Let me start by saying this situation hasn't come up, its not something I am mulling over for any particular reason. It just kind of occurred to me while I was fucking around and I am curious how other people feel on the matter.
Does the original artists TOS still apply after the piece has been resold?
My thoughts: Technically only the original purchase agrees to the original artists TOS <unless its a closed species situation of course>. Original artists do not generally include clauses in the TOS to cover their piece for its perceivable lifetime if it switches hands. So how much say should they have over future owners? I rarely see resales that require the new owner abide by the original creators TOS either.
So let's say the creators TOS says you may NOT change the design at all, I use this one because its the most likely one I will have issue with. The design is a one off, not part of a species or anything. Piece is then sold.
Second or third owner down the line buys it because they love it, but would like to make changes. How much right do you think the original creator would have in saying they cannot change the piece per the artists standard TOS?
