also why would they take gem off gwen it wasnt gwens fault for 1 incident a group of kids pranked her into doing, granted it was super bad but i wouldnt think they would just take gem away espechally since she would be wakeing up in a hospital allone i would of thought they would of let gwen in to be by her side for when she woke up
I dont know what its like in america but here in the UK child services are really err...they seem to be quick to take children even if sometimes its not the best course of action. its kinda a knock on effect from a couple of incidents here where children werent taken when they should have been and then died as a result so yeah the social services do a very difficult job and dont always get it right
basically group home care under the milieu system, like what happens in cases as described here. Kid gets injured near to the point of death CAS takes the kid out of the situation, you blame the kid for it.
It isn't so much the foster parents but the hostile situation with the children the foster parent has. Especially if the kids are birth children (or real children as I recall calling them)

Wow, a week-long coma ... I'm guessing Gem fell, hit her head, and breathed in a lot of water. She may have nearly drowned, and it sounds like she was only rescued just in time. Nev and his gang probably figured that if they just didn't say anything, and Gem died, the authorities would figure out who was responsible, and then they'd be on trial for murder. But if they told the authorities, they'd still be on trial for attempted murder, but at least they'd have the fact that they confessed on their side.

There are 10 year olds here that have been convicted of 1st Degree Murder. Technically, though it would be attempted 2nd degree Manslaughter if charges were determined to be appropriate in the story as posed.
Because Gem was in a coma for 5 days the kids were directly responsible for a life threatening injury due to their actions. The intent was to harm and cause physical pain but not to maim or kill. That at least in Canada (which follows alot of similar statues to UK common law) is enough for a second degree offence. Unlike in the US, unless you can prove the original intent was to kill--then its manslaughter.
But at that age criminal responsibility is impossible, so there is another statue that could be used to remove the victim and blame the foster parents. Not only that but when kids kill, there are tragic tragic circumstances that pose some pretty hard mitigating factors. So much in fact that its often referred to as a "justified killing' that, in Canada at least lends to extremely reduced punishment.

In the USA, it depends on the state and its laws, but they did intentionally and knowingly put her in a situation that would have led to her death -- leaving her down a well, with nobody else aware of where she was. That's no different than, I dunno, tying someone to the railroad tracks, or locking them in one of those rooms from the movies where the walls close together. She's got no way out and no food down there, and it probably gets pretty cold so she might freeze to death too. I'm not a lawyer, and I know even less about UK laws than about USA ones, but those kids are in real trouble, I'd say. They're kids, so their defense might be that they didn't realize that they could've killed her.

Yeah sadly it doesn't happen because such kids don't get sent to juvi until they actually kill someone or cause problems for adults. Then they never come out again.
The system knows about these kids and they carry BIG money so the local agencies don't do anything about it and just shuffle the others around to accommodate for such young criminals who do things like what happened to gem.
This includes sexual abuse too.

Gem I'll say this you've done a good job provoking emotions with this. But I still don't get child services taking her away from Gwen. I mean I'd imagine the kids confessed when questioned about it due to Gwen reporting Gem missing. And given this was a case of her being lured away it makes no sense to remove the child. I mean did those kids get in trouble at all? Especially the Deer boy. I mean what he did I think an attorney could make a case for attempted murder or something of the like. Cuz I mean this went beyond prank into nearly killing someone.
Because kids that young who commit crimes cannot be held responsible so they hold the parent responsible instead...

Ah reading your other post I see that yes that Manslaughter would be appropriate but again I think an attorney could still argue for a second degree attempted murder. I doubt they'd win but it could be argued. Though I think I see some legal differences here. In the US a child be charged with a crime and while they might not be tried as an adult I could still see this case leading to a lengthy term in a Juvenile facility. Still though I have trouble understanding how in this case under these circumstances that removal of the victim from the home would be appropriate.
You can only send kids 12 and above to Juvinile detention faculties. Even then such kids are placed in minimum level security until their 14.

im sure the gang got in trouble but lets all remember theyre only 9-10 years old they werent out to hurt gem which is why when she was discovered missing in the morning they took the authorities to the well. The fact that fyari didnt notice gem missing till morning would have been enough in the authoriies eyes to remove Gem, the authorities would have wanted to be seen to be doing something as no doubt this incident would have probably gotten media coverage, bear in mind fyari hadnt adopted Gem she was a foster carer which is a temporary position.
I think this might be a difference of laws. Here I think these kids or at least the boy despite their ages could still be facing criminal charges because of this. It doesn't matter that they didn't intend to nearly kill her. Now that said I don't think any of them would be tried as adults but I would think at least the boy would wind up serving at least some time in a Juvenile correctional facility with perhaps a lengthy probationary period afterwards with mandated therapy sessions.
Ah so basically just Mr. Yankee here thinking in terms of US Law. XD Sorry. I guess in a way it's probably better. One has to wonder if our system gets justice or takes a an already messed up kid and pushes em to an extreme where a few years down the road the adult justice system has to deal with em.
At any rate though again very good story. You definately got this Liger's emotions going. Here's hoping Karma at least comes around to that deer kid and teaches him the error of his ways. Oh and here's to happier times though. ^^ I betcha if this story's made so many of us just wanna give Gem a hug I'd imagine Mr. Lion there feels the same way listening to it. ^^

What kind of injuries has Gem sustained? Whatever it is there was no water in the well, to break her plummet. Confession from these sadists? They still deserve 5 years of detention and reformation. Rather unfair Gwen should be deemed unfit for further care, she had nothing to do with Dev's prank. You really need a visit from your schoolmates to cheer you up Gem. Hope that you do not move school too.

Well, one difference between her story and mine, (the goons in mine never came to rescue me) I was passed out under a rock formation in God knows wherever in the desert, and I hadn't eaten or drunk anything for 3 days, and when you are 12, starvation and dehydration kill you faster. I remember the moment I woke up in the hospital, I had bandages around my arms, neck, torso and legs, because, even in November, the heat is still unbearable in Arizona. Especially in the desert. I was told by the doctor that I was the luckiest person in the world, because I should have died for how long I lasted in the blistering sun and the freezing nights, without eating or drinking anything. It was a miracle that a helicopter pilot helping out on the search for me saw me laying there under the rock formation trying to cool down, about to suffer from a heat stroke (I don't remember anything beyond this point, but I do remember feeling my heart beat start to accelerate so rapidly that I could see the blood vessels in my eyes in my vision. I remember looking down at one of the burns on my arm and my skin looked like it was from a horror movie with the surface of my skin looking almost a light tomato red. (I had 2nd degree burns) I was lucky the high that day was only 88*, with a heat index of 97*.
I lost consciousness soon afterwards and I do 100% remember the feeling of dying.

The good thing is, 2 of the boys in the group were arrested for a whopping 4 charges, because they were minors. All of them felony charges, each boy was charged with \

2 Conspiracy to commit murder (Overturned when they proved they were only a part of bringing me out to the desert)
3 Tampering of Evidence (They tried bribing an investigator to change a report given by a fellow student about how this wasn't the first time they had been a part of something similar.)

They asked me if I wanted to file the charges against them, and I said no. I did want to hunt down the cult leader and bring him to justice, which I eventually did.
All I gotta say is don't be a bully, because though being a bully may make you seem like an unstoppable bitch, all I gotta say is karma is even bitchier.
