue work on the piece until you approve the most recent WIP
• I will complete the work to the best of my ability and try to do so within a reasonable amount of time.
• Taking copies of WIPs and editing them to get across changes you want making is acceptable and encouraged: it's not always easy to put into words any change that you want making.
• If you ask for significant changes after the WIP sketch, you may be charged additional fees, have to accept the work as is, or ask for a refund.
Restrictions
TL;DR applying to all, not just commissioners: Don't mint/create NFTs of my art. Don't use my art with anything to do with AI. Don't use my art for commercial purposes. Don't use my art to represent any character when roleplaying extreme or illegal content. Ask the commissioner if you want to use art I made that they commissioned for personal use.These restrictions apply to art that others have commissioned from me, art I created that has not been commissioned, and apply to both commissioners and everyone else
• You may not mint/create NFTs of my art
• You may not use my art to train AI or machine learning systems for the purpose of generating art which resembles my own in style or content, or to enhance the quality of my art in any manner
• You may not use my art for commercial purposes
• You may not use my art to represent your roleplay character if you will be partaking in roleplaying extreme or illegal content, as this would indirectly present me in negative light for something which I never endorsed
• You must consult the rights holder of any art I have created for a person who has commissioned me, if you wish to use that art for personal use.
Exceptions and Additions to Restrictions for Commissioners
TL;DR: Only the commissioner and I have rights to use the art for merchandise or commercial purposes. Only the commissioner should have access to the version without a signature/watermark.• We, i.e. the commissioner and I and no one else, have joint rights to use the commissioned art for promotional and commercial purposes e.g.; merchandising
• You may request a copy of the commission with any background removed
• To transfer your rights to the art to any other person, you must meet the following conditions:
Your character is the only one in the piece
You abandon your own rights to the commission and ownership of the character (e.g.; you are selling the character in an art bundle auction or other manner as part of a collection of other art)
You include a copy of these rights and restrictions, in a way that clearly indicates the piece(s) associated with these rights and restrictions
You have reasonable and good faith expectation that the recipient will respect these rights and restrictions
Refunds
- obviously requests and other free art is exemptTL;DR: You can't scam me by demanding a refund higher than the price for the stage I've already completed the work for. If you breach my terms (or especially if you share private information) you'll be blacklisted, and refunded if appropriate. If you are unsatisfied with the work and can demonstrate why, you may be eligible for a partial refund.
• If you are in serious breach of these ToS you may be sent an appropriate refund and blacklisted
• If you are found to be sharing my or any other commissioner's private or personal information you will blacklisted, this would also be in breach of the FurAffinity Code of Conduct and you would be reported via trouble ticket. This does not affect your right to call me out with factual information if you feel within reason that I have scammed you, and likewise I reserve the right to do the same.
• If you have reasonable doubt that the finished piece is up to the expected standard or that it was not completed within a reasonable timespan, you may request a partial refund. And don't think you can pull this on me if you asked for a significant change too late into the piece and decided to go ahead with it anyway!
• You may request a refund up until after the finished piece is sent to you:
If you have not been sent a WIP sketch, you eligible for a full refund.
If the sketch has been completed, you are eligible for a half refund.
If flat colour has been completed, you are eligible for a refund worth 25% of the payment.
If when commissioning me you could quote any part of these terms to prove that you have read them, that would be great! Or better still, write a comment saying such. I reserve the right to remind or ask you about any of these terms if I suspect that you haven't read them.
